Executive Summary
Recommendation to approve and authorize the Chair to sign one Release of Lien for full payment in the amount of
$12,676.32 pursuant to the Agreement for Deferral of 100% of Collier County Impact Fees for owner-occupied
Affordable Housing Dwellings.
OBJECTIVE: To support the County’s affordable housing community development strategic objective utilizing the
Impact Fee Deferral program.
CONSIDERATIONS: Pursuant to Article IV of Chapter 74 the Collier County Code of Ordinances, the County may
defer the payment of the impact fees for any new owner-occupied unit which qualifies as affordable
housing. Section 74-401(a)(3) of the Code of Laws authorizes the County Manager to enter into an impact fee deferral
agreement with the developer, homeowner or applicant. The deferred impact fees shall be a lien on the property, and the
agreement shall be accepted by the County in lieu of prompt payment of the impact fee that would otherwise be due and
payable.
In this case, the impact fee became due upon the developer’s inability to transfer the property to a qualified family
within six months of obtaining the CO for the property. Therefore, the developer has paid the deferred impact fees. The
following table details the associated deferral agreement that has been repaid in full. As such, satisfaction of lien is
required.
A total of $12,676.32 was paid to Collier County into the appropriate impact fee trust funds.

This item is consistent with the Collier County strategic plan objective support comprehensive affordable housing
oportunities.
FISCAL IMPACT: A recording fee of $10 per Release of Lien will be paid by Affordable Housing, Fund 1077, Project
50137.
GROWTH MANAGEMENT IMPACT: The Impact Fee Deferral program assists the County in meeting some of the
Housing Goals and Objectives in the Growth Management plan.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote for Board

amount of $12,676.32 pursuant to the Agreement for Deferral of 100% of Collier County Impact Fees for owner-
occupied Affordable Housing Dwellings.
