Executive Summary
Recommendation to approve an Agreement between the Board of County Commissioners, as the ex officio Governing
Board of the Collier County Water-Sewer District (hereinafter referred to as the CCWSD), the Board of Supervisors of
the Big Cypress Stewardship District (hereinafter referred to as the District), CDC Land Investments, LLC, and Collier
Land Holdings, Ltd., (hereinafter referred to as Landowners) to exclusively provide potable water, wastewater and
irrigation quality water services to the Town of Big Cypress Stewardship Receiving Area (SRA) development, repealing
and replacing the prior Agreement dated June 27, 2023 and recorded at OR 6266, Pages 2221-2231 of the Public Records
of Collier County, Florida. (This item is a companion to Item 16C6)
OBJECTIVE: The public purpose is to provide public infrastructure and facilities to effectively, efficiently, and
sustainably meet the needs of the community. This action is to update the existing utility agreement to reflect changes in
the Town of Big Cypress SRA development and associated utility service requirements.
CONSIDERATIONS: On June 27, 2023, agenda item 16.C.2, the Board approved a Utility Agreement for the CCWSD
to exclusively provide potable water, wastewater and irrigation quality water services within the Town of Big Cypress
Stewardship Receiving Area development. The Agreement was recorded at OR 6266, Pages 2221-2231 of the Public
Records of Collier County, Florida. A new agreement has been formulated to address the negotiated changes outlined
below. The Board’s approval of this new agreement will repeal and replace the June 27, 2023, agreement.
Changes include:
1. Incorporated requests from CCWSD to upsize pipes to meet projected demand of additional towns and villages.
2. Absorption schedule update, identified in Exhibit A
3. Relocation of the future utility site south, near 10
th Ave NE, identified in Exhibit B
4. Provide an updated reimbursement cost from the CCWSD to the District for upsizing the potable water
transmission mains, wastewater force mains, irrigation water transmission facilities, including an upsize to a 20-
inch pipe along Oil Well Road at the request of the CCWSD, in an amount to not exceed $4,367,310, identified
in Exhibit C.1 along with Mitchell & Stark (Labor) in an amount not to exceed $996,306 and Ferguson
(Material) in amount not to exceed $530,406, identified in Exhibit C.
5. Provide an updated reimbursement cost from the CCWSD to the District for the IQ main extension in the
amount not to exceed $3,048,337, identified in Exhibit C.2
6. Provide an updated reimbursement cost from the CCWSD to the District along with the cost of upsizing potable
water and wastewater mains in the amount not to exceed $2,133,200, identified in Exhibit C.3
This item is consistent with the Collier County strategic plan objective to maintain public infrastructure and facilities to
effectively, efficiently, and sustainably meet the needs of our community. It further is in support of the Infrastructure and
Asset Management Strategic Focus Area’s objectives to optimize the useful life of all public infrastructure resources
through proper planning and preventative maintenance.
FISCAL IMPACT: Funding is available in the water and wastewater impact fee funds (4011 and 4013, respectively).

This action will increase the reimbursement cost from the CCWSD to the District by $4,329,093. The companion item
(16.C.7) reduces the fiscal impact by a reduction in reimbursement cost by $3,647,058. The net Fiscal impact is an
increase of $682,035.
GROWTH MANAGEMENT IMPACT: This item meets current Growth Management Plan standards to ensure the
adequacy and availability of viable public facilities.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority vote for approval.
