Executive Summary
Recommendation to approve the release of three code enforcement liens with an accrued value of $234,650 for a reduced
payment of $4,991.30 in the code enforcement actions titled Board of County Commissioners vs. Titus Enterprises, LLC,
relating to the property located at 2185 Markley Ave, Collier County, Florida.
OBJECTIVE: To have the Board of County Commissioners accept an offer to release three code enforcement liens
with an accrued value of $234,650 for payment of $4,991.30 in relation to Code Enforcement Special Magistrate Case
No. CEVR20220007489 and Code Enforcement Board Case Nos. CENA20220007701 and CESD20220007782.
CONSIDERATIONS: As a result of code violations on this property, the Code Enforcement Special Magistrate (SM)
and Code Enforcement Board (CEB) ordered the following imposition of liens against Titus Enterprises, LLC, as
follows:
In SM Case No. CEVR20220007489, the violation consisted of clearing vegetation prior to obtaining a Vegetation
Removal Permit. The lien was recorded in the Official Records on September 24, 2025, at O.R. Book 6510, Pages
2123-2125, in the amount of $24,912. The fine amount of $24,800 is based on 224 days of accrued fines ($200 per day
from May 30, 2024, through August 6, 2025), and $112.00 in operational costs was paid on October 1, 2025. The
property was brought into compliance on August 6, 2025.
In CEB Case No. CENA20220007701: the violation consisted of litter and illegal outdoor storage, including, but not
limited to, recreational vehicles, furniture, unlicensed trailers, building materials, and refuse. The lien was recorded on
May 15, 2025, at O.R. Book 6468, Pages 1882-1884 in the amount of $85,059.49. Fines continued to accrue, and the
amount of $90,600 is based on 453 days of accrued fines ($200 per day from February 25, 2024, through May 22, 2025).
The property was brought into compliance on May 22, 2025.
In CEB Case No. CESD20220007782, the violation consisted of an agriculturally zoned property with multiple
structures requiring permits, including but not limited to multiple greenhouse structures over 100 feet in footprint, a
mobile home, and a set of stairs leading up to the mobile home’s door. The lien was recorded on May 15, 2025, at O.R.
Book 6468, Pages 1825-1827 in the amount of $116,059.63. Fines continued to accrue, and the amount of $119,250 is
based on 477 days of accrued fines ($250 per day from January 17, 2024, through May 7, 2025). The property was
brought into compliance on May 7, 2025.
Pursuant to Resolution No. 2023-90, a request for reduction of fines may be considered, in part, when a lien encumbers
property under new ownership, and the new owner has diligently pursued abatement and achieved compliance, and/or
when payment of the lien would impose a severe financial hardship on the owner. The property is being actively
maintained by Titus Enterprises, LLC., and offers to pay $3,000 to settle the liens; however, Code Enforcement
recommends accepting payment of $4,991.30.
The recommended payment of $4,991.30 is based on ten percent of the Collier County Property Appraiser’s Assessed
Value of $499,130 and meets the criteria outlined in Resolution 2023-90. There are no known violations at this time.
This item is consistent with the Collier County strategic plan objective to preserve and enhance the character of our
community.
FISCAL IMPACT: Acceptance of payment of $4,991.30 to settle the lien will correlate to what is outlined in Collier
County Resolution 2023-90.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and
legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution
2023-90.-RTT

southeast corner of the property.

who is interested in purchasing the parcel and
the Zoning desk referred her to Environmental
Review due to the protective zoning overlays
in place (Rural Fringe Mixed Use-Sending
Lands Overlay and North Belle Meade
Overlay). These overlays limit the maximum
amount of clearing that can occur. While
looking up the folio for any previous Wetland
Determination or permit issued, I discovered
these 3 open Code cases. I made Ms.
Perez aware of the 3 alleged violations and
advised if someone purchased the parcel that
the Code cases would be re-opened in their
name and new owner would be responsible
for abating whatever violation was discovered
to exist even though new owner hadn’t
created the violation. I also answered
additional questions she had about
environmental issues, permitting, wetlands,
etc. Ms. Perez said the parcel is
advertised for sale on Zillow website. I sent
Instant Message to Investigator to inform him
of the call.

amount of clearing that can occur. While
looking up the folio for any previous Wetland
Determination or permit issued, I discovered
these 3 open Code cases. I made Ms.
Perez aware of the 3 alleged violations and
advised if someone purchased the parcel that
the Code cases would be re-opened in their
name and new owner would be responsible
for abating whatever violation was discovered
to exist even though new owner hadn’t
created the violation. I also answered
additional questions she had about
environmental issues, permitting, wetlands,
etc. Ms. Perez said the parcel is
advertised for sale on Zillow website. I sent
Instant Message to Investigator to inform him
of the call.
