Executive Summary
Recommendation to approve the release of a code enforcement lien with an accrued value of $724,400 for a reduced
payment of $1,434.40 in the code enforcement action titled Board of County Commissioners vs. Janet Sneeden, in Code
Enforcement Board Case No. CESD20110009351, relating to property located at 540 Platt Rd., Collier County, Florida.
OBJECTIVE: For the Board of County Commissioners to accept an offer to release a code enforcement lien with an
accrued value of $724,400 for a reduced payment of $1,434.40 in relation to Code Enforcement Board Case No.
CESD20110009351.
CONSIDERATIONS: In Case No. CESD20110009351, the Code Enforcement Board ordered the imposition of a lien
against property located at 540 Platt Rd., Collier County, and owned by Janet Sneeden. The violations consisted
of modifications to the main structure without first obtaining Collier County Building Permits. The lien was recorded in
the Official Records on May 9, 2012, at O.R. Book 4795, Pages 743–744, in the amount of $6,600. Fines continued to
accrue for 3,622 days ($200 per day from March 25, 2012, through February 22, 2022), totaling $724,400. The owner
brought the property into compliance on February 22, 2022.
Pursuant to Resolution No. 2023-90, a request for a reduction of fines may be considered when payment of the lien
would impose severe financial hardship on the owner. Janet Sneeden states that the modification (an enclosed
room/porch) was attached to the main structure when she purchased the home, and she was unaware that a permit was
required to tear it down. The property is being actively maintained, and the owner offers to pay $5,000 to settle
$724,400 in accrued fines; however, Code Enforcement recommends the Board accept $1,434.40 to settle the fines.
The recommended payment of $1,434.40 is ten percent of the Collier County Property Appraiser’s Assessed Value of
$14,344 and meets the criteria outlined in Resolution 2023-90. There are currently no known violations on the property.
This item is consistent with the Collier County strategic plan objective to preserve and enhance the character of our
community.
FISCAL IMPACT: Acceptance of payment of $1,434.40 to settle the lien will correlate to what is outlined in Collier
County Resolution 2023-90.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and
legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution
2023-90. RTT
RECOMMENDATION(S): To approve the recommended reduction of fines in the amount of $722,965.60, accept
payment in the amount of $1,434.40, release the lien, and authorize the Chairman to sign the attached release and
satisfaction of lien for recording in the Official Public Records.

Paul in permiting. Questions were raised and
clerification was made on court order. He

compliance.

a meeting took place on site with myself,
Ranauld Paul and property owners Janet and
Eric. We were able to determine that the
addition in question has been removed and
that a demolition permit is what is required
per Mr. Paul. A meeting was scheduled with
Mr. Paul and property owners for Monday 08-
30-2021 at GMD on Horseshoe at 1030-11 to
administer the application for permit. This is
certainly progress in compliance after 10
years. I will continue to update case.
