Horseshoe Drive Naples,FL 34104 RE: Request to Toll or Reduce Fines-Case CESD20210004950 Dear Members of the Code Enforcement Board: I am writing regarding the above-referenced case,in which a prior order required that I obtain the necessary after-the-fact approvals for improvements located at my property at 191 Smallwood Drive. I understand that today's hearing concerns only the potential imposition or continuation of daily fines. I respectfully request that the Board toll (pause) the accrual of any additional daily fines and reserve the ability to reduce any fines already accrued once the active County review process is completed. Since receiving notice of the required approvals, I have made continuous and substantial efforts to bring the property into full compliance. These efforts are documented in the materials submitted to the Board, including: • Engagement of licensed surveyors and engineers; • Preparation and submission of the Site Plan with Deviations (DR) and Site Improvement Plan (SIP) applications now under active County review; • Receipt and response to County review comments dated May 5,2025 and May 8,2025; • Submission of Submittal 2, containing revised plans and a comprehensive engineering response addressing zoning,ADA,landscape,transportation,and technical comments; • Continued communication and coordination with County staff and engineering professionals from 2024 through November 2025; • Preparation of required exhibits including setback measurements, landscape plans with photos, seating plans, ADA and right-of-way photos, historical aerials, and other information requested by staff. These actions demonstrate consistent and ongoing good-faith compliance. �.,. Any remaining delays relate to the County's own multi-department review process, which requires several rounds of technical comments and revisions before approval. Under Florida Statute§ 162.09(2),the Board is required to consider: 1. The gravity of the violation, 2. The actions taken to correct the violation, and 3. Any prior violations. The zoning map shows the areas that are zoned Village Residential, C-4, TTRVC which is considered a commercial zone. Historically, many of the residents and visitors walk to the restaurant.A proven industry standard is that most people will walk a ''/ mile instead of driving especially in a village/resort area. The use of the building has changed over time. The records are not clear on the original uses however, the property card for the Post Office, does list the years the buildings were originally constructed beginning in 1965, 1972 and 1973. The recent uses have included a Post Office that was established via Building Permit #83-2545 (enclosed). Permit #2004012464 (enclosed) approved the Havana Cafe remodel of the interior of the northern portion of the building to accommodate a 20 seat cafe. Justification: The existing parking layout includes 10 spaces plus one Handicap space onsite.The County has required that the parking within the Smallwood Drive ROW be removed of which the applicant has agreed to.The purpose of this deviation is to allow the shortfall of 22 parking spaces.The Havana Café is the only restaurant development on Chokoloskee.The remainder of the island is residential. Over the years many of the residents have been walking,bicycling or driving golf carts to the restaurant. In fact, Chokoloskee Island along with Plantation Island was approved for the use of golf carts to be driven on the islands pursuant to Ordinance#2019-16."Golf carts may be operated on county roads and streets on Chokoloskee Island and on Plantation Island,Florida,with the exception of Plantation Parkway from approximately 850 feet north of Spoonbill Avenue to CR 29 and also on CR 29 from approximately 1120 feet north of Demere Lane north to end of County maintenance(approximately 2750 feet south of Plantation Parkway)." Chokoloskee Island is a small-scale community that is only± 147 acres which is conducive to pedestrian,bicycle and golf cart modes of transportation.The Pedestrian Shed and Zoning Map Exhibits depict'/.mile and %:mile distances from the subject property. The site plan depicts the location of a new bicycle rack to be installed per code.And golf carts can use the parking spaces.This scenario minimizes the demand for automobile parking. June 17, 2022 Peninsula Engineers prepared detailed Map of Boundary Survey for review by Planning and Zoning, resulting in property owners continuing changes for compliance. One of the delays was Amerigas taking a year to secure permits to move and relocate their tanks. September 28, 2022 Hurricane Ian catastrophically destroyed our area with high winds and floods affecting a broad area from Everglades City and surrounding area to Ft. Myers. This caused further delays in our efforts to conclude our compliance as they were superimposed by emergency cleanups and new constructions. Subsequently, 2023,was a hardship for everyone.
