RELATING TO PETITION NUMBER V-B9-B FOR A
VARIANCE OF PROPERTY HEREINAFTER
DESCRIBED IN COLLIER COUNTY,
FLORIDA.
WHEREAS, the Legislature or the State of Florida in Chapter
125, Florida Statutes, has conferred on all counties in Florida
the power to establish, coordinate and enforce zoning and such
business regulations as are necessary for the protection of the
public, and
WHEREAS, the County pursuant thereto has adopted a
Comprehensive Zoning Ordinance establishing regulations. for the
zoning of particular geographic divisions of the County, among
Which is the granting of variances, and
WHEREAS, the Board of Zoning Appeals being the duly elected
constituted board of the area hereby affected, has held a public
hearing after notice as in said regulations made and provided,
and has considered the advisability of a 0.3 foot variance tram
the required (northeast) side yard setback of 10 feet to 9.7
feet and a 1.5 foot variance from the required rear yard setback
of 25 feet to 23.5 feet as shown on the at~ached plot plan,
Exhibit "A" in a Planned Unit Development (PUD) zone tor the
property hereinafter described, and has found as a matter of
tact that satisfactory provision and arrangement has been made
concerning all applicable matters required by said regulations
and in accordance with Sectio'~ ll.l.b ot the Zoning Regulations
tor the unincorporated area of Collier County, and
WHEREAS, all interested parties have been given opportunity
to be heard by this Doard in public meeting assembled and the
Board having considElred all matters presented,
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF ZONING APPEALS
of Collier County, Florida, that the petition of Porter Homes,
Inc., represente1 by John W. Emerson with respect to the
property hereinafter described as:
Site 26, Block D, Pelican Bay, Unit 4, according to
the plat thereof, recorded in Plat Book 13, Pages
30-32 of the Public Records ot Collier County,
Florida.
