All other applicable state or federal permits must be obtained before commencement of the development. 2. This conditional use is limited to that which is depicted on the Conditional Use Conceptual Site Plan (Revised September 25,2025)and prepared by Q. Grady Minor and Associates, LLC. 3. At the time of Site Development Plan (SDP),the owner shall submit plans illustrating that outdoor lighting for the parking areas is designed to reduce light spillage beyond the property lines. For services and other periods and events of significant traffic generation, as determined by Collier County staff,the property owner shall provide traffic control by law enforcement or a law enforcement-approved service provider as directed by Collier County staff,with staffing and at location(s) as directed by the Collier County Transportation Administrator or his designee. 7. The maximum total daily trip generation for the CU shall not exceed 20 two-way PM peak hour net trips based on the use codes in the ITE Manual on trip generation rates in effect at the time of application for SDP/SDPA or subdivision plat approval. 8. Private school or day care services are not included nor allowed. Childcare is permitted during religious services. 9. No outdoor amplified sound shall be permitted. 10. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: SECTION ONE: ADOPTION OF AMENDMENT TO THE GROWTH MANAGEMENT PLAN The Board of County Commissioners hereby adopts this small-scale amendment to the Urban Golden Gate Estates Sub-Element of the Golden Gate Area Master Plan and Golden Gate Future Land Use Map and Map Series in accordance with Section 163.3184, Florida Statutes. The text and map amendment are attached hereto as Exhibit "A" and incorporated herein by reference. SECTION TWO: TRANSMITTAL TO THE FLORIDA DEPARTMENT OF COMMERCE The Board of County Commissioners directs transmittal of the adopted amendment to the Florida Department of Commerce. SECTION THREE: SEVERABILITY. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION FOUR: EFFECTIVE DATE. The effective date of this plan amendment, if the amendment is not timely challenged, shall be 31 days after Board adoption. Schmitt,Chairman Oat La- Approving this conditional use would violate the stated GOALS AND OBJECTIVES in a number of ways. GOAL 1: TO GUIDE LAND USE AND PUBLIC FACILITY DECISION MAKING AND TO BALANCE THE NEED TO PROVIDE BASIC SERVICES WITH NATURAL RESOURCE CONCERNS THROUGH A WELL-PLANNED MIX OF COMPATIBLE LAND USES WHICH ENSURE THE HEALTH, SAFETY,WELFARE,AND QUALITY OF LIFE OF THE LOCAL RESIDENTS. GOAL 3: TO PROVIDE FOR LIMITED COMMERCIAL SERVICES AND CONDITIONAL USES FOR PURPOSES OF SERVING THE RURAL NEEDS OF GOLDEN GATE ESTATES RESIDENTS, SHORTENING VEHICULAR TRIPS,AND PRESERVING RURAL CHARACTER. The petition does meet some of the standards set but not the ones I highlighted. I'd like to explain some of the reasons these standards would be violated. There will be a legitimate traffic concern which will affect the QUALITY OF LIFE OF THE LOCAL RESIDENTS. The entry to the church will not be from an arterial or collector roadway(more about that later)but from a two-lane residential road adjacent to the intersection of that road and a major arterial roadway.This narrow residential road also provides access to the CREW Bird Rookery which already increases traffic on this road. Bird Rookery attendance on Sunday during high season is between 165 and 389 with an average of 266. There are currently 41 homes that use Shady Hollow Blvd to access their property. There are an additional 92 lots that would use Shady Hollow Blvd once a home is built. We have been seeing 3-4 of those lots convert to homes each year. Brightshore Village will be adding 2000 homes north of the proposed church on Immokalee. The Church"expects"a maximum of 120 vehicles and are spreading that out over 30 minutes after the service coming up with 4 cars per minute. A more concerning number is calculated before the service. Most churches I see have the majority of parishioners arrive within a 15 minute window so assuming 100 cars in 15 minutes you get 6.7 cars per minute.Those would never be spread out evenly so I think it's safe to say that there would be times where it is double that. This would be 1 car every 5 seconds or so. Add the residential and Rookery traffic and it gets even worse.With a single lane at this point on Immokalee, even with turn lanes,this would result in cars stopped in the active lane mostly in the northbound lane. This is an accident waiting to happen. The CCSO already has deputies directing traffic at other churches on Immokalee where there are three lanes each direction. Any overflow parking(on special occasions?)will be on the edge of a small two-lane road without any type of edging.It is too small for U-turns so those parking on the street will have to do 3-point turns or use residential driveways to turn around. They claim limited use on Sunday(and one other day?). If they decide to open a daycare,would they be allowed to do that or would the waiver be based on their current proposal of only two days per week?A day care would cause similar traffic concerns within a very narrow window of the opening and closing times of the daycare and would be a daily occurrence In the GOALS AND OBJECTIVES,NATURAL RESOURCE CONCERNS, and PRESERVING RURAL CHARACTER are mentioned.This is more subjective than the traffic concerns but two things immediately come to mind. We share our neighborhood with all kind of wildlife including panthers, bears,and bobcats(even alligators)as well as numerous bird species. We are able to coexist on our properties and it is one of the things we love about living here. There is no way the wildlife would be able to do the same with what is essentially, if not by definition,a commercial property. The paved parking light with the lights that are inevitable are very much not in line with nature and offer no benefits to the local fauna.Many of our lots provide shelter, food, and a home for them. Are you able to require Dark Sky lighting? Personally,when I turn off Immokalee onto Shady Hollow Blvd after dark,I get an immediate feeling of peace and quiet. It is dramatic how that first 50 feet off the major lighted highway makes a difference. With a lighted parking lot as the first thing I will see,this feeling will no longer be associated with leaving the highway. The conditional use waiver must meet one of the following 4 sets of criteria of the Conditional Uses Subdistrict,one of which must be met. 1. must be to provide essential services. 2. must be near a neighborhood center 3. must be adjacent to an existing non-residential use 4. or it must be on and oriented toward arterial or collector roadways. This petition doesn't meet any of the four and based on this alone,no conditional use should be permitted. If allowed, it becomes an existing non-residential use and opens it up to even more of the same with future petitions able to meet criteria number 3 so this is even more significant to reconsider and not pass your approval to the commissioners. The petitioner,in a meeting on August 11,2025, stated that the main reason they want to build on this lot was because they were able to get it at a good price. Other lots that would not require the waiver or would qualify for the waiver,which this lot does not,would cost(significantly)more than this"residential"lot. It is not the county's duty nor should it even be the county's concern to save money for the petitioner. They knowingly bought a residential lot at a residential lot price. In closing,and perhaps the most pressing issue and one that you need to acknowledge as a decision- making body is the SAFETY issue.This intersection will without question be made less safe if a church is allowed to be built at this location.The single northbound lane doesn't support the kind of traffic that this church will generate even if it is for a short time on Sunday mornings.One reason I have put these concerns in writing is so that there is a record of you being made aware of this issue. Please don't have it come up at a future date after someone is seriously injured or worse.
