RESOLUTION NO. 89-~
RESOLUTION AUTHORIZING PRELIMINARY ACCEPTANCE
OF THESE ROADWAY AND DRAINAGE IMPF\OVEMENTS IN
GRASSMERE, PHASE I AT WYNDEMERE AND ACCEPTING
THE MAINTENANCE BOND FROM THE DEVELOPER FOR
MAINTENhNCE OF THE ROADWAY AND DRAINAGE
:~PROVEMENTS FOR Ii MINI~ruM OF ONE YEAR.
~~ERE~S, the Board of County ~ommissioners ot Collier County,
Florida, on August 16, 1988 apprt;..':1d the plat of Grassmere, Phase
I at Wyndernere for construction; and
WHEREAS, th~ developer has constructed the roadway and
drainage improvements in accordance with the approved plans and
specifications and as requin~d by the Subdivision Regulation&
(Ordin~nce 76-06, as amended) and the Utilities Standards and
Procedures Ordinance (Ordinance 88-76, as amendecl); and
WHEREAS, the developer has now requested preliminary
acceptance of the roadway and drainage improvements and release of
his COilstruction security after an acceptable maintenance security
is provided: and
m1EREAS, the Compliance Services Section at the Development
Services Department has inspected the roadway and drainage
improvements and is recommending preliminary acceptance of said
facil i ties;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLoRIDA, that preliminary
acceptance be granted for these roadway and drainage improvements
in Grassmere, Phase I at Wyndemere.
BE IT f~RTHER RESOLVED AND ORDERED that the County accept the
maintenance security in the amount of $34,485.68 and that the
developer is responsible for the maintenance of the roadway and
drainage improvements for a minimum period of one year as required
by the as required by the SUbdivision Regulations Ordinance 76-06,
as amended and the Utilities Standards and Procedures Ordinance
(OrdLlance 88-76, as amended), at which time the developer must
petition the Board for final accep~ance.
This Resolution adopted
favoring same.

4. A certificate of completion of the improvements by the
Developer's ongineer, along wit!1 the final project records have
been furnished to and approved by the Dcvclorment Services Director
for compliance with th~ Collier County Subdivision RegUlations.
~. Th~ Developer agrees to ~aint~in all required
improvements for u period beginning aftor acceptance of all
required improvements, and ending upon completion of a satisfactory
final inspection, but not less than one year; after the maintenance
period by the Developer has tcrmin~ted the Development Services
Director shall inspect all the required improvements and, if found
to be still in compliance with Collier County Subdivision
Regulations as reflected by final acceptance by the Board, the
D13velopcr's responsibility for mairltenance of tho required
impr:-ovcrnents shall tcnninate and the Board shall release the 10%
Surety, otherwise the Developer's responsibilty for maintenance
shall continue until final acceptance by the Roard.
6. All of the terms, covenants and conditions herein
contained are and shall be binding upon the respective successors
and assigns of the Developer.
IN WITNESS WHEREOf, the Board and the Developer have caused
this Agreement to be executed by their duly authorized
