Respondent, Dakota Davison(Davison) is the owner of the dog named BJ. 2. On May 25, 2025 BJ bit Timothy Dunne(Dunne) on a public roadway. Dunne was riding an electric scooter. BJ was tethered to a golf cart. It is undisputed that Mr. Dunne was bitten and BJ was the dog which bit him. 3. The Petitioner made a determination, pursuant to Collier County Code of Laws and Ordinances, Chapter 14, Article II, Section 14-38,that BJ was a dangerous dog.Notice of such determination was transmitted verbally to the Respondent on or about May 26, 2025. Notice of such determination was made to the Respondent via hand delivery of a document entitled"Collier County Domestic Animal Services Sufficient Cause to Classify Dog as "Dangerous"Pursuant to Collier County Ordinance Chapter 14 Article II Section 14-38 and/or Chapter 767 Florida Statutes" on July 2, 2025. Such hand delivery was acknowledged by the Respondent signing a"Dangerous Dog Acknowledgement". The Dangerous Dog Acknowledgement reflected that"Dakota Davison"had received the following forms and/or documents: "CCACO 14-38 and Chapter 767 Florida Statutes, Dangerous Dog Sufficient Cause Letter, including appeal options, Dangerous Dog Registration Application."(hereafter Notice)Cara Frank of Collier County Domestic Animal Services testified to the delivery of the aforementioned Notice. 4. The notice provided made reference to the applicable laws and ordinances that set out procedures and penalties for a dangerous dog determination. 5. Respondent timely challenged the Petitioner's determination that BJ was a dangerous dog. A Notice of Hearing was mailed to the Respondent by the Petitioner. The Notice of Hearing stated that a hearing was to be held on a violation of"Dangerous Dog 14-38." 7. Respondent was duly noticed for the public hearing and was present at the hearing with attorneys Michael-Anthony Pica and Lisa Difilippo. 8. All testimony presented at the hearing was under oath. 9. It is uncontroverted that the bite took place on a public roadway near Goodland boat ramp. 10. Davison presented testimony that she knows Dunne and has had 5-6 incidents with him and their dogs. She testified that Dunne teased BJ and rode his scooter close to her and BJ. She testified that there was never a police report filed. She further testified that BJ responds to commands, but not consistently. BJ apparently responds better to Ms. Jones that Mr. Wensel. 11. Ms. Tanya Jones, mother of Ms. Davison testified that she and Mr. David Wensl were walking BJ, attached to their golf cart when Mr. Dunne passed by on an electric scooter. They felt threatened due to the noise from the scooter and its proximity to them. BJ lunged for Mr. Dunne and broke out of his collar allowing him to reach Mr. Dunne, knock him over and bite him. It is Ms. Jones' testimony that BJ was protecting them. Ms. Jones also testified to her recollection that Dunne had prior interactions with the Respondent and BJ. 12. Mr. David Wensel, Ms. Jones' spouse,testified that he was in the golf cart at the time of the incident in question today. He largely corroborated the testimony of Ms. Jones. 13. The Respondent testified that she has had several incidents with Mr. Dunne passing them closely and sometimes made verbal comments. There is a previous incident where Mr. Dunne's and Ms. Jones' dogs got into an altercation. She paid the fine for that citation. 14. Mr. Dunne,the bite victim testified that his electric scooter makes very little noise and he was at least 6 feet into the road and was not too close to BJ before he broke loose. He testified he has had no prior incidents with Davison. EMS was called to treat Mr. Dunne, who required stitches to his arm and legs and also suffered an arm fracture. He provided medical records of his treatment. 15. The Petitioner provided testimony and pictorial evidence of the re-enactment and of Mr. Dunne's lacerations. 16. Petitioner's witnesses from Domestic Animal Services(DAS) staff testified to the method of their investigation of the incident. Those witnesses were Timothy Crofts, Ronald Tomasko, Cara Frank, and Christina Perez. The DAS staff testified that County did re-enactment of the scene of incident, it is found that the investigation substantially met the standards set forth in §767.12(1), Fla. Stat. 17. The Petitioner's witnesses testified that the dangerous dog determination was authorized by the County Attorney based upon the investigation undertaken by the DAS staff. The determination required a legal opinion. The County Attorney's office acts as counsel for the DAS. Page 2 of 5 CONCLUSIONS OF LAW 18. There are several issues of law which must be addressed in determining whether the initial finding that BJ is a dangerous dog can be upheld. a. Was the Respondent provided with procedural due process? b. Was BJ a dog that inflicted severe injury on a human being pursuant to §767.11 (1) (a) Fla. Stat.? c. Did TIMOTHY DUNNE act in a manner that would be considered"... tormenting, abusing, or assaulting the dog or its owner or a family member." § 767.12(2)(a), Fla. Stat. such that BJ could not be found to be dangerous? d. Was the investigation "adequate"pursuant to §767.12 (1), Fla. Stat.? 19. Was the Respondent Provided with Procedural Due Process? The Respondent was provided with the Notice that advised her of the applicable law regarding dangerous dogs and the penalties which could be imposed if the dog was found dangerous,see Collier County Domestic Animal Services Sufficient Cause to Classes Dog as. "Dangerous"Pursuant to Collier County Ordinance Chapter 14 Article II Section 14-38 and/or Chapter 767 Florida Statutes, The Respondent was also supplied notice of the hearing which is evidenced by the appearance of the Respondent represented by counsel at the October 17, 2025 hearing. Respondent's counsel was well prepared for the case,to the extent of having several witnesses prepared to testify. The Respondent had a significant opportunity to be heard. Thus, it is found that, based upon clear and convincing, substantial competent evidence presented at the hearing,the Respondent was provided with due process as required by law. "A quasi-judicial hearing generally meets basic due process requirements if the parties are provided notice of the hearing and an opportunity to be heard."Jennings v. Dade Cty., 589 So. 2d 1337, 1340 (Fla. 3d DCA 1991) 20. Was BJ a Dog that Inflicted Severe Injury on a Human Being? The Petitioner provided clear pictorial evidence of the bite wounds suffered by Mr. Dunne. This evidence was considered using the Dunbar Bite Scale. The evidence presented by the Petitioner and testimony by Dunne and Petitioner proved a bite severity of at a Level 5 on the Dunbar scale. A Dunbar Scale Level 5 bite is characterized by the following factual evidence: "Multiple-bite incident with at least two Level 4 bites or multiple-attack incident with at least one Level 4 bite in each." For clarity, a Level 4 bite is characterized as:" One to four punctures from a single bite with at least one puncture deeper than half the length of the dog's canine teeth and considerable bruising around the wound(dog held on for a number of seconds and bore down), or lacerations in both directions (dog held on and shook its head from side to side). A Level 5 bite is considered a severe bite pursuant to Fla. Stat. Section 767.12. Thus, it is found that the Petitioner proved to a clear and convincing standard of proof, by substantial competent evidence that BJ did inflict severe injury on TIMOTHY DUNNE. 21. Did TIMOTHY DUNNE Act in a Manner that would be considered"... tormenting, abusing,or assaulting the dog or its owner or a family member." & 767.12 (2) (a),Fla. Stat. ? Merriam-Webster's online dictionary defines assault as"a violent physical or verbal attack". Assault is defined in the Wolters Kluwer Bouvier Law Dictionary, Desk Edition as; "An unlawful act that places a person in reasonable apprehension of an imminent battery."There Page 3 of 5 was no testimony or evidence that would support the conclusion that Dunne. was assaulting BJ. Merriam-Webster's online dictionary defines abuse as applied to this situation as "physical maltreatment". Abuse is further defined as"Physical or mental maltreatment" in Black's Law Dictionary 10(6`h Ed. 1990). The evidence presented by the parties does not support a conclusion that TIMOTHY DUNNE. was abusing BJ. Tormenting is defined in Florida Statutes in various ways. "...the words"torture,""torment," and"cruelty" shall be held to include every act, omission, or neglect whereby unnecessary or unjustifiable pain or suffering is caused, except when done in the interest of medical science, permitted, or allowed to continue when there is reasonable remedy or relief..." § 828.02, Fla. Stat. The term is defined in Merriam-Webster's online dictionary as "..to cause severe, usually persistent or recurring distress of body or mind, or distort, twist". There was no substantial competent evidence presented that would suggest that TIMOTHY DUNNE was either"...tormenting, abusing, or assaulting the dog or its owner or a family member..."Thus,the actions of BJ are not excused under § 767.12 (2)(a), Fla. Stat. 22. Was the investigation "adequate" pursuant to 767.12 (1),Fla. Stat.? It is found that there was substantial,competent evidence presented that showed to a clear and convincing standard of proof that the investigation was "adequate"and substantially met the standards set forth in §767.12 (1), Fla. Stat.
