RESOLUTION NO. 89- 128
RELATING TO PETITION NUHDER SDV-89-1 FOR AN
EXCEPTION FROM TilE PROVISIONS OF THE
SUBOIVI5IOtl ORDINANCE, NUMBER 76-6 AS
AT-JENDEO, FOR PROPERTY HEREINAFTER DESCRIBED
AS TRACT 80, GOLDEN GATE ESTATES, UNIT 32,
AS RECORDED IN PLAT BOOK 7, PAGES 21 AND 22,
OF THE PUDLIC HECORDS OF COLLIER COUNTY,
FLORIDA.
\~{EREAS, the Legislature of the State of Florida in Chapter
125, Florida Statutes has conferred on Collier County, the power
to establish, coordinate and enforce, zoning, building, housing
and related technical codes and regulations as are necessary for
the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a
Subdivision Ordinance (Ordinance 76-6) establishing such
regulations; and
WHEREAS, the Collier County Planning Commission being the
duly appointed and constituted authority for the review and
approval of subdivision master plans and exceptions from
reguircnents of Ordinance 76-6, as amended, pursuant to Article
VII, S~ction 2 of said Ordinances has held a public hearing
atter due notice and has considered the advisability of
Subdivision Master Plan approval and the granting of the
exception from, Ordinance 76-6, amended, for the property
hereinafter described and has found that satiSfactory provision
and arrangement has been made concerning all matters of public
health and safety that would otherwise be ?...::hieved by the
application of all of the provisions of Ordinance 76-6 as
amended, and has recommended approval of the granting of the
requested exception from the provisions of Ordinance 76-6 as
amended, specifically with respect to the submission of
construction plans as required by Article IX, Section 4,
Ordinance 76-6 as amended and further to be excepted from the
reguire~ents of Article X, Section 18 of Ordinance 76-6 as
a~ended with respect to improvement standards for streets and
related facilities; and
WHEREAS, all interested parties have been given opportunity
