CESM Minutes 10/03/2025 (Draft) October 3, 2025 1 MINUTES OF THE HEARING OF THE COLLIER COUNTY SPECIAL MAGISTRATE Naples, Florida, October 3, 2025 LET IT BE REMEMBERED the Collier County Special Magistrate, having conducted business herein, met on this date at 9:00 AM in REGULAR SESSION in Administrative Building “F,” 3rd floor, Collier County Government Complex, Naples, Florida, with the following persons present: SPECIAL MAGISTRATE: Honorable Patrick H. NEALE PRESIDING The Honorable Special Magistrate Patrick H. Neale called the Hearing to order at 9:00 AM. All those testifying at the proceeding did so under oath. 2. Pledge of Allegiance The Pledge of Allegiance was recited. Prior to conducting the Hearing, Respondents were given an opportunity to speak with their Investigating Officers for a Resolution by Stipulation. Cindy Granados acted as translator testifying inspections have been completed and they are working on revisions to the plans for the permit. Contractor issues also contributed to the delays in abating the violation. Special Magistrate Neale the Stipulation was executed on May 3, 2024. October 3, 2025 4 Special Magistrate Neale DENIED the Respondent’s Motion for Extension of Compliance Deadline with fines starting to accrue today. C. MOTION FOR REHEARING None 6. STIPULATIONS 1. CASE NO: CENA20250004317 OWNER: Alejandra Lynch OFFICER: Doug Williams VIOLATIONS: Collier County Land Development Code 04-41, as amended, Section 2.02.03, and Collier County Code of Laws and Ordinances, Chapter 54, Article VI, Sections 54-181 and 54-179. The illegal recurring outside storage of but not limited to plastic bins, wood dressers, blue tarps covering furniture, debris in the front and backyard on this residential parcel. FOLIO NO: 62260040000 PROPERTY ADDRESS: 5330 Broward St. Naples, FL 34113 Officer Williams requested the hearing. Ms. Lynch requested waiving of the Civil Penalty and discussion occurred with the County noting there have been issues on the property for over 2 decades with numerous violations issued with sporadic remediation which is unfair to the neighbors. The Stipulation was entered into by Alejandro Lynch on October 3, 2025. Special Magistrate Neale found the Respondent GUILTY of the alleged violation and was ordered to: 1. Pay Operational Costs in the amount of $111.70 incurred in the prosecution of this case within 30 days of this hearing. 2. Pay a Civil Penalty of $1,000.00 for multiple repeat violation within 90 days of this hearing. 3. Remove all unauthorized accumulation of litter and all other items not permitted for outside storage to a site designated for such use, or store desired items in a completely enclosed structure within 14 days of this hearing or a fine of $200.00 per day will be imposed until the violation has been abated. 4. Notify Code Enforcement Investigator when the violation has been abated in order to conduct a final inspection to confirm abatement. Pool that is green, stagnant, and not properly maintained, missing wooden planks on the pool barrier, and windows that are screwed shut and do not properly open and close. Vacant commercial property not being properly maintained: damages to the plastic cover on the pylon sign, leaning parking lot light pole, missing cover on both light poles with exposed wires, missing lighting fixtures in the front of the store, exposed wires throughout the structure, unsecured soffit, appearance of microbial growth on the storefront apron and fascia around the building, damaged junction box located in the parking lot, exterior outlet and junction box located on the exterior wall, outlet without a cover and both not properly capped. Graffiti and damage to the dumpster enclosure and damage to the wooden fence. The recurring violation of operation of a business without obtaining all Collier County approvals, Collier County Business Tax Required (BTR). FOLIO NO: 60782160004 PROPERTYADDRESS: 11342 Tamiami Trl E, Naples, FL 34113 Date of Notice of Hearing by Certified Mail: 9/15/25 Date of Property/Courthouse Posting: 9/15/25 Officer Williams requested the hearing. The Stipulation was entered into by the Respondent’s representative Krystef Tylinski on October 3, 2025. Special Magistrate Neale found the Respondent GUILTY of the alleged violation and was ordered to: 1. Pay Operational Costs in the amount of $111.75 incurred in the prosecution of this case within 30 days of this hearing. 2. Obtain a Collier County Zoning Certificate and an issued Collier County Business Tax Receipt to legally manage and operate the business on said property within 30 days of this hearing or cease operating a business on this property or a fine of $250.00 day per day will be imposed into the violation is abated. 3. Pay a Civil Penalty of $500.00 for a repeat violation within 30 days of this hearing. 4. Unpermitted construction including but not limited to: build out of two rooms, mini-split installation, and screen enclosure modifications. FOLIO NO: 82537840007 PROPERTY ADDRESS: 181 Mentor Dr, Naples, FL 34110 Date of Notice of Hearing by Certified Mail: 9/9/25 Date of Property/Courthouse Posting: 9/10/25 Officer Pirosseno represented the County and testified Part A of the violation was abated but not in the prescribed timeframe. Part B of the violation was abated within the compliance period. Special Magistrate Order: No. 6407 Page: 3121 Fine Amount: 200.00/day Duration: 219 days Total Fine Amount: $43,800.00 Unpaid Operational Costs: $111.90 Total to Date: $43,911.90 Rafael Alejandro De La Torre and Monica Vecino De La Torre were present and represented by Attorney Gary Rhodes. Mr. Rhodes noted the violation was abated on September 8, 2025 and during his questioning, Mr. De La Torre testified:  They stipulated to abating the violation to obtain an “After the Fact” permit for the contractor enclosing the lanai area.  They engaged a party to obtain permits, however inspections required removal of the wall coverings and roof area to inspect the work.  Given the timing and all the issues and delays in abating the violation, they decided to obtain a demolition permit and restore the area to the originally permitted condition.  The work was completed by a licensed contractor, and all inspections were completed. Ms. De La Torre testified:  They intended to abate the violation by obtaining the necessary permits for the lanai enclosure however inspections requirements delayed abating the violation, so they determined to demolish the improvements.  The officer in the case changed during the timeframe and she attempted to contact officials to notify them of the progress.  They were unaware an extension of time could be obtained to abate the violation. Officer Collier testified he was the original official involved in the case and they Respondent’s began action immediately after signing the stipulation There was prior code violation associated with property for an unpermitted pool deck which was resolved. Special Magistrate Neale, after considering the factors of the case, GRANTED the County’s Motion for Imposition of Fines and Liens in the amount of $7,611.90 ($7,500.00 in Fines and $111.90 in Operational Costs). Said amount payable within 90 days of this hearing and become a lien on the property. October 3, 2025 8 Recessed: 10:40am Reconvened: 10:55am 10. CASE NO: CEPM20240002432 OWNER: PACIFICA NAPLES LLC OFFICER: Jonathan Musse VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 22, Article VI, Sections 22-228(1) and 22-231(12)(p). A leak within the wall between the closet and master bedroom causing water damages to the drywall and floor. FOLIO NO: 35830040001 PROPERTY ADDRESS: 4255 Heritage Cir, Unit 103, Naples, FL 34116 Officer Musse represented the County testifying the violation has not been abated amassing fines and costs in the amount of $83,612.65. There is a permit on file for the work in rejected status. Evidence Entered: Photos dated 7/9/25 Susan Pressley, Vice President and Christiana Mejia Regional Manager of Pacifica Naples, LLC and Attorney Gary Carman represented the Respondent. Mr. Carman testified they were unaware the permit application was in rejected status and consideration is being given to replacing the contractor. They continue to work on abating all violations to bring the property into full compliance. He requested a 60 day continuance for the case as the unit is unoccupied. Ms. Pressley testified they are working on abating the violations and there has been a change in management structure and the processes in place to deal with code violations. They have been making efforts and abated some of the violations. Special Magistrate Neale noted the issues have been on going for a couple of years with no response by the company to the Orders he has issued. They should be aware the County has the right to foreclose on the property when liens are placed due to unpaid fines and costs. Special Magistrate Neale CONTINUED the case until the December 2025 Special Magistrate hearing date with fines continuing to accrue. CASE NO: CEPM20240005059 OWNER: PACIFICA NAPLES LLC OFFICER: Jonathan Musse VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 22, Article VI, Sections22-228(1), 22-231(12)(b), 22-231(c), 22-231(12)(n), 22-231(r) and 22-240(1)(I). Uneven parking lot, damages to the exterior lights, chain link and vinyl fence, exterior walls, fascia, downspout, missing gate on the dumpster enclosure, and trash overflowing from the dumpster. FOLIO NO: 35830040001 PROPERTY ADDRESS: 4250 Heritage Cir, Naples, FL 34116 Officer Musse represented the County testifying the violation has not been abated amassing fines and costs in the amount of $119,112.40. There is an active permit on file for the work remaining to be completed. Susan Pressley, Vice President and Christiana Mejia Regional Manager of Pacifica Naples, LLC and Attorney Gary Carman represented the Respondent. October 3, 2025 9 Mr. Carman testified many of the items in the violation have been abated and only the repairs to the uneven parking lot remain. Special Magistrate Neale reiterated his concerns regarding Pacifica Naples, LLC. Special Magistrate Neale CONTINUED the case until the December 2025 Special Magistrate hearing date with fines continuing to accrue. CASE NO: CEPM20240006303 OWNER: PACIFICA NAPLES LLC OFFICER: Jonathan Musse VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 22, Article VI, Sections 22-228(1), 22-231(1), 22-231(12)(p), 22-231(19) and 22-231(20). Microbial growth in the A/C vents and on the drywall behind the toilet. Water stains on the ceiling and interior walls. Damaged vanity. Bathroom sink disconnected. Inoperable smoke detector. FOLIO NO: 35830040001 PROPERTY ADDRESS: 4235 Heritage Cir, Unit 108, Naples, FL 34116 Officer Musse represented the County testifying the violation has not been abated amassing fines and costs in the amount of $119,112.40 and there is a permit application on file in rejected status. Susan Pressley, Vice President and Christiana Mejia Regional Manager of Pacifica Naples, LLC and Attorney Gary Carman represented the Respondent. Mr. Carman noted his response is like case #10 and they are seeking to replace the contractor and requested a 60 day continuance in the case. Presence of mold in the hallway closet, leak that appears to be coming from the ceiling hallway closet, inoperable disposal unit, clogged drain in the kitchen sink, leak in the refrigerator, loose front doorknob not properly secured, and missing doorbell with exposed wires. Leak coming from the ceiling in the restroom and closet, water damages to the ceiling in the restroom and closet, and damages to the weather stripping on the front door.
