RELATING TO PETITION NUMBER V-B9-2 FOR A
VARIANCE OF PROPERTY HEREINAFTER DESCRIBED
IN COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature of the state of f'lorida in Chapter
125, Florida statutes, has conferred on all ct,unties in Florida
the pow~r to establish, coordinate and enforce zoning and such
business regulations as are necessary for the protection of the
public, and
WHEREAS,
the County pursuant thereto
has adopted a
comprehensive Zoning Ordinance establishing regulations for the
zoning of particular geographic divisions of the county, among
which is the granting of variances, and
WHEREAS, the Board of Zoning Appeals being ths duly elected
constituted board of the area hereby affected, has held a public
hearing after notice as in said regUlations made and provided,
and has considered the advisability of a 9.1 foot variance from
the required front yard setback of 35 feet to 25.9 feet for the
existing structure only and a 6.6 foot variance from the
required front yard setback of 35 feet to 2B.4 feet for the
existing structure only both as shown on the attached plot plan,
Exhibit "A", in a RMF-6 zone for the property hereinafter
described, and has found as a matter of fact that satisfactory
provision
and arrangement has

matters required by
said regulations and
accordance with Section 11.1.b of the Zoning Regulations for the
unincorporated area of Collier County, and
WHEREAS, all interested parties have been given opportunity
to be heard by this Board in public meeting assembled and the
Board having considered all matters presented,
NOW, THEREFORE BE IT RESOLVED, BY THE BOARD OF ZONING
APPEALS of collier County, Florida, that the petition of
Cortland R. Dusseau, the applicant with respect to the property
hereinafter described as:
