RESOLUTION NO. 89 - 115
RELATING TO PETITION NUMBER V-89-3 FOR A
VARIANCE OF PROPERTY HEREINAFTER
DESCRIBED IN COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature ot the State ot Florida in Chapter
125, Florida Statutes, has conterred on all counties in Florida
the power to establish, coordinate and entorce zoning and such
business requlations as are necessary tor the rrotection ot the
public, and
WHEREAS, the County pursuant thereto has adopted a
Comprehensive Zoning Ordinance establishing regulations tor the
zoning ot particular geographic divisions ot the County, among
which is the granting of variances, and
WH~AS, the Board ot Zoning Appeals being the duly elected
constituted board ot the area hereby attected, has held a public
hearing atter notice as in said requlations made and provided,
and has considered the advisability ot a 0.4 toot variance trom
the required front yard setback ot 30 feet to 29.6 teet as shown
on the attached plot plan, Exhibit "A", in the Pelican Bay POD
zone, Group One Parcels approved by Ordinance 77-18 tor the
property hereinafter described, and has tound as a matter ot
tact that satistactory provision and arrangement has been made
concerning all applicable matters required by said requlations
and in accordance with Section ll.l.b ot the Zoning Requlation.

WHEREAS, all interested parties have been given opportunity
to be heard by this Board in public meeting assembled and the
Board having considered all matters presented,
NOW, THEREFORE BE IT RESOLVED, BY THE BOARD OF ZONING
APPEALS of Collier County, Florida, that the petition ot Dr.
John P. Guercio, Jr. and Jill P. Guercio, husband and wite
represented by Ron Pergl of Forsythe Architects, Inc., with
respect to the property hereinatter described as:
