Executive Summary
Recommendation to approve a Resolution and Lease Agreement with the Florida Department of Agriculture and
Consumer Services to continue the operation of radio communication equipment previously installed on the County-
owned communications tower at 2901 County Barn Road, Naples, FL 34112.
OBJECTIVE: To approve the Lease Agreement (“Lease”) with the Florida Department of Agriculture and Consumer
Services for space on a County-owned communication tower and floor space inside the County-owned communications
shelter, preserving the County's long-standing arrangement for another five years with options for three additional five-
year terms.
CONSIDERATIONS: The Board of Collier County Commissioners (“Board”) approved a Lease Agreement with the
Florida Department of Agriculture and Consumer Services (“FDACS”) on March 13, 2001, Agenda Item 16.E.2, to
utilize floor space and tower space on the County’s communications tower located at 2901 County Barn Road, Naples,
FL 34112. The current lease ended on March 13, 2021, and has continued on a month-to-month basis as a holdover
tenant.
This location is essential for FDACS’s radio communications equipment to provide adequate coverage for
communication services and is needed for daily operations.
Key Terms of the Lease Agreement:
Term: The Lease term is for five (5) years, with FDACS having the option to renew for three additional five-year terms.
Termination: Either party may terminate the Lease at any time, with or without cause, by providing a thirty-day written
notice.
Utilities: County will continue to be responsible for providing electricity to FDACS’s equipment.
Rent: The annual rent has been waived since the FDACS presence on that tower benefits the general public.
This item is consistent with the Collier County strategic plan objective to prepare for the impacts of natural disasters on
our critical infrastructure and natural resources.
FISCAL IMPACT: There is no fiscal impact associated with this item.
GROWTH MANAGEMENT IMPACT: There is no impact associated with the Growth Management Plan.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority vote for Board
approval. - SAA
RECOMMENDATION(S): To approve and authorize the Chairman to execute the attached Lease Agreement and
Resolution.

From time to time, Crahsoft OBO Florida Department of Agriculture and Consumer Services
(we, us or Company) may be required by law to provide to you certain written notices or
disclosures. Described below are the terms and conditions for providing to you such notices and

Getting paper copies

RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, APPROVING A LEASE AGREEMENT
BETWEEN COLLIER COUNTY AND THE STATE OF FLORIDA
DEPARTMENT OF ACITICULTURE AND CONSUMER SERVICES FOR
USE OF THE COUNTY BARn- COMMUNICATIONS TOWER FACILITY.
WHEREAS, the State of Florida Department of Agriculture and Consumer Services. desires to lease a
position on a communications tower located at 2901 County Bam Road. Naples, Florida, owned by Collier
County, a political subdivision of the State of Florida, in addition to a space located within the ground-level
shelter; and
WHEREAS, the lease shall be for five (5) years with three (3) additional renewal terms of five (5) years
each; and
WHEREAS, by the operation of this antenna on the County Bam communications tower facility, the
Departmenl of Agriculture and Consumer Services shall provide a significant public benefit to the community,
and there shall be no annual rent charged by Collier County; and
WHEREAS, the Board of County Commissioners is satisfied that this property is required lbr the
Department of Agriculture and Consumer Services' use and is not needed for County purposes.
l. The Board of County Commissioners does approve the attached Lease Agreement between
Collier County and the State ofFlorida Department of Agriculture and Consumer Services.
2. The Chairman of the Board of County Commissioners of Collier County, Florida, is hereby
authorized to execute the Lease Agreement.
