OBJECTIVE: To approve the Lease Agreement (“Lease”) with the Florida Department of Agriculture and Consumer Services for space on a County-owned communication tower and floor space inside the County-owned communications shelter, preserving the County's long-standing arrangement for another five years with options for three additional five- year terms. CONSIDERATIONS: The Board of Collier County Commissioners (“Board”) approved a Lease Agreement with the Florida Department of Agriculture and Consumer Services (“FDACS”) on March 13, 2001, Agenda Item 16.E.2, to utilize floor space and tower space on the County’s communications tower located at 2901 County Barn Road, Naples, FL 34112. The current lease ended on March 13, 2021, and has continued on a month-to-month basis as a holdover tenant. This location is essential for FDACS’s radio communications equipment to provide adequate coverage for communication services and is needed for daily operations. Key Terms of the Lease Agreement: Term: The Lease term is for five (5) years, with FDACS having the option to renew for three additional five-year terms. Termination: Either party may terminate the Lease at any time, with or without cause, by providing a thirty-day written notice. Utilities: County will continue to be responsible for providing electricity to FDACS’s equipment. Rent: The annual rent has been waived since the FDACS presence on that tower benefits the general public. This item is consistent with the Collier County strategic plan objective to prepare for the impacts of natural disasters on our critical infrastructure and natural resources. FISCAL IMPACT: There is no fiscal impact associated with this item. GROWTH MANAGEMENT IMPACT: There is no impact associated with the Growth Management Plan.
