OBJECTIVE: To provide for public access to waterways located at the Goodland Boating Park by submitting the required Florida Department of Environmental Protection's ("FDEP") fully sovereign submerged lands lease renewal and modification to increase square footage to the Florida Division of State Lands. CONSIDERATIONS: On July 28, 2009 (Item 16D13), the Board approved a Sovereignty Submerged Lands Lease Renewal and Modification to reflect a change in ownership, reflect a change in description of use, reflect a term change, and increase and reflect the correct square footage. The Sovereignty Submerged Lands Lease Renewal Lease and Expiration expired on May 5, 2025. On April 16, 2014, a specific-purpose survey by FDEP was conducted to delineate the limits of the lease parcel at the Goodland Boating Park. The survey determined an increase in submerged lands from 47,753 square feet to 48,740 square feet. On March 3, 2015 (Agenda Item No. 16.D.12), the Board approved the Submerged Lands Lease Renewal and Modification to Increase Square Footage, including the additional square feet that continued to allow use of the 18- slip docking facility, fishing piers, and a public boat ramp. Approval of this item will authorize the Board Chairman to sign the submerged land lease renewal and modification and authorize payment of the invoice. The annual lease fee for $14,753.60, and any supplement payments for wet slip rentals, will be invoiced by FDEP separately. This item supports the strategic plan; it provides the continued use of quality public amenities and recreational opportunities at the Goodland Boating Park. FISCAL IMPACT: The annual lease fee is $14,753.60, and any supplement payments for wet slip rentals are determined on an annual basis upon the Revenue Report Submission to FDEP. Funding is available within the Parks and Recreation General Fund (0001), Marina Parks Operating Cost Center (156364). GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this request. This assessment shall be computed at the rate of twelve percent ( l2%) per annum, calculated on a daily basis for every day the payment is late. 5. No dock or pier shall be constructed in any manner that would cause harm to wildlile. The leased premises shall be subject to inspection by the Lessor or its designated agent at any rcasonable time. 16. NON-DISCRINIINAI lON: The Lcsscc shall not disriminate against any individual bqcause ofthat individual's race, color. religion. sex, national origin, age. handicap. or marital status with respect to any activity occurring within the arca subjcct to this lease or upon lands adjacent to and used as ar adjunct oflhc leased area. I 7. EN I'ORCEM ENT OF PROV ISION S: No lailure. or successive failures. on the part o f lhe Lessor to enforce any provision, nor any waiver or successive waivers or its part oI any provision herein. shall operate as a dischargc thereofor render the same inoperative or impair the right ol the Lessor to enforce the same upon any renewal thereolor in the event of subsequent breach or brcaches. 18. PERMISSION CRANTED: Upon expiration or cancellation ofthis lease all permission granted hereunder shall cease and tenninate. I9. RENEWAL PROVISIONS: Renewal ofthis lease shall be at the so le option o lthe Lessor. S uch renewal shallbesubject to the terms. conditions and provisions of managcnrent standards and applicable laws, rules and regulations in effect at that tinre. In the event that the Lessee is in full compliance with the terms offiis lease, the Lcssor will begin the renewal process. The tenn of any renewal granted by the Lessor shall commence on the last day ofthe previous lease term. ln the cvcnt the Lessor does not grant a renewal, the Lessee shall vacate the leased premises and remove all structures and equipment occupying and erected thereon at its expense. The obligation to remove all structures authorized herein upon termination ofthis lease shall constitute an affirmative covenant upon the Lessee's interest in the riparian upland property more panicularly described in Attachment E which shall rirn wilh the title to the Lessee's interest in said riparian upland property and shall be binding upon the Lessee and the Lessec's succcssors in title or successors in intcrest. 20. RENIOVAL OF STRUCTURESTAD\4INISTRATM FINES: If the Lessee do es not remove said structures and equipment occupying and erected upon the leased premises after expiration or cancellation of this lease, such structures and equipment will be deemed lorleited to the Lessor. and the l,essor may authorize renroval and may sell such forfeited structures and equipment after ten ( l0 ) days written notice by ccrtified rnail addressed to the Lessee at the address specified in Paragraph l2 or at such address on record as provided to the l-essor by the Lessee. However. such remedy shall be in addition ro all other remedies available to the Lessor under applicable laws. rules and regulations including the right to conrpcl removal ol all structures and the right to impose administrative fines. 21. REMOVAL COSTS/I.IEN ON RIPARIAN UPLAND PROPERTY: Subiect to the noticing provisions of Paragraph 20 of this lease, any cosls incurred by the Lessor in removal of any structures and equipment constructed or mainlained on statc lands shall be paid by Lessee and any unpaid costs and expenses shall constitute a lien upon the l.essee's interest in the riparian upland property that is more particularly described in Anachmcnt B. This licn on the Lessee's interest in the riparian upland prope(y shall be enforceable in summary proceedings as provided by larv. 22. RIPARIAN RIGHTS/FINAL ADJUDICATIONT In the event that any pan of any structur€ authorized hereunder is detennined by a final adjudication issued by a court of competent j u risd iction to encroach on or interfere with adjaccnt riparian rights, Lcsscc agrees to either obtain written consent for the offending structure from the affected riparian owner or to remove the interference or encroachment within 60 days from the date ofthe adjudication. Failure to comply rvith this paragraph shall conslitute a material breach of this lease agreement and shall be grounds for immediate termination of rhis lease agreement at the option ofthe Lessor. 23. AMENDMENTS/MODIFICATIONSi This lease is the entire and only agreement between the parties. lts provisions are not severable- Any amendment or modification to this lease must be in writing, must be accepted. acknorvledged and cxecuted by the Lessee and Lessor. and must comply rvith the rules and statutes in existence at the time ofthe execution ofthe modification or anrendment. Notwithstanding the provisions of this paragraph, ifrnooring is authorized by this lcase. the Lessee ma) inslall boatlifts rvithin the leased premises without lormal modification oflhe lease provided that (a) the l,essee obtains an) statc or iocal regulatory permit that may be required; and (b) the location or size ofthe litl does not increase the mooring capacity ofthe docking facility. Unless specifically authorized in writing by the Lessor. such activities or structures shall be considcrcd unauthorized and a violation of Chapter 253, Florida Statutes. and shall subject the Lessee to administrative fincs under Chapter I E- 14. 'fhis condition does not apply to minor structural repairs requircd to maintain the authorized structures in a good state ofrepair in the interests ofpublic health. safety or welfare: providcd. however. that such activities shall not cxceed the activities authorized by this lease. 25. USACti AUTHORIZATION: Prior to commencement of construction and/'or activities authorized hcrcin. the Lcssee shall obtain the U,S, Army Corps of Engincers (LSACE) perrnit if il is required by thc USACE, Any rnodifications to thc construction and/br activities authorized herein that may be required by the t,SACE shall require consideration by and thc prior wrinen approval ofthe Lessor prior to the commencement ofconstruclion and,'or any activities on sovereign, submerged lands. 26, COMPLIANCE WITH FLORIDA LAWS:On or in conjunction with the use of the leased premises, the Lessee shall at all times comply with all Florida Statutes and all administrative rules promulgated thereunder, Any unlarvful activity which occurs on the leased premises or in conjunction with the usc ofthe leased premises shall be grounds for the termination ofthis lease by the Lessor. 27. LIVEABOARDS: The term "liveaboard" is defined as a vessel docked at the lacility and inhabited by a person or persons tbr any five (5) consecutive days or a total of ten ( l0) days within a thiny (30) day period. lf liveaboards are aurhorized b1- paragraph one ( I ) of this lease, in no event shall such "liveaboard" status exceed six (6) months within any lwelve ( l2) rnonth period, nor shall any such vessel constitute a legal or primarv rcsidencc. 28. GAMBLING VESSELS: During the term ofthis lcase and any renewals, extensions. modifications or assignments thereof, Lessee shall prohibit the operation ofor entry onto thc leased prcmises olgambling cruise ships, or vessels that arc uscd principally for thc purpose of gambling, when these vessels are engaged in "cruises to nowhere." where the ships lcavc and retum to the state of Florida without an intervening stop !vithin another state or foreign country or waters rvithin the jurisdiction ofanothcr state or loreign country, and any rvatercraft used lo carry passengers to and from such gambling cruise ships. 29.
