Executive Summary
Recommendation to approve an Easement Use Agreement (Agreement) for Family Living Unit No. 7, Pinewoods
Condominium, Unit Two, as recorded in Official Record Book 831, page 1376 of the public records of Collier County,
Florida.
OBJECTIVE: To approve an Easement Use Agreement between the County and the current property owners of Family
Living Unit No. 7, Pinewoods Condominium, Unit Two, as recorded in Official Record Book 831, page 1376 of the
Public Records of Collier County, in order to allow a screened pool and deck to encroach approximately 0.6 feet into a
10-foot wide Drainage and Utility Easement as created and recorded on the plat of Pinewoods, Plat Book 12, page 59 of
the Public Records of Collier County, Florida, more specifically shown on Exhibit “A.”
CONSIDERATIONS: The property is located at 2428 Camden Court. There is an existing screened pool and deck on
the subject property that encroaches 0.6 feet into a 10-foot-wide drainage and utility easement located along the rear
boundary of the property. The 10-foot-wide drainage and utility easement use is for the sole purpose of maintaining the
lake. The current owners purchased the property in February 2024, with the encroachment already in place; reviews of
aerials prior to 2024 confirm the encroachments existed prior to the current owners purchasing the property. A letter of
no objection has been received from Pinewoods Unit Two, Inc., Collier County Road Maintenance, and respective
Utility providers. According to the plat of Pinewoods (Plat Book 12, Page 59), the subject easements are dedicated to the
perpetual use of the public.
Development Review has reviewed the Agreement and Exhibits and recommends approval of the Easement Use
Agreement.
This item is consistent with the Collier County strategic plan objective to operate an efficient and customer focused
permitting process.
FISCAL IMPACT: There is no fiscal impact. The property owners will be responsible for the recording fees of this
Agreement.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for
Board approval. - CLD
RECOMMENDATION(S): To approve the Easement Use Agreement between the County and current property
owners of Family Living Unit No. 7, Pinewoods Condominium, Unit Two, as recorded in Official Record Book 831,
page 1376, and authorize the Chairman to execute the Agreement and direct the Clerk to record the Easement Use
Agreement into the public records of Collier County, Florida.

Dear Jeff,
Thank you for contacting FPL about the proposed installation of a pool cage. As
shown on your site plan FPL has no objection to this encroachment in the platted
utility easement at the referenced location. FPL has no objection to this existing
encroachment and will not require its removal, however FPL does not agree to the
future encroachment of any other structures into the easement.

The City of Naples Public Works Department is in receipt of your email dated September 12, 2024,
requesting a Letter of No Objection from our office regarding the following proposed easement
encroachment:
We have been engaged by the property owner for the purpose of petitioning Collier County in connection
with an easement use agreement, to allow a minor pool cage encroachment into a small portion of the 10’
platted public drainage and utility easement currently encumbering the referenced property. More
specifically, the platted easement is located in the Pine Woods platted subdivision (Plat Book 12, Pages 59-
60).
This parcel is located within the City’s water and wastewater service area. The City owns and operates an
existing watermain and sanitary sewer within the Camden Court right-of-way. Per the City’s GIS records,
there are no existing City-owned water or sanitary sewer facilities located within the 10’ platted public
drainage and utility easement. The Public Works Department does not anticipate a future need to install water
or sanitary sewer facilities within the utility easement.
Therefore, this correspondence serves as our formal Letter of No Objection to the above referenced
easement encroachment. If you have any questions or require any additional information, please contact this
