Executive Summary
Recommendation to approve the final payment of $1,433,151.30, release retainage funds, assess liquidated damages in
the amount of $291,454, and approve all verified additional work under Agreement No. 19-7615 with Astra Construction
Services, LLC for Phase 1 of Big Corkscrew Island Regional Park. (Project No. 80039)
OBJECTIVE: To formally close out the Big Corkscrew Island Regional Park Phase 1 construction contract, approve
final payment, release retainage, assess liquidated damages, and approve all verified additional work..
CONSIDERATIONS: The Big Corkscrew Island Regional Park ("BCIRP") was developed to meet the recreational
needs of the growing Golden Gate Estates community. Following the adoption of the Parks and Recreation Master Plan
in 2011, a master plan was created for the County-owned property within the Orangetree Planned Unit Development.
This plan coordinated infrastructure for multiple facilities, including the BCIRP.
In 2017, the Board approved a design contract for the BCIRP, which includes a wide range of amenities, including an
aquatic center, community center, athletic fields, and courts. A competitive bid process in 2019 resulted in the Board
awarding Astra Construction Services, LLC ("Astra"), construction Agreement No. 19-7615 in October 2019. The
County funded the project through a combination of Sales Tax and Parks and Recreation Impact Fee Capital Funds.
Construction began in November 2019 with an anticipated completion in March 2021. However, the COVID-19
pandemic significantly impacted labor, materials, and equipment availability, resulting in multiple schedule extensions.
The final substantial completion occurred in September 2023. To facilitate public use during construction, Astra
implemented a phased turnover approach:
1. January 11, 2021: North ball fields and multipurpose fields
2. January 28, 2022: Playground, hard courts, event lawn, and concession/bathroom facility
3. August 5, 2022: Community Center and Maintenance Building
4. September 21, 2023: Aquatic facility (opened to the public in October 2023)
In addition to the pandemic, Astra experienced challenges with subcontractor performance, material shortages (e.g.,
concrete masonry, electrical switchgear, HVAC equipment), and owner-directed changes, such as switching from
well/septic to public utilities, modifying field drainage and turf design, and upgrading low-voltage systems. Throughout
the project, the County issued work directives to address scope changes, regulatory requirements, and unforeseen
conditions. Due to Astra's documentation delays, formal change orders could not be processed in real time.
While Astra remained engaged and ultimately completed the project, delays, particularly with the aquatic facility,
resulted in extended turnover timelines. Staff recommends assessing partial liquidated damages of $291,454 to offset
County-incurred costs during the extended construction period.
This final payment consolidates all authorized work directives, previously approved change orders, and validated change
requests. The backup documentation has been thoroughly reviewed to verify costs incurred and includes the following
anomalies:
1. Invoices with incomplete proposals
2. Unverified work dates
3. Work performed prior to or without work directive issuance
4. Corrections to markup and tax calculations
The backup documentation has been reviewed by County staff and the Clerk of Courts' finance team. The final payment
amount of $1,433,151.30 utilizes a portion of the Agreement's allowance funds and results in a final project cost
$42,798,605.30, which is $2,266,848.70 below the original contract price of $45,065,454. The assessment of liquidated
damages would reduce the final project cost and increase the delta between the contract price by $291,454.
This item is consistent with the Infrastructure, Asset Management, and Quality of Place elements of the Collier County

Strategic Plan.
FISCAL IMPACT: Funds in the amount of $1,433,151.30 for the final payment are available in the allowance provided
in the construction contract. The remaining retainage will be released to the contractor and liquidated damages, if
assessed, would decrease overall payment by an amount of $291,454.
GROWTH MANAGEMENT IMPACT: This action has no impact on the Growth Management Plan.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for Board
