Executive Summary
Recommendation to approve a Grant of Access and Utility Easement to Summit Broadband Inc., for the installation and
maintenance of a fiber optic cable from Livingston Road to The Golisano Children’s Museum of Naples, located on
County-owned property at North Collier Regional Park.
OBJECTIVE: To obtain Board approval and authorization to execute a non-exclusive access and utility easement in
favor of Summit Broadband Inc.,(“Summit”) across a portion of County-owned property located at 15080 Livingston
Road, Naples, Florida (North Collier Regional Park), for the installation, operation, and maintenance of
telecommunications infrastructure serving The Golisano Children’s Museum of Naples (“CMON”).
CONSIDERATIONS: Summit requires an access and utility easement to install and maintain fiber optic cable and
associated communications infrastructure to serve CMON, which operates on County-owned property pursuant to a
long-term lease dated December 16, 2003, as amended, which expires December 31, 2034.
The easement will allow Summit to operate and maintain underground telecommunications facilities within a defined
portion of the County's property. CMON has requested temporary early access to allow Summit to begin installation of
the fiber optic line from Livingston Road to the Museum.
All work will be conducted in compliance with County insurance, safety, permitting, and site restoration requirements.
The required Right-of-Way Permit (No. PRROW2025041488801) has been obtained and is attached for reference.
The attached Grant of Utility Easement has been reviewed and approved by the County Attorney’s Office and the Public
Utilities Division.
This item is consistent with the Infrastructure and Asset Management Element of Collier County's Strategic Plan by
planning and building public infrastructure and facilities to effectively, efficiently, and sustainably meet the needs of our
community.
FISCAL IMPACT: The total cost will not exceed $200 for recording the easement. Sufficient funds are available in
account 1011-156310-649030.
GROWTH MANAGEMENT IMPACT: There is no impact on the County’s long-range growth management plans.
LEGAL CONSIDERATIONS: This item is approved as to form and legality by the County Attorney’s Office. A
majority vote is required for approval. - SAA
RECOMMENDATIONS: That the Board:
1. Approves and accepts the attached Grant of Access and Utility Easement to Summit Broadband Inc.;
2. Authorizes the Chairman to execute the Grant of Access and Utility Easement to Summit Broadband Inc.,
following approval by the County Attorney’s Office; and
3. Directs the County Manager, or designee, to record the executed Grant of Access and Utility Easement in the
Public Records of Collier County, Florida.
