Executive Summary
Recommendation to approve Agreement No. 25-332-NS-WV, “BECS Chemical Controllers, Parts, Services and Various
Pool Purification Systems,” authorize expenditures for single-source purchases from Commercial Energy Specialists,
LLC, for the purchase of chemical and pool purification systems, parts and materials in an amount not-to-exceed
$1,000,000 per fiscal year for a period of five years, and authorize the Chair to sign the attached Agreement.
OBJECTIVE: To effectively procure and maintain specialized BECS chemical and pool filtration systems at County
facilities through an approved single-source vendor for parts, supplies, and services to ensure the safety of the public by
complying with Health Department regulations with proper chemical control systems.
CONSIDERATIONS: On July 14, 2020 (Agenda Item 16.D.21), the Board approved Agreement No.20-041-NS with
Commercial Energy Specialists (“CES”) authorizing the procurement of goods and services from CES as a single-source
supplier to support the chemical and pool filtration systems for an amount not-to-exceed $300,000 per fiscal year.
On July 13, 2021 (Agenda Item 16.D.7), the Board approved an increase in the single-source waiver expenditure under
Agreement No. 20-041-NS from a not-to-exceed amount of $300,000 to $700,000 per fiscal year. This was largely due
to the need to purchase replacement filters at Sun N’ Fun Lagoon.
There is again a need to continue the use of the single-source supplier arrangement with an increased annual not-to-
exceed value in order to meet current and prospective needs for the County’s many featured aquatic facilities, as well as
accounting for annual pricing changes. Staff is requesting a not-to-exceed limit of $1,000,000 per fiscal year under the
single source waiver and attached Agreement No. 25-332-NS-WV. CES is based out of Jupiter, Florida, and has been
performing services for the County since 1994.
CES is also the sole distributor in our area of proprietary pool filtration systems, chemical controllers, and UV
Disinfection systems and pool vacuums for the following manufacturers:
• BECS Technology Inc.
• Neptune-Benson
• Hexagone Manufacture SASU
• Yaskawa America Inc.
• EPD USA Inc.
• Fluidra USA
• EKO3 Systems
Golden Gate Community Park, Sun-N-Fun Lagoon, Eagles Lakes Community Park, Big Corkscrew Island Regional
Park and the Immokalee Sports Complex facility are all utilizing BECSys Chemical Controllers. CES is the single
source for obtaining replacement parts and service for the BECSys chemical controllers. The chemical control system
allows for continuity in pool operations and would require manually balancing pool chemicals if not in place with
additional risk to staff and operations.
In accordance with Section 12,subsection 3 of the Collier County Procurement Ordinance 2025-34, staff requests that
the Board find that it is in the best interest of the County to continue to purchase BECS chemical controllers, parts,
services and the above listed pool purification systems, parts and materials from CES as a single source vendor in a not-
to-exceed amount of $1,000,000 per fiscal year for five years. The Procurement Services Division posted a public notice
of the County’s intent to designate CES as a single source to the vendor community through its online bidding platform
for seven days and did not receive any responses. The Waiver Request Form approved by Procurement Services
Division is attached as a further backup for this request.
Additionally, staff is requesting Board approval of Agreement No. 25-332-NS-WV, “BECS Chemical Controllers, Parts,
Services and Various Pool Purification Systems,” with CES for a period of three years with two additional one-year

renewal options.
To provide quality public amenities and recreational opportunities.
FISCAL IMPACT: Annual expenditure will not exceed $1,000,000 per year. Funds are budgeted in the Parks and
Recreation operating and capital budgets.
GROWTH MANAGEMENT IMPACT: This item supports the recreation and open space element of the growth
management plan.

When the Sun-N-Fun Lagoon Water Park at North Collier Regional Park was originally constructed, the installed controller system
was the Stranco-Strantrol System, manufactured by BECS Technologies. In 2005, BECS Technologies discontinued the supply of
aquatic controllers and replacement parts through Stranco-Strantrol and introduced the BECSys line of aquatic controllers.
BECS Technologies distributes its BECSys systems through a network of regional partners. In Florida and the Caribbean region,
Commercial Energy Specialists, LLC is the exclusive authorized provider for sales, service, and warranty administration. While other
distributors exist, they are located outside the Southwest Florida region and are not positioned to provide timely support.
BECS Technologies systems have also been incorporated into the design of the Big Corkscrew Island Regional Park Aquatics
Facility. Additionally, in 2014, the Immokalee Sports Complex was upgraded to the BECSys7 Chemical Controller system. The
County’s current investment in BECS Technologies systems across its aquatic facilities is estimated at $3.29 million.
CES is the Master Distributor throughout the South East United States and the Caribbean for water
treatment equipment in the commercial aquatic industry. Because of the proprietary nature of the
BECS Technologies, factory-trained technicians authorized by BECS must perform all service to
keep the manufacturers' warranties intact.
Pricing for comparable technologies have not been sought. The current systems associated with Collier
County Parks and Recreation Aquatics were chosen when the aquatics facilities were first designed as well
as conversion of existing facilities using this technology. Operator familiarity with systems have encouraged
use of this technology. BECS is known within the aquatics industry for their propriety water chemistry
controller.
The system is simple to operate and supported by BECSys by Windows software, which provides
operational data logs, graphs and event calendars, which assist staff to comply with both regulatory and risk
management needs of the Division. Given the historical use of BECS Technologies for these systems it is
estimated that a significant amount of funds would be required to competitively price and replace this
existing equipment. This would also affect service levels and require closure of the facility to facilitate a
change in equipment.

The purpose of this market analysis is to provide a justification for using Commercial Energy
Specialists (CES) as a single source provider for:
• BECS Technology, Inc including BECSys Controller line and related products
• Neptune Benson Defender Regenerative Media Filter and Wafer UV

precision, and energy efficiency. Moreover, the lack of other certified service providers for
BECSys systems strengthens the case for CES’s single-source status.

Conclusion:
The research strongly supports the justification of CES as a single source provider for The BECSys
controllers, Eko3 - backwash valves for the filters, EPD - media filtration system, Yaskawa -
Variable Frequency Drive that controls the filter, Fluidra - filter tanks are proprietary, Neptune
Benson UV disinfection systems, Enduro Turbo clean - pool vacuums in South Florida,
particularly in the Collier County area. The proprietary nature of the technology, combined with
the lack of other authorized distributors and the high barriers to revise the pool existing controls
systems, means CES holds a unique position in the market.

The BECSys Controller line includes the BECSys7 filtration/equipment room controller as well as
the BECSys5, BECSys3, BECSys2 and all CES MR series water chemistry controllers. All BECSys
