Soto, in Special Magistrate Case No. CENA20230000258, relating to the property located at 4070 14th Ave. SE, Collier County, Florida. OBJECTIVE: For the Board of County Commissioners to accept an offer to release a code enforcement lien with an accrued value of $78,800 for a reduced payment of $14,739.40 in relation to Special Magistrate Case No. CENA20230000258. CONSIDERATIONS: In Case No. CENA20230000258, the Special Magistrate ordered the imposition of a lien against property located at 4070 14th Ave SE and owned by Lucy B. Soto. The violations consisted of outside storage and/or litter, including but not limited to wood, plastic, metal, mattresses, and bins, and weeds exceeding 18 inches in height within 30 feet of the residence. The lien was recorded in the Official Records on January 26, 2024, at O.R. Book 6324, Pages 2926-2928, in the amount of $21,223.55. Fines continued to accrue for 788 days ($100 per day from June 10, 2023, through August 5, 2025), totaling $78,800. The owner brought the property into compliance on August 5, 2025. Pursuant to Resolution No. 2023-90, a request for a reduction of fines may be considered when payment of the lien would impose severe financial hardship on the owner. Lucy Soto resides outside of Collier County and only discovered the lien during the pending sale of the property. Despite living on a fixed income, Ms. Soto worked diligently to bring the property into compliance, leaving her with little to no proceeds after the sale. She requested to pay the least amount possible, as the abatement, mortgage, and selling costs would have left her in financial hardship. The property is actively maintained, and the owner offers to pay the minimum amount possible. Code Enforcement recommends settling $64,060.60 in accrued fines for $14,739.40, which is 10% of the Collier County Property Appraiser’s 2024 Assessed Value of $147,394 and meets the criteria outlined in Resolution 2023-90. There are currently no known violations on the property. This item is consistent with the Collier County strategic plan objective to preserve and enhance the character of our community. FISCAL IMPACT: Acceptance of a payment of $14,739.40 to settle the lien will correlate to what is outlined in Collier County Resolution 2023-90. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution 2023-90. - RTT RECOMMENDATIONS: To approve the recommended reduction of fines in the amount of $64,060.60, accept payment in the amount of $14,739.40, release the lien, and authorize the Chairman to sign the attached release and satisfaction of lien for recording in the Official Public Records.
