CESD20150002065 and CESD20170003130, relating to the property located at 5341 Martin St., Collier County, Florida. OBJECTIVE: To have the Board of County Commissioners accept an offer to release two code enforcement liens with an accrued value of $198,400 for a reduced payment of $16,319.10 in Code Enforcement Board Case No. CESD20150002065 and Special Magistrate Case No. CESD20170003130. CONSIDERATIONS: The Code Enforcement Board and the Special Magistrate imposed liens against Randy Houlton for code violations at 5341 Martin St. In Case No. CESD20150002065, the Code Enforcement Board ordered the imposition of a lien for a violation consisting of an unpermitted shed and animal cages on improved property without first obtaining a valid Collier County Permit. The lien was recorded in the Official Records on November 2, 2015, at O.R. Book 5210, Pages 236-237, in the amount of $2,628.34. Fines continued to accrue for a total of 361 days ($100 per day from September 27, 2015, through September 21, 2016), totaling $36,100. The owner brought the property into compliance on September 21, 2016. In Case No. CESD20170003130, the Special Magistrate ordered the imposition of a lien for a violation consisting of an unpermitted shed and animal cages on improved property without first obtaining a valid Collier County Permit. The lien was recorded in the Official Records on February 7, 2018, at O.R. Book 5475, Pages 575-576 in the amount of $3,227.13. Fines continued to accrue for a total of 1,623 days ($100 per day from December 7, 2017, through May 17, 2022), totaling $162,300. The owners brought the property into compliance on May 17, 2022. Pursuant to Resolution No. 2023-90, a request for a reduction of fines may be considered when payment of the lien would impose severe financial hardship on the owner. The property is actively maintained, and Mr. Houlton offers to pay $1,000 to release the liens; however, Code Enforcement recommends accepting $16,319.10. The recommended payment of $16,319.10 is ten percent of the Collier County Property Appraiser’s Assessed Value of $163,191 and meets the criteria outlined in Resolution 2023-90. There are currently no known violations on the property. This item is consistent with the Collier County strategic plan objective to preserve and enhance the character of our community. FISCAL IMPACT: Acceptance of a payment of $16,319.10 to settle the lien will correlate to what is outlined in Collier County Resolution 2023-90. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution 2023-90. - RTT RECOMMENDATIONS: To approve the recommended reduction of fines in the amount of $182,080.90, accept payment in the amount of $16,319.10, release the liens, and authorize the Chairman to sign the attached releases and satisfaction of liens for recording in the Official Public Records. As an out-of-town owner, I had no physical control over the siluadon and couldn't force compliancs. The lenant withheld nolices mail from me and prevented me from addressing the issues.
