ORDER Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the authority granted in Chapter 162, Florida Statutes, and Collier County Ordinance No. 07-44, as amended, IT IS HEREBY ORDERED: A. As to Citations CEAC20250001587-30 and CEAC20250001587-15: B. Respondent is ordered to pay operational costs in the amount of $50.00 per occurrence plus an administrative fee of $7.00 incurred in the prosecution of this case per occurrence, a total of $114.00, within ninety, (90) days from the date of this hearing (November 13, 2025). C. Respondent is assessed a civil penalty of $500.00 per occurrence, a total of $1,000.00 to be paid within ninety (90) days of the date of this hearing (November 13, 2025). If the Respondent fails to pay the $1,000.00 within 90 clays, Collier County may record a lien for that amount upon the Respondent. D. Respondent is hereby ordered to nay total fines and costs in the total amount of $1,114.00, to be paid on or before ninety (90) days from the date of the hearing (November 13, 2025). E. Violation of Collier County Code of Law and Ordinances, Chapter 14, Article 11, Section 14- 37(1)(E) is by the definition set forth in that section a violation of Florida Statue Section 828.12(1). F. Pursuant to Collier County Ordinance 2024-24 (The Collier County Animal Abuser Registry Ordinance), a violation of Fla. Statute Section 828.12 is an "Abuse Offense". G. Section three of the Collier County Ordinance 2024-24 mandates that an Abuser who has been convicted of an abuse offense after the effective date of that ordinance must register with the County Animal Abuser Registry Ordinance. The Special Magistrate requests that the Respondent be adjoined to the Collier County Animal Abuser Registry. H. It is further ordered that the Respondent registers and completes the Collier County Responsible Pet Owner within 90 days of this hearing (November 13, 2025). As to Citations CEAC20250001587-01, CEAC20250001587-08, CEAC20250001587-17 and CEAC20250001587-16 I. Respondent is ordered to pay operational costs in the amount of $50.00 per occurrence plus an administrative fee of $7.00 incurred in the prosecution of this case per occurrence, a total of $228.00. J. Respondent is assessed a civil penalty of $500.00 per occurrence, a total of $2,000.00. K. The total fines and fees are $2,228.00. L. These fines will be suspended for a period of 1 year so long as the Respondent commits no animal related offenses as per Collier County Code of Laws and Ordinances, Florida State Statutes pertaining to any animal related offense. M. At the end of 1 year the fines will be forgiven pending if the Respondent commits no animal related offenses as stated above. N. At any time during the 1-year suspension, should the Respondent violate any provision of Collier County Code of Laws and Ordinances, Chapter 14, or any Florida State Statute pertaining to animal -related violations - All fines will be reinstated and ordered to be paid within 30 days. O. Failure to pay all fines within the timeframe as ordered shall result in a lien placed against the respondent and any properties owned by the respondent. In consideration of the disposition and resolution of the matters outlined in said Citation/Notice to Appear for which a hearing is currently scheduled for August 15, 2025 to promote efficiency in the administration of the code enforcement process; and to obtain a quick and expeditious resolution of the matters outlined therein, the parties hereto agrees as follows: 1) The violations noted in the referenced Citations are accurate and I stipulate to their existence.
