Agenda Additions and Deletions One deletion: Public Hearings item 10C (2025-14 – Benjamin Lopez – TopQuality Contractors LLC – CEMIS20250004648) was continued to the next meeting (October 22, 2025) and removed from this agenda. 3. Jean Lefrancois – Infinity Glass & Hardware, LLC – Review of Second Entity (2025-3577) Mr. Jean Lefrancois appeared for review of a request to qualify a second business entity. Staff reported compliance with required documentation and confirmed standing with the Division of Corporations. Board members questioned whether supervision across two entities could be reasonably performed. Mr. Lefrancois responded that separate management staff were in place and oversight would remain adequate. Motion by Matthew Nolton; Second by Terry Jerulle to approve the request. Vote: Motion passed 8-0 (including late arrival of Robert Meister). 9. OLD BUSINESS 9.A. Daisy Jarery Quezadas Avalos – M & D Professional Plastering of SWFL LLC – Probation Review (2025-3487) Staff reported licensee had not submitted updated credit documentation. License suspended for not complying with Board Order. Motion by Kevin Johnson; Second by Stephen Jaron to suspend license. Vote: Motion passed 8-0. 9.B. Anthony J. Dimech – R & A Plumbing Contractors Inc. – Probation Review (2025-3579) Staff reported no credit score documentation had been provided. License suspended for not complying with Board order. Motion by Richard Joslin; Second by Jennifer Cassidy to suspend license. Vote: Motion passed 8-0. 9.C. 2024-15 – CEMIS20240004396 – Nova Homes of South Florida Inc. (2025-3581) Staff updated Board on continued compliance concerns related to Nova Homes. Page 5 of 368 4 Issues regarding engineering certification and structural corrections remained unresolved. Counsel for Nova Homes reiterated arguments presented at prior meetings that settlement agreements had transferred responsibility. Board members discussed the need to ensure public protection. Vote: Motion passed 8-0. 9.D. 2025-02 – CEMIS20240006352 – Sunshine Pools of Naples, LLC (2025- 3582) Staff reported that the contractor is no longer listed on the permit. The homeowner has taken over the permit. The license holder was present to request permit pulling privileges be reinstated. Motion by Stephen Jaron; Second by Kevin Johnson to continue matter for 30 days. Vote: Motion passed 8-0. 10. PUBLIC HEARINGS Note: At staff request for efficiency (to allow early release of county staff), Public Hearing 10A was advanced and heard prior to New Business 8A. A. 2025-09 – Peter Kallie – Kaltin Construction Inc. – CEMIS20250002654 (2025-3584) The public hearing was opened (motion passed 8-0). Respondent was represented by counsel Stan [Butler/Cliner—clarify name if available from full transcript], but did not personally appear. A stipulation agreement was read into the record: Respondent admits to violations in Administrative Complaint 2025-09 (Counts 1- 13, 1A, and 1B) under Section 22-20112 (willful violation of state, county, or City of Naples laws). Sanctions include: $2,000 fine payable within 60 days (failure results in automatic license revocation); 12 months’ probation starting September 17, 2025 (any subsequent violation requires board appearance); submit new or revised permit application (PRMFH-20230416452) for full interior demolition (including electrical and plumbing work) and finalize within 60 days (failure results in license suspension and automatic board appearance). Staff presented investigative findings and compliance concerns. Investigators Broughton and Zydek testified to permit and inspection deficiencies. Attached documentation was introduced into the record, noting discrepancies in credit standing and supervisory responsibility. Mr. Aviles provided testimony in response, acknowledging business difficulties but requesting leniency. Counsel Neal advised Board regarding options of probation, suspension, or continuance. Board members discussed the seriousness of the violations, referencing the attachment evidence. Several emphasized the need to balance rehabilitation with public protection. Motion by Terry Jerulle; Second by Kevin Johnson to continue case for 30 days, requiring submission of updated financial and credit documentation prior to next hearing. The score that matters most is the version that your lender will actually use to evaluate your credit application. It's important to focus on the FICO® Score version that's most relevant to your near-term credit needs If you don't know which score version your creditor is using, consider these guidelines: Financing a new car? Upon investigation, it was discovered on September 16th, 2023, TOP QUALITY CONTRACTORS LLC entered into a contract with property owner John A Morrison, for a new block paver driveway, to install new 4x4 Culvert to the main property entrance. The contracted amount was for $17,375.00. An initial deposit of Page 308 of 368 $7,000.00 was made in September 2023. A second payment of $7,000.00 was made in December 2023. A third payment of $3,375.00 would be paid on completion of this job and permit(s) finaled. 7. On November 8, 2023, permit # PRROW20230938970 was issued to remove an asphalt driveway and install new pavers 21' wide. 8. On September 18, 2024, the 800 -Right of Way Final Inspection failed for (1) missing footers, (2) swales not being graded and sodded, and (3) wooden form boards on mitered ends not removed. 9. On November 2, 2024, permit# PRROW20230938970 expired. 10.On March 10, 2025, permit application #PRROW20250310030 was submitted and subsequently denied on March 14, 2025. The denial was based on the use of an outdated Authorization Form from the original permit application and the need to revise the ROW plans to: (1) reflect a maximum driveway width of 24 feet, (2) maintain a minimum distance of 7.5 feet from the side property line, and (3) clarify and correct inconsistencies in side measurements across all plan pages. 11. On April 22, 2025, Investigator Simmonds verified the right of way work had been completed. 12. On April 22, 2025, Investigator Simmonds spoke to the Respondent about the complaint, expired permit, failed 800 final inspections, and issued a formal 30-day notice to the Respondent advising of the deficiencies and directing correction of the failed inspection. 13. On May 28, 2025, a review of County records revealed that no corrective action had been taken on permit # PRROW20250310030 and the BOO-inspection remained failed. 14. On May 28, 2025, Investigator Simmonds issued a second 30-day notice to the Respondent directing correction of the failed inspection. 15. On July 19, 2025, a review of County records revealed that no corrective action had been taken on permit # PRROW20250310030 and the 800-inspection remained failed. 16. On July 22nd, 2025, a review of the County records revealed that no permit has been reactivated/issued, with no attempts to correct the building code violation. Attempts to remedy the issue via telephone and email to the Respondent, most recently on 19th July, were unsuccessful. 17. On July 23, 2025, Collier County Chief Building Official formally determined that the matter constituted a willful code violation for being non-responsive and inaction. 18. Inspections are for the purpose of correcting errors seen at the time of inspection and do not constitute acceptance for maintenance by the County, nor do they release the Permittee from liability if a failure occurs in the future. Collier County requires inspections for the following items: 1. Open-cutting of roadways. 2. Drainage culvert installations and any final swale grading. 3. Jack-and-bore construction, after opening of the jacking and receiving pits and before closure of the pits. 4. All work to be performed by means of directional boring. 5. Any other work which may disturb private property or which may require restoration of the right- of-way by the Permittee. 6. Any work which may disturb County owned or maintained landscape and irrigation within the right- of-way. 7. A county authorized inspector may, at the discretion of the Right-of-Way Section Manager or designee, impose immediate cessation of work in the right-of-way and may impose immediate corrective measures if the health, safety, or welfare of the public is determined to be at risk. The ordering of cessation of work on the basis of health, safety, or welfare shall not be cause for damages against the County or its representatives.” D. An annual “Blanket Permit” will be issued and the permit fee waived for all publicly regulated and/or franchised utility companies under any of the following conditions: 1. Where overhead lines cross the public right-of-way and there is no physical construction in the right-of-way. 2. For any construction in utility easements, unless the easement is a combination utility/drainage easement. 3. For pole replacement, except in combination utility/drainage easements. 4. When underground secondary and/or service cables are to be installed less than 300 feet in length and on road crossings where conduits or casings exist under the street. 5. Routine maintenance of permitted facilities. The Director of Road Maintenance or his designee will determine if the proposed activity is routine or not (if it is determined the activity is not routine, a ROW permit will be required). A schedule and a Blanket Permit shall be provided to the County where routine maintenance will occur. 3 Page 367 of 368 h. The following procedure shall be followed for the installation of drainage culvert within the public right-of- way: 1. Prior to the installation of any type of drainage culvert within the public right-of-way, a right-of-way permit shall be obtained. 2. The required culvert length, type, size, and other pertinent information including mitered end sections, concrete collars, and sod shall be shown on the approved permit. 3. The culvert grades shall be set in accordance with the approved plan and may be later modified by staff (with the ROW Permitting Section Manager’s consent) if required by practical field conditions. 4. The permittee or contractor shall place the culvert to the specified elevations and shall re-grade or re-shape the swale and road shoulders that were disturbed or damaged during construction to comply with the “General Conditions of Right-of-Way Permits” in Appendix A, and/or additional specific stipulations added to the approved permit. 5. Unless otherwise approved, a clean-out or inlet must be constructed at every common property lot line, or in accordance with FDOT requirements, whichever is less. An inlet, clean-out, or junction box shall also be required at any change of culvert size, culvert type, change of flow direction or any union of two or more culverts. The minimum inlet, clean-out, or junction box size is 24” by 36”, inside dimension. Each such inlet, clean-out, or junction box shall have a cast iron grate by United States Foundry (No. 6210) or equivalent. 6. If the swales, drainage culverts and inlets are not installed correctly, final approval will be withheld until corrected. No Certificate of Occupancy may be issued until such final approval is granted. 7. Temporary culverts must be installed within the drainageways of Collier County if construction has commenced and the approved permanent culvert is not already in place. 8. Fifteen inch diameter (unless extenuating circumstances exist as determined by the ROW Permitting Section Manager or designee) is the minimum size allowable for use where a culvert is to be connected to the County drainage system, or where a culvert is placed within the public right-of-way. 9. In cases where the culvert is associated with a driveway and is approved as part of a Building Permit, an inspection shall be made and work shall be approved prior to the Growth Management Division signing the Building Department’s “Master Control Card” to ensure that all public property has been restored to a condition satisfactory to the County. 18 Page 368 of 368
