RESOLUTION NO. 89-~
RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA REQUESTING THE FLORIDA
LEGISLATURE ADOPT A LOCAL OPTION SURTAX ON
DOCUMENTARY STAMPS WITH THE REVENUE FROM THIS
SURTAX TO BE UTILIZED FOR THE PROVISIONS OF
AFFORDABLE HOUSING
WHEREAS, the State of Florida, and Collier County, face
critical shortages in the existing supply and future production
of adequate housing affordable for low and moderate-income
persons; and
WHEREAS, it is generally recognized that, in order to
adequately provide affordable housing, governm~nt subsidies must
be used to leverage private investment for the development of low
and moderate-income housing affordable. to families at this income
levell and
WHEP~AS, while the responsibility for providing subsidy has
fallen upon the federal government for the past forty years, the
reduction of federal housing budget authority by over seventy
percent in this decade has severely limited its ability to
address the widespread housing problems throughout the nationl
and
WHEREAS, the State of Florida is most particularly affected,
as rapid population growth has combined with federal reductions
to make the affordable housing problem especially acute I and
WHEREAS, low and moderate-income households, who largely
comprise the blue-collar service and farm labor segments of the
work force, are forced to live in substandard housing or pay more
than a reasonable share of their income for housing I as the
Florida Affordable Housing Study Commission estimates that
720,000 households are paying more than thirty-five percent of

WHEREAS, Collier County recognizes that the provision of
affordable housing is an important element in the County's
economic and social vitality I and

WHEREAS, the State of Florida has imposed requirements for
the provision of affordable housing upon counties and municipali-
ties through the Growth Management Act of 1985, but State and
local governments are incapable of appropriating the necessary
funds to fully meet these requirements, and
WHEREAS, Collier County requires the Autt.ority to obtain
revenue to facilitate the development of afforddble housing, and
WHEREAS. should the State of Florida enact legislation
allowing counties to collect a local-option surtax on documentary
stamps for commercial real estate transactio.1.s, sufficient
resources would exist for Collier County to capitalize a housing
trust fund, thereby encouraging the formation of public/private
partnerships for construction and rehabilitat,on of low and
moderate-income housing; and
WHEREAS, similar legislation was adopted in 1983 to allow
Dade County and other charter counties to collect such a surtax,
and over $12 million has been raised annually by Dade County to
promote a wide range of affordable housing activities; and
WHEREAS, enabling legislation which would allow for the
adoption of a surtax in Collier County would serve a valid public
purpose.
NOW. THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the Florida
Legislature be requested to adopt legislation during its 1989
session which would allow counties throughout the State to enact
a surtax on documentary. stamps in an amount up to 45 cents for
each $100 in commercial real estate transactions. The proceeds
would be used by the counties levying the surtax to capitalize a
locally-administer~d housing trust fund, which would be used to
