Resolution 1989-030 ~ARY 1., 1818 RESOLUTION 89-30 RELATING TO PETITION CCCL-88-18C, WILSON, MILLER, BARTON, SOLL, AND PEEK, INC., REPRESENTING EQUITY SOUND DEVELOPMENT GROUP; REQUESTING A 50-FOOT VARIANCE FROM THE COASTAL CONSTRUCTION CONTROL LINE TO ALLON FOR A CONSTRUCTION ACCESS AREA SEANARD OF THE PROPOSED SEAPOINT AT NAPLES CAY BUILDING (PART OF GOVERNMENT LOT I, S16, T49S, R25E). WHEREAS, W~lson, Miller, Barton, SolI, and Peek, Inc., 50-foot variance requesting a from the Coastal are Construction Control Line (CCCL), on behalf of Equity Sound Development Group, as required by Ordinance 75-19, to allow for a construction access area seaward of the proposed Seapoint at Naples Cay Building; and WHEREAS, on January 3, 1989, an inspection of the subj ect completed by Andrea property Stevens was (Envirorunental Resources Staff), accompanied by Barbara Cawley (Wilson, Miller, Barton, SolI, and Peek, Inc.). Outer Clam Bay is located to the north of the subject property and the Villas Raphael condominium is adjacent to the property to the south; and WHEREAS, the petitioner is requesting permission to use a 50 x 375 foot area seaward of the CCCL for construction traffic and material storage during the construction of the Seapoint at Naples Cay Building; and WHEREAS, the rectangular area in question is entirely , covered with white sand washed up from the beach by a recent storm event. Mangroves are found just beyond the northern boundary of the proposed construction 'area. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that variance petition CCCL-88-18C for the proposed Seapoint at Naples Cay Building (part of Govenment Lot 1, S16, T49S, R25E) is approved subject to the following conditinns: 1. A Vehicle on the Beach permit (Ordinance 79-46) shall be secured by the petitioner before the operation of any vehicle (including a crane) seaward of the CCCL. 2. Crane relocation and vehicl., use during development activity shall be minimized to limit the potential for erosion in the area. 3. The proposed construction area shall be temporarily fenced along its northern and western boundaries to protect surrounding habitats from intrusion by construction activity. . 4. As per Section 8 of Ordinance 88-52 (Sea Turtle Ordinance), any construction within 100 feet of the vegetation line of a beach where requires nesting, a turtles are sea Construction in Sea Turtle Nesting Area Permit from the County Environmental Staff. 5. ,All construction use of the area shall be completed within 1 1/2 years from the date of this variance approval. 6.
