Executive Summary
Recommendation to approve and authorize the Chair to execute the Second Amendment to the Collier County Legal Aid
Agreement to extend the term of the Agreement through October 22, 2030, with automatic one-year renewal terms
thereafter unless terminated earlier by either party.
OBJECTIVE: To approve a Second Amendment for extension of time to the Agreement for Collier County Legal Aid.
CONSIDERATIONS: On October 22nd, 2013 (Agenda Item No. 16.K.3), the County entered into an Agreement No.
14-6351-NS “Legal Aid” (the “Agreement”) with Legal Aid to assist Collier County in providing legal aid programs
required under Sections 29.008(3)(a) and 939.185, Florida Statutes, to qualified County residents. On July 9th, 2019, the
parties amended the Agreement to extend the term for an additional three (3) years, with an option to renew the
agreement for an additional three (3) years which term expires on October 22, 2025. The Parties wish to enter into a
Second Amendment to extend the Agreement term starting on October 23, 2025, through October 22, 2030. Thereafter,
the Agreement will automatically renew October 22nd of each year for an additional year, unless terminated earlier by
either party in compliance with the Agreement.
FISCAL IMPACT: There is no change in the fiscal impact. The minimum funding for Collier County Legal Aid is
determined by the amount of court fees collected to assist Collier County in providing legal aid programs required under
Sections 29.008(3)(a) and 939.185, Florida Statutes which is understood to be $193,000. Therefore, the County is
obligated to make available to the Legal Aid Society all funds collected for this program if the appropriate receipts are
provided to the County for reimbursement. As set forth above, funding of legal aid by the Counties was mandated by
the Legislature, which also provided a funding mechanism. There is accordingly no discretion on the County’s part
with respect to minimum funding of legal aid, though the County is free to provide additional funding beyond the
statutory requirements, should it wish.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority vote for approval.

RECOMMENDATIONS: That the Board of County Commissioners approves and authorizes the Chair to sign a
Second Amendment to the Collier County Legal Aid Agreement to extend the term of the Collier County Legal Aid
Agreement.
