Executive Summary
Recommendation to authorize the County Attorney to file a lawsuit on behalf of Collier County Board of County
Commissioners against RTS of Broward Corp., d/b/a RTS Underground, and any other responsible parties for
$40,829.29 in damages caused to a 6’ wastewater force main in front of 3313 Europa Drive, Naples, Florida and to sewer
laterals located at 109, 124, and 215 Willowick Drive, Naples, Florida.
OBJECTIVE: To recover the money spent by Collier County to repair County owned, operated, and maintained assets
from the responsible negligent contractor.
CONSIDERATIONS: On or about October 26, 2021, workers for RTS of Broward Corp., d/b/a RTS Underground
(“RTS Underground”) damaged a 6-inch County wastewater force main while performing a directional bore involving
cable work. The County was required to engage an emergency contractor and utilize staff resources to restore the
County’s 6-inch wastewater force main, and the County incurred $6,217.41 in damages. RTS Underground has been
contacted by the County’s third-party adjuster Johns Eastern Company, as well as by the County Attorney’s Office,
several times with no responses received.
On or about August 19, 2022, workers for RTS Underground damaged the County’s sewer laterals while performing
directional boring activities. The County was required to engage an emergency contractor and utilize staff resources to
restore the County’s sewer laterals, and the County incurred $34,611.88 in damages. RTS Underground has been
contacted by the County’s third-party adjuster Johns Eastern Company several times with no responses received. The
sum of the damages caused by RTS Underground to County assets is $40,829.29, not including other direct and
consequential damages that may be recoverable.
The County recommends Board of County Commissioner (“Board”) approval to file a lawsuit in county court to recover
the damages. Attached is a draft copy of the complaint, along with corresponding backup materials documenting the
damage and amounts thereof.
By filing this lawsuit to recover damages, the County puts contractors on notice that they will be held responsible for
their negligent actions.
FISCAL IMPACT: The cost to file and serve a Complaint is approximately $410.00 and funds are budgeted and
available in the Risk Management Property & Casualty Fund.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this item.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for
Board approval. – CLD

COMPLAINT
Plaintiff, BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY,
FLORIDA, (the “County”), by and through its undersigned counsel, sues Defendant, RTS OF
BROWARD CORP., d/b/a RTS UNDERGROUND (“RTS UNDERGROUND”), a Florida Profit
Corporation, and states as follows:
NATURE OF CLAIMS, THE PARTIES, JURISDICTION, AND VENUE
1. The County’s claims stem from damage to the County’s personal property,
specifically an underground 6-inch wastewater force main and sewer laterals, owned, operated,
and maintained by the County, and the resulting cost of repair and mitigation incurred by the
County.
2. This Court has jurisdiction over this matter, as it is an action to recover damages
more than $8,000.00 and less than $50,000.00.
3. In personam jurisdiction is properly exercised over RTS UNDERGROUND
because RTS UNDERGROUND is a Florida corporation and Florida courts have personal

jurisdiction over all Florida residents. See, e.g., Subic Bay Marine Exploratorium, Inc. v. JV China,
Inc., 257 So. 3d 1139, 1141 (Fla. 5th DCA 2018).
4. The County, as the governing body for Collier County, Florida, a political
subdivision of the State of Florida, and as the ex-officio governing board of the Collier County
Water-Sewer District, an independent special district created by the Florida Legislature, is the
owner of the personal property that is the subject of this litigation and is thus authorized to bring
this action.
5. RTS UNDERGROUND is a profit corporation organized under the laws of Florida,
with its principal place of business at 14810 Queen Ave, Clewiston, Florida 33440, in Hendry
County, Florida, and is authorized to and does conduct business throughout the State of Florida,
including in Collier County.
6. Venue is proper in Collier County, Florida, pursuant to Sections 47.011 and 47.051,
Florida Statutes, because (i) this is an action against a domestic corporation, (ii) Collier County is
where the instant cause of action accrued, (iii) Collier County is where the property in litigation is
located, (iv) the property damage occurred in Collier County, and (v) the amounts due to the
COUNTY are due in Collier County.
FACTUAL ALLEGATIONS
7. In 1993, the Florida Legislature enacted the “Underground Facility Damage
Prevention and Safety Act,” Chapter 556, Florida Statutes (“the Act”), to prevent injury to persons
or property and the interruption of services resulting from damage to an underground facility
caused by excavation or demolition operations. Fla. Stat. § 556.101(3)(a).
8. The Act created a not-for-profit corporation called Sunshine State One-Call of
Florida, Inc. (the “Corporation”), and requires the Corporation to maintain a free-access

notification system (the “One-Call System” or “System”) which excavators can use to notify
owners of underground facilities of planned excavation or demolition activities. See Fla. Stat. §§
556.103, 556.104.
9. The Corporation is comprised of the owners of underground facilities in the State
of Florida, which are called “member operators” by the Act. Fla. Stat. § 556.104.
10. The County is a “member operator” under the Act.
11. Under the Act, “excavators” and “excavating contractors” are required to notify the
System and provide information about a planned excavation at least two full business days before
beginning any excavation. Fla. Stat. § 556.105(1). The System then notifies member operators
with underground facilities near the planned excavation, who are required to “identify the
horizontal route by marking to within 24 inches born the outer edge of either side of the
underground facility by the use of stakes, paint, flags, or other suitable means within two full
business days after the time the notification is received” from the System. Fla. Stat. § 556.105(5)
(emphasis added).
12. RTS UNDERGROUND is an “excavator” and/or “excavating contractor” under the
Act because they performed the excavation work at issue.
13. RTS UNDERGROUND is a licensed Certified General Contractor in Florida with
a license number CGC1527621.
14. Florida Power & Light Company hired RTS UNDERGROUND to perform
excavation work at 3313 Europa Drive, 109 Willowick Drive, 124 Willowick Drive, and 215
Willowick Drive, Naples, Collier County, Florida.
15. Under the Act, “[w]hen an excavation site cannot be described in information
provided under s. 556.105(1)(a) with sufficient particularity to enable the member operator to

ascertain the excavation site, and if the excavator and member operator have not mutually agreed
otherwise, the excavator shall premark the proposed area of the excavation before a member
operator is required to identify the horizontal route of its underground facilities in the proximity
of any excavation. However, premarking is not required when the premarking could reasonably
interfere with traffic or pedestrian control.” Fla. Stat. § 556.114(3).
16. RTS UNDERGROUND failed to notify the System of planned excavation work at
3313 Europa Drive.
17. On or around October 2021, RTS UNDERGROUND engaged in directional
drilling activities at 3313 Europa Drive and hit and damaged the County’s owned, operated, and
maintained wastewater force main. The County discovered damage to its wastewater force main
on October 26, 2021.
18. Prior to performing the excavation work at 3313 Europa Drive, the County provided
a positive response code “3N” and requested that RTS UNDERGROUND “white line” the
proposed excavation.
19. The System provides response codes on its website
https://sunshine811.com/response-codes, stating “[n]ext to getting your locate ticket, confirming
and verifying member positive responses is essential to preventing damage to underground
facilities. By comparing what you see at your excavation/dig site to the positive response codes
for your locate ticket, you can determine whether it's safe to begin digging or do some follow up
with the member operator.”
20. The System’s definition of the 3N positive response code on its website
https://sunshine811.com/response-codes is as follows:
3N Unmarked: Locate description is insufficient - white lining is required per s.
556.114(3), F.S. Please contact the utility when white lining is completed.

Excavation site is unmarked. Based on the written description on the ticket, the
locate technician could not determine the exact area that needed locating. White
lining is required per s. 556.114(3), F.S., when the written description of the area
to be located is not understandable and when the marks don't interfere with traffic
or pedestrian control (i.e. placing white marks on the ground could be confused
with the lines already on pavement directing pedestrian and car traffic).
21. RTS UNDERGROUND failed to respond to the County’s 3N positive response
code and failed to white line the projected boring path resulting in damage to the County’s
wastewater force main.
22. On August 14, 2022, RTS UNDERGROUND’s representative, Anabel Alomar,
notified the System of a planned excavation at the North and South side of Willowick Drive
between Turnbury Way and Lakeland Avenue.
23. On August 17, 2022, RTS UNDERGROUND’s representative, Antonio Leon,
notified the System of a planned excavation at the entire property located at 103, 109, 119, 123,
127, 215, 223, 229, 235, and 239 Willowick Drive.
24. On August 23, 2022, the County marked the underground utilities at the locations
described in paragraphs 22 and 23 of the Complaint.
25. On or around August 19, 2022, RTS UNDERGROUND engaged in underground
boring activities at 109, 124, and 215 Willowick Drive and hit and damaged the County’s owned,
operated, and maintained sewer laterals.
26. “If any excavator fails to discharge a duty imposed by [the Act], the excavator, if
found liable, is liable for the total sum of the losses to all parties involved as those costs are
normally computed.” Fla. Stat. § 556.106(2)(b).
27. As a result of RTS UNDERGROUND’s negligence, the County incurred monetary
damages, including but not limited to the cost to repair the County’s wastewater force main and
sewer laterals in the total amount of $40,829.29.

28. Accordingly, RTS UNDERGROUND is liable to the County for the total sum of
the losses to repair the damage caused by RTS UNDERGROUND.
29. All conditions precedent to the relief demanded herein have been performed or
waived.
COUNT I – NEGLIGENCE
Wastewater Force Main Damage located at 3313 Europa Drive.
30. The County re-alleges and incorporates by reference its allegations in paragraphs
1–28, as if fully set forth herein.
31. RTS UNDERGROUND had a duty to notify the System and provide information
about their planned excavation at least two full business days before beginning any excavation.
Fla. Stat. § 556.105(1).
32. RTS UNDERGROUND breached the aforementioned duty by failing to notify the
System pursuant to Section 556.105(1), Florida Statutes.
33. RTS UNDERGROUND’s breach of its duty to notify the System is the direct,
proximate, and foreseeable result of the damage caused to the County’s owned, operated, and
maintained wastewater force main located at 3313 Europa Drive.
34. In addition, should a member operator not mark its utilities, the Act imposes a duty
on excavators to proceed only “if the excavator does so with reasonable care and if detection
equipment or other acceptable means to locate underground facilities are used.” Fla. Stat. §
556.105(6)(a).
35. RTS UNDERGROUND had a duty to use increased caution to use reasonable care
and locate the County’s wastewater force main located at 3313 Europa Drive.

36. RTS UNDERGROUND breached the aforementioned duty by failing to use
reasonable care and failing to locate the County’s wastewater force main located at 3313 Europa
Drive.
37. RTS UNDERGROUND’s breach of its duty to use reasonable care and failing to
locate the County’s wastewater force main before proceeding with the excavation is the direct,
proximate, and foreseeable result of the damage caused to the County’s wastewater force main.
38. Finally, RTS UNDERGROUND had a duty to exercise due care in the performance
of its excavation at 3313 Europa Drive, which required RTS UNDERGROUND to exercise the
degree of care that a reasonably careful excavator would use under like circumstances.
39. RTS UNDERGROUND breached its duty to exercise due care in the performance
of its excavation at 3313 Europa Drive, in the following ways:
a. RTS UNDERGROUND knew or should have known that the County had utilities
in the vicinity of the proposed excavation.
b. RTS UNDERGROUND failed to use the System altogether to provide information
about its planned excavation at least two full business days before beginning any
excavation. Fla. Stat. § 556.105(1).
c. RTS UNDERGROUND ignored the County’s positive 3N response requesting that
the proposed excavation be white lined. See Fla. Stat. § 556.114(3).
d. RTS UNDERGROUND failed to coordinate with the County and provide
additional information or a white line of the proposed excavation.
e. RTS UNDERGROUND performed an excavation by directionally drilling
underneath the ground without first locating the County’s wastewater force main or
coordinating the excavation with the County.

40. The damage caused to the County’s wastewater force main was the direct,
proximate, and foreseeable result of RTS UNDERGROUND’s malfeasance described in
Paragraph 38, a.– e.
41. As a result of RTS UNDERGROUND’s negligence, the County incurred monetary
damages including, but not limited to, $6,217.41 incurred by the County to repair the wastewater
force main, and other direct and consequential damages.
42. RTS UNDERGROUND is liable to the County for the total sum of the losses
incurred by the County as a result of its negligence. Fla. Stat. § 556.106(2)(b).
WHEREFORE, the County demands judgment against Defendant, RTS OF BROWARD
CORP., d/b/a RTS UNDERGROUND, for damages, together with prejudgment interest and costs,
and for such other or further relief as this Court deems equitable and just under the circumstances.
COUNT II – NEGLIGENCE
Sewer Lateral Damage at 109, 124, and 215 Willowick Drive.
43. The County re-alleges and incorporates by reference its allegations in paragraphs
1–28, as if fully set forth herein.
44. “Obtaining information as to the location of an underground facility from the
member operator as required by this chapter does not excuse any excavator from performing an
excavation or demolition in a careful and prudent manner, based on accepted engineering and
construction practices, and it does not excuse the excavator from liability for any damage or injury
resulting from any excavation or demolition.” Fla. Stat. § 556.106(2)(c).
45. The Act imposes a duty on excavators to perform excavations in a careful and
prudent manner, based on accepted engineering and construction practices. Fla. Stat. §
556.106(2)(c).

46. RTS UNDERGROUND had a duty to perform its excavation at 109, 124, and 215
Willowick Drive in a careful and prudent manner, based on accepted engineering and construction
practices.
47. RTS UNDERGROUND breached this duty by failing to perform its excavation in
a careful and prudent manner, based on accepted engineering and construction practices.
48. RTS UNDERGROUND’s breach of its duty to perform its excavation in a careful
and prudent manner is the direct, proximate, and foreseeable result of the damage caused to the
County’s sewer laterals at 109, 124, and 215 Willowick Drive.
49. In addition, the Act imposes a duty on excavators to use increased caution to
identify and protect underground facilities when an excavation is to take place within a “tolerance
zone.” Fla. Stat. § 556.105(5)(c). “The protection requires hand digging, pot holing, soft digging,
vacuum excavation methods, or similar procedures to identify underground facilities.” Id.
50. The Act defines “tolerance zone” as “24 inches from the outer edge of either side
of the exterior surface of a marked underground facility.” Fla. Stat. § 556.102(15).
51. RTS UNDERGROUND’s excavation at 109, 124, and 215 Willowick Drive was
within the “tolerance zone” of the County’s sewer laterals.
52. RTS UNDERGROUND knew or should have known that its excavation was within
the “tolerance zone” of the County’s sewer laterals, of which the County’s sewer laterals were
marked prior to the excavation work.
53. RTS UNDERGROUND had a duty to use increased caution to identify and protect
the County’s sewer laterals.

54. RTS UNDERGROUND breached this duty by failing to use increased caution to
identify and protect the County’s sewer laterals before proceeding with its excavation at 109, 124,
and 215 Willowick Drive.
55. The damage caused to the County’s sewer laterals was the direct, proximate, and
foreseeable result of RTS UNDERGROUND’s breach of its duty to use increased caution to
identify and protect the County’s sewer laterals within the tolerance zone.
56. Finally, RTS UNDERGROUND had a duty to exercise due care in the performance
of its excavation at 109, 124, and 215 Willowick Drive, which required RTS UNDERGROUND
to exercise the degree of care that a reasonably careful excavator would use under like
circumstances.
57. RTS UNDERGROUND breached its duty to exercise due care in the performance
of its excavation at 109, 124, and 215 Willowick Drive because RTS UNDERGROUND knew or
should have known that the County had utilities in the vicinity of the proposed excavation.
58. The damage caused to the County’s sewer laterals was the direct, proximate, and
foreseeable result of RTS UNDERGROUND’s breach.
59. As a result of RTS UNDERGROUND’s negligence, the County incurred monetary
damages including, but not limited to, $34,611.88 incurred by the County to repair the sewer
laterals, and other direct and consequential damages.
60. RTS UNDERGROUND is liable to the County for the total sum of the losses
incurred by the County as a result of its negligence. Fla. Stat. § 556.106(2)(b).
WHEREFORE, the County demands judgment against Defendant, RTS OF BROWARD
CORP., d/b/a RTS UNDERGROUND, for damages, together with prejudgment interest and costs,
and for such other or further relief as this Court deems equitable and just under the circumstances.

area of where they were working and the contractor did not check positive response, Mackenzie left the
positive response of 3N Requesting white line of the projected bore path will be. If the contractor would
have stayed compliant with FS 556 and checked positive response this damage could have been
avoided. The contractor failed to follow the requirements of 556 and should be responsible for the
damage.

commencing excavation for the work, potholing of all potential conflicts must be performed.
Condition: Sunshine 811 Damage Prevention Guide: Chapter 556, F.S., sets a tolerance zone that extends 24 inches from the outer edge of each
side of an underground facility. Locate marks show the approximate location of an underground facility. To be sure where that facility is
located, you must expose it using a method below: Hand digging at an angle toward the facility Pot holing Soft digging Vacuum excavation
methods Other similar procedures Exposing the facility lets you see the facility size and the clearance you need to maintain during excavation.
Digging within the tolerance zone requires special precaution and using mechanized equipment requires a spotter. Within existing pavement,
soft digging will be required after removal of pavement associated with a permitted open-cut.
