OBJECTIVE: To declare a seat to be vacant on the Collier County Code Enforcement Board. CONSIDERATIONS: This seven-member board, plus two alternates, was established pursuant to Chapter 162 of the Florida Statutes by Ordinance No. 07-44, as amended, and is composed of individuals representing the occupations of architect, business owner, engineer, general contractor, subcontractor and realtor, and who are considered for appointment based on their experience or interest in the areas of the codes and ordinances to be enforced. Members are required to file a Form 1 Statement of Financial Interest each year with the Supervisor of Elections. Terms are 3 years. This is a quasi-judicial board. A list of the current membership is included in the backup. A member of this board, Sue Curley, has been unable to attend the past three consecutive Code Enforcement Board meetings. Collier County Ordinance No. 2001-55, as amended, provides that if any board member is absent from two consecutive meetings without a satisfactory excuse acceptable to the board chairperson, the board chairperson shall state such fact at the next board meeting, and if the Commission concurs with the chairperson’s notification, the Commission shall declare the board member’s position to be vacant. There are currently two vacant seats for alternates. STAFF RECOMMENDATION: On September 25, 2025, the Code Enforcement Board met and voted in favor of removing Ms. Curley for excessive absence. Ms. Curley has missed 11 of 23 meetings in the past two years, from August 2023 to August 2025. Attendance records and a recommendation memo are included in the backup. FISCAL IMPACT: There is no fiscal impact associated with this action. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for Board approval. -JAK RECOMMENDATIONS: That the Board of County Commissioners adopts the Staff Recommendation and authorizes the Chair to execute the attached resolution declaring the vacancy. Ms. Curley's appointment on the Board began on December 9, 2014. Ms. Curley missed five of the eleven meetings in 2023 and five of the eleven meetings in 2024. Some with written notice provided and others were unexcused absences. Ms. Curley has not attended a Code Enforcement Board Hearing since May 2025 and has missed five ofthe nine meetings so far in 2025. Due to the nature ofour hearings, it is imperative to ensure a quorum, which has been a concern previously. The Code Enforcement Board voted in favor olhaving her removed from the Board. WHEREAS, the Board of County Commissioners adopted Ordinance No. 07-44, as amended, the Consolidated Code Enforcement Ordinance, which established the Collier County Code Enforcement Board to hear and decide cases in which violations are alleged of any provision of Collier County codes or ordinances; and WHEREAS, Ordinance No. 07-44, as amended, provides that the Collier County Code Enforcement Board shall consist of seven regular members and two alternate members; and WHEREAS, Collier County Ordinance No. 01-55, as amended, provides that any board member who is absent for more than one-half of the board’s meetings in a given fiscal year shall be deemed to have tendered his or her resignation from such board; and WHEREAS, member Sue Curley has missed the last three consecutive meetings of the Code Enforcement Board; and WHEREAS, the Chairman of the Code Enforcement Board has requested that the Board of County Commissioners declare that the seat held by Sue Curley be vacant on their Board. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the seat of Sue Curley is hereby declared to be vacant on the Collier County Code Enforcement Board.
