Executive Summary
Recommendation to hold a public hearing to consider vacating the 30-foot-wide public roadway easements as described
in Official Record Book 1033, at pages 1087, 1098, 1099, 1103, 1107, 1122, and 1126, of the public records of Collier
County, Florida, located approximately 4,900 feet Northeasterly of U.S. 41, Tamiami Trail East and approximately 4,000
feet east of Greenway Road in Section 7, Township 51 South, Range 27 East, Collier County, Florida. (PL20240001248)
OBJECTIVE: For the Board of County Commissioners (Board) to establish a time and date for a public hearing to
consider the vacation of the County and the Public interest in the 30-foot-wide public roadway easements as described in
Official Record Book 1033, at pages 1087, 1098, 1099, 1103, 1107, 1122, and 1126, of the public records of Collier
County, Florida, Located in Section 7, Township 51 South, Range 27 East, of the Public Records of Collier County,
pursuant to Florida Statutes section 336.09(2) and Resolution No. 2021-243.
CONSIDERATIONS: This request is to vacate the 30-foot-wide public roadway easements as described in Official
Record Book 1033, Pages 1087, 1098, 1099, 1103, 1107, 1122, and 1126, of the Public Records of Collier County,
Florida, in Section 7, Township 51 South, Range 27 East, Collier County, Florida. This would vacate and clear title to a
bisecting roadway known as Laredo Street, located east of Greenway Road in Rural Fringe Mixed Use Overlay
(RFMUO)-Receiving Lands. Laredo Street is the result of various deed conveyances in the 1980s from the then-grantors
to Collier County. It is comprised of fragmented 30-foot-wide segments.
The Petitioners are Greenway Fritchey Land, LLC, and Habitat for Humanity of Collier County, Inc., as owners of the
Parcels to which the aforementioned public roadway easements occupy. Petitioners accordingly own all abutting sides of
Laredo Street, from the northern right-of-way line of Fritchey Road and "dead ends" at the north line of Section 7.
(However, this application requests a "quit claim" vacation of the entire length of Laredo Street to the north line of
Section 7 for purposes of technical title clearance.) Laredo Street does not provide practical or legal access to any other
parcels, except those owned by the Petitioners. These existing parcels are part of a Growth Management Plan
Amendment and Planned Unit Development rezone, to be known as the Greenway Fritchey RPUD.
Statement of Public Benefit:
1. There is no present necessity or reasonably foreseeable necessity for retention of Laredo Street, and no
adjoining property owner's right of legal access will be affected by the vacation of Laredo Street.
2. Under Policy II.B.1.A of the Future Land Use Element, development is to be directed to this area, designated as
Receiving Lands on the Future Land Use Map of the Growth Management Plan. Policies centered on
Receiving Lands under the Future Land Use Element encourage and incentivize development in this area. The
vacation will support these public policies employed to direct development to Receiving Lands by eliminating
gaps between Petitioners' lands, allowing for a cohesive and contiguous project that supports both market-rate
and affordable housing.
3. Petitioners will reserve, on an equal square footage basis relative to the vacation area, right-of-way for a future
expansion of Fritchey Road and Greenway Road, along the frontages of the proposed residential project,
without compensation or impact fee credits.
To clear the cloud on the title relating to Laredo Street for development, two actions are required:
1. A deed from Collier County conveying its fee simple ownership in the various 30-foot-wide slivers that are
vested in the County by virtue of the aforementioned deeds establishing fractured segments of Laredo Street:
• The West thirty-foot (30') of the land is described in those certain Deeds recorded in Official Records Book
1033, Page 1103; and in Official Records Book 1033, Page 1099; and in Official Records Book 1033, Page
1087; and in Official Records Book 1033, Page 1107, Collier County, Florida.
• The eastern thirty-foot (30') of the land is described in those certain Deeds recorded in Official Records Book

1033, Page 1122; and in Official Records Book 1033, Page 1126; and in Official Records Book 1033, Page
1098, Collier County, Florida.
2. Vacation of the public interest over Laredo Street and the lands contiguous thereto for purposes of technical title
clearance. This request is to vacate a 60-foot-wide portion of the potential easement area from Fitchey Road to
the north Section Line of Section 7, despite only segments having been conveyed to Collier County pursuant to
action no. 1 above, in order to eliminate the street completely and remove ambiguity with respect to the public
right to use the street in connection with redevelopment.
The Development Review Division has reviewed this petition and found no reason for objection.
Pursuant to Florida Statutes section 336.09(2) and Resolution 2021-243, the Board "may adopt a resolution declaring
that at a definite time and place a public hearing will be held to consider the advisability of [vacating the public road
rights-of-way]." If the proposed resolution is adopted, the hearing will take place on December 9, 2025.
Additionally, the hearing will be advertised in a local newspaper of general circulation, pursuant to Florida Statutes
Section 336.10 and Resolution 2021-243, and the property owners will also be given notice.
This item is consistent with the Collier County strategic plan objective to operate an efficient and customer focused
permitting process.
FISCAL IMPACT: The application fee of $2,000 covers staff review, and processing. The applicant is also responsible
for advertising fees.
GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for
Board approval – CLD

1033, Page 1122; and in Official Records Book 1033, Page 1126; and in Official

The release is restricted to the following description: Florida Power and Light
Company has reviewed your request on the properties located at Parcel numbers:

A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
AMENDING RESOLUTION 2006-160, AS AMENDED, IN
ORDER TO AMEND THE POLICIES AND PROCEDURES
FOR: 1) THE CLOSING AND VACATION OF ROAD
RIGHTS-OF-WAY; 2) THE VACATION AND
ANNULMENT OF PLATS OR PORTIONS OF PLATS OF
SUBDIVIDED LAND; AND 3) THE EXTINGUISHMENT OF
PUBLIC EASEMENTS CONVEYED BY SEPARATE
INSTRUMENT RECORDED IN THE PUBLIC RECORDS
CONVEYANCES OTHER THAN ON A SUBDIVISION
PLAT) ON PLATTED OR UNPLATTED LAND, EXCEPT
FOR PUBLIC ROADS, OR THE EXCHANGE OF REAL
PROPERTY.
WHEREAS, the Board of County Commissioners of Collier County, Florida ("Board"),
pursuant to sections 125.01, 125.37, 177.101, 336.09 and 336.10, Florida Statutes, Collier
County Ordinance No. 2004-31, as amended, and the Collier County Land Development Code, is
authorized to grant or deny vacations and annulments of plats of subdivided land, road rights-of-
way, alleyways, and public dedicated easements conveyed by separate instrument recorded in the
public records, and exchange of real property; and
WHEREAS, the Board, on July 25, 2006, adopted Resolution 2006-160, which
superseded and replaced Resolution 1998-465, establishing the policies and procedures
previously established for the above; and
WHEREAS, the Board, on September 10, 2013, adopted Resolution 2013-166, which
amended Resolution 2006-160, to further amend the policies and procedures previously
established for the above; and
WHEREAS, the Board desires to further amend the policies and procedures for: 1)
closing and vacation of road rights-of-way; 2) vacation and annulment of plats or portions of
plats of subdivided land; and 3) extinguishment of public easements conveyed by separate

POLICY AND PROCEDURE ON THE CLOSING
AND VACATION OF ROAD RIGHT-OF-WAY
A. AUTHORITY: —Sections 336.09 and 336.10, Florida Statutes.
B. POLICY: When a request is in the interest of the general public welfare or where no public
detriment is established and when said request does not invade or violate individual property
rights and otherwise qualifies under Ssection 336.09, Florida Statutes, the Board of County
Commissioners (BCC)may:
1. Vacate, abandon, discontinue and close any existing public or private street, alleyway,
road, highway, or other place used for travel, or any portion thereof, other than a state or
federal highway, and to renounce and disclaim any right of the County and the public in
and to any land in connection therewith.
2. Renounce and disclaim any right of the County and the public in and to any land, or
interest therein, acquired by purchase, gift, devise, dedication or prescription for street,
alleyway, road or highway purposes, other than lands acquired for state and federal
highways.
3. Renounce and disclaim any right of the County and the public in and to land, other than
land constituting, or acquired for, a state or federal highway, delineated on any recorded
map or plat as a street, alleyway, road, highway or other place used for vehicular travel.
C. PROCEDURE:
1. An application for the vacation of road right-of-way is to be completed along with the
listed items needed for review and to be submitted to Growth Management, Development
Review Division / Planning and Regulation, Engineering Services Section. It must be
accompanied by a non-refundable application fee (refer to Growth Management
Development Services' / Planning and Regulation current fee schedule for the applicable
fee).
2. The petitioner must also provide:
a) Evidence to show that the petitioner owns the fee simple title to the whole or that part
of the parcel sought to be vacated (FEEee SIMPLEimple DEEDeed). If petitioner is

and resolution and transmit both documents to the County Attorney's Office for approval.
If approved as to form and legality by the County Attorney, the petition will be filed with
the Clerk to the Board with a request for a time and date for a public hearing. The
petition may be placed on the BCC agenda to establish a time and date for a public
hearing by Resolution pursuant to Ssection 336.09, Florida Statutes.
4. Once the time and date of the public hearing isare established, the Clerk to the Board
shall publish legal notice of the hearing one time in a newspaper of general circulation at
least two weeks prior to the date stated therein for such hearing.
5. The petitioner and all property owners within 250 feet (and others as may be required by
the Engineering ServicesDevelopment Review Division) of the requested vacation parcel
shall be given notice by the Clerk to the Board; stating time, place and date of public
hearing, by regular mail. If the number of property owners within two hundred fifty feet
250') exceeds twenty (20), petitioner shall incur an additional postage and handling
charge of fifty cents ($.50)per additional property owner.
6. In the event that the petitioner for the property in question does not represent lthemself
at the public hearing(s), they must provide a signed letter or other appropriate
documentation which authorizes another specific person to represent h4mthem.
7. The Board of County Commissioners shall then hold a public hearing and any approved
resolution by such governing body shall have the effect of vacating all requested streets
and alleys which have not become highways necessary for use by the traveling public.
8. Notice of the adoption of such a resolution by the Commissioners shall be published by
the Clerk to the Board one time, within 30 days following its adoption, in one issue of a

9. The processing of this petition shall coincide, where applicable, with the processing of
such other platting or land use change applications proposed for the same property with
regard to submissions of applications, staff reviews, reviews by advisory bodies, or the
Board of County Commissioners, so that the decision on such vacation shall occur at the
same meeting at which time the reuse application is reviewed by the Board of County
Commissioners.
10. Once the application is accepted for review it will remain under review so long as a
resubmittal in response to a county reviewer's comments is received within 90 days of the
date on which the comments were sent to the applicant with a one time extension of an
additional 90 days upon written notification. If a response is not received within this
time, the application for request review will be considered withdrawn. Further review of
the project will require a new application subject to the then current code.

A. AUTHORITY: _Section 177.101 Florida Statutes, and Collier County Ordinance No. 01 57
2004-31 and the Collier County Land Development Code.
B. POLICY: When a request is in the interest of the general public welfare or no public
detriment is established, the persons making application for said vacation own the fee simple
title to the whole or that part of the tract covered by the plat sought to be vacated, the request
will not affect the ownership or right of convenient access of persons owning other parts of
the subdivision, and the request does not invade or violate individual property rights, the
Board of County Commissioners may adopt resolutions vacating plats in whole or in part of
subdivisions in said countyies, returning the property covered by such plats either in whole or
in part into acreage.
C. PROCEDURE:
1. To petition for the vacation and annulment of plats or portions of plats of subdivided
land, an application is to be completed along with the listed items needed for review. The
application must be submitted to Engineering ServicesGrowth Management,

B. POLICY: Requests will be granted as long as the public benefit is established or no public
detriment is established. The Board of County Commissioners may:

thereof, granted to the County or public by any instrument recorded in the public records
of Collier County and to renounce and disclaim any right of the County and the public in

1) A sketch and lbegal description and sketch of what is to be dedicated, prepared
along with a current attorney's title opinion or certification by a title company
and noted on the sketch, signed and sealed by a Florida Professional Surveyor
and Mapper and have a "Prepared by" block listing the name and address of the
Florida Professional Surveyor and Mapper,,.-

3. Engineering ServicesDevelopment Review Division will review the petition for

If approved as to form and legality by the County Attorney, the petition will be filed with
the Clerk to the Board with a request for a time and date for a public hearing.
4_Where anFor exchanges of real property interest is applicablepursuant to section 125.37,
Florida Statutes, the terms and conditions of any such exchange of property shall be
published, once a week for at least two weeks, in a newspaper of general circulation
published in the County prior to the adoption by the Board of County Commissioners.
45. In the event that the owner of the property in question does not represent l-imthemself at
the BCC meeting, they must provide a signed letter or appropriate documentation which
authorizes another specific person to represent lthem.
36. The processing of this petition shall coincide, where applicable, with the processing of
such other platting or land use change applications proposed for the same property with
regard to submissions of applications, staff reviews, reviews by advisory bodies, or the
Board of County Commissioners, so that the decision on such extinguishment shall occur
at the same meeting at which time the re use application is reviewed by the Board of
County Commissioners.
67. Once the application is accepted for review it will remain under review so long as a
resubmittal in response to a county reviewer's comments is received within 90 days of the
date on which the comments were sent to the applicant with a one time extension of an
additional 90 days upon written notification. If a response is not received within this
time, the application for request review will be considered withdrawn and cancelled.
Further review of the project will require a new application subject to the then current
code.

Executive Summary
Recommendation to authorize the Clerk of Courts to release a Performance Bond in the amount of $690,732, which was
posted as a guaranty for Excavation Permit Number PL20230015778 for work associated with Sandy Lane Assemblage.
OBJECTIVE: To release a security which was posted as a development guaranty.
CONSIDERATIONS: The Development Review Division routinely accepts securities administratively as guaranties
for developer commitments in accordance with Section 22-115 of the Collier County Code of Ordinances. The work
associated with this security has been inspected, and the developer has fulfilled his commitments with respect to this
security. The Performance Bond was posted as security for an Excavation Permit associated with the Sandy Lane
Assemblage. The As-Built lake cross-sections have been received, and the lakes were inspected on August 20, 2025, by
the Development Review Division.
This item is consistent with the Collier County strategic plan objective to operate an efficient and customer-focused
permitting process.
FISCAL IMPACT: Performance Bond securities are held as a development guaranty and released after work is
performed.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for
Board approval. - SAA
RECOMMENDATIONS: To authorize the Clerk of Courts to release the Performance Bond in the amount of
$690,732. Development Review staff will issue a Memorandum to the Clerk of Courts upon approval of this item by the
Board of County Commissioners, advising the Clerk of this action.

THIS EXCAVATION PERFORIVIANCE AGREEIVENT entered into this 9th day of
November, 2023 between Naples Associates Vl, LLLP hereinafter referred to as "Developer,"
and the Board of County Commissioners of Collier County, Florida, hereinafter referred to as the
"Board".
WHEREAS, Developer has applied for an excavation permit in accordance with Section
22-106, et a/- of the Collier County Code of Laws and Ordinances, and the Collier County Land
Development Code, including but not limited to Section 3.05.1 0 (collectively, the "Excavation
Regulations"); and
WHEREAS, the Excavation Regulations require the Developer to post appropriate
guarantees and execute an Excavation Performance Security Agreement stating applicant will
comply with the Excavation Regulations and Excavation Permit No. PL20230015778 (the
"Excavation Permit").
NOW, THEREFORE, in consideration of the foregoing premises and mutual covenants
hereinafter set forth, Developer and the Board do hereby covenant and agree as follows:
1. Developer agrees to comply with the Excavation Regulations and the Excavation
Permit (the "Excavation Work").
2. Developer herewith tenders its excavation performance security (attached hereto
as Exhibit "A" and by reference made a part hereofl in the amount of
$690.732.00.
ln the event of default by Developer or failure of Developer to complete the
Excavation Work within the tlme required by the Excavation Regulations and
Excavation Permit, Collier County, may call upon the excavation performance
security to insure satisfactory completion of the Excavation Work.
The Excavation Work shall not be considered complete until Developer notifies
the County that the Excavation Work is complete and the final Excavation Work
is reviewed and approved by the County lrilanager or designee for compliance
with the Excavation Regulations.
The County Manager or designee shall, within sixty (60) days of receipt of
notification by Developer in writing that the Excavation Work is complete, either:
a) notify Developer in writing of his approval of the Excavation Work; or b) notify
the Developer in writing of his refusal to approve the Excavation Work, therewith
specifying those conditions which Developer must fulfill in order to obtain the
County [/anager's approval of the Excavation Work.
ln the event Developer shall fail or neglect to fulfill its obligations under this
Agreement, upon certification of such failure, the County lt/lanager or designee
may call upon the excavation performance security to secure satisfactory
completion, repair and maintenance of the Excavation Work. The Board shall
have the right to construct and maintain, or cause to be constructed or
maintained, pursuant to public advertisement and receipt and acceptance of bids,

the Excavation Work. The Developer, as principal under the excavation
performance security, shall be liable to pay and to indemnify the Board, upon
completion of such construction, the final total cost to the Board thereof,
including, but not limited to, engineering, legal and contingent costs, together
with any damages, either direct or consequential, which the Board may sustain
on account of the failure of Developer to fulfill all of the provisions of this
Agreement.
7. All of the terms, covenants and conditions herein contained are and shall be
binding upon Developer and the respective successors and assigns of
Developer.

County of the specific improvements described in the Land Development Regulations (hereinafter the
"Guaranty Period") or until replaced by a new bond in the event of a change of Ownership. Pursuant to
Code of Ordinances Section 22-1 15.
NOW, THEREFORE, if the Owner shall well, truly and faithfully perform its obligations and duties in
accordance with the Land Development Regulations during the guaranty period established by the County,
and the Owner shall satisfy all claims and demands incurred and shall fully indemnify and save harmless
the County from and against all costs and damages which it may suffer by reason of Owner's failure to do
so, and shall reimburse and repay the County all outlay and expense which the County may incur in making
good any default, then this obligation shall be void, otherwise to remain in full force and effect.
PROVIDED, FURTHER, that the said Surety, for value received hereby, stipulates and agrees that no
change, extension of time, alteration, addition or deletion to the proposed specific improvements shall In
any way affect its obligation on this Bond, and it does hereby waive notice of any such change, extension
of time, alteration, addition or deletion to the proposed specific improvements.
PROVIDED FURTHER, that it is expressly agreed that the Bond shall be deemed amended
automatically and immediately, without formal and separate amendments hereto, so as to bind the Owner
and the Surety to the full and faithful performance in accordance with the Land Development Regulations.
The term "Amendment," wherever used in this Bond, and whether referring to this Bond, or other documents
shall include any alteration, addition or modification of any character whatsoever.
