Agenda 10/14/2025 Item #16A12 (Resolution - Considering vacating a protion of Oil Well Park Road)10/14/2025 Item # 16.A.12 ID# 2025-2854 Executive Summary Recommendation to adopt a Resolution to hold a public hearing to consider vacating a portion of Oil Well Park Road, also known as a portion of a 100-foot-wide right-of-way and easement described as Tract A, as recorded in Deed Book 23, Page 42, of the Public Records of Collier County, Florida, located west of State Road 29, approximately 1.5 miles south of Oil Well Road, in Section 20, Township 48 South, Range 30 East, Collier County, Florida. VAC- PL20250006144 OBJECTIVE: Pursuant to Sections 336.09 and 336.10, Florida Statutes, and Resolution No. 2021-243, the Board of County Commissioners may authorize a public hearing to consider the vacation of a portion of any type of public road right-of-way. CONSIDERATIONS: The Development Review Division has received a request to vacate a portion of Oil Well Park Road, also known as a portion of a 100-foot-wide right-of-way and easement described as Tract A, as recorded in Deed Book 23, Page 42, of the Public Records of Collier County, Florida, located west of State Road 29, approximately 1.5 miles south of Oil Well Road, in Section 20, Township 48 South, Range 30 East, Immokalee, Collier County, Florida. In 1952, several members of the Collier family granted a right-of-way an easement to Collier County for a public road. This was a dirt/rock road that ran from SR 29, where the current Collier County Oil Well Park is located (7671 SR 29, Immokalee), to CR 846/Immokalee Road. At the time, it was known as Oil Well Grade. In the early 1970s, Collier County paved Oil Well Grade and straightened it at the eastern end to align with CR 858 (also known as Mound Crossing Road at the time). The entire road then became known as CR 858 Oil Well Road, and the portion near Oil Well Park was no longer needed. Collier County vacated the majority of the rights-of-way/easements back to the Collier Family in 1972 (OR Book 461, Page 932), which portion ended at the east line of Section 19. However, the portion of the easement from the east line of Section 19 at approximately 7695 Oil Well Park Road to SR 29 was not vacated. The portion of Oil Well Park Road from the northwest corner of Oil Well Park to SR 29 will not be vacated, as shown in Exhibit “A.” While the applicant understands that Collier County does not routinely grant right of way easement vacations, they have provided a benefit to Collier County in other ways. One of the applicants, Sunniland Family Limited Partnership (SFLP), donated a Boat Ramp, Access, and Maintenance Easement to the County in January 2021, recorded in Official Record Book 5978, page 3665. SFLP is an adjacent property owner and is affiliated with JB Ranch I, LLP, one of the applicants, and Aliese P. Priddy is the managing member for both. This donated easement was done at no cost to the County in response to an important drainage issue along the Barron Canal (a/k/a SR 29 Canal). Due to the lack of need for the easement, it has been terminated (See attached Termination of Easement). This right-of-way vacation request is not being made for a development project; rather, SFLP is concerned with trespassing, which has occurred on a regular basis and is facilitated by the public road leading to their private property. This vacation request is directly adjacent to their residence. CSC Farm, LLC will provide a 1” asphalt overlay from SR 29 to the County Park, for a distance of 250’ and a width of 18’ (See Public Benefit Exhibit) when the internal roads of the Collier Rod & Gun Club project are constructed. Collier County will no longer be responsible for maintaining the right-of-way or hold liability for the remaining portion of the roadway. The property owners who utilize the right-of-way to access their private property will assume responsibility for repair and maintenance beyond the termination of the public right-of-way. Oil Well Park Road will remain a public right-of-way, fronting only the County property (Oil Well Park). The vacation request also enhances security for the property owners involved. The Development Review Division has reviewed this petition and found no reason for objection. The hearing will be advertised in a local paper of general circulation pursuant to Section 336.10, Florida Statutes, and Resolution No. 2021-243, and the adjoining property owners will be given notice as well. FISCAL IMPACT: The Growth Management Community Development Department's Development Review staff has collected a $2,000 “Petition to Vacate” fee from the petitioner, which covers the County’s cost of recording and processing the Petition. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this Executive Summary.
