A RESOLUTION AU?HORIZING THE ACQUISITION OF LANDS
BY GIFT, PURCHASE OR CONDEMNATION, NEC~:SSARY FOR THE
FOUR-LANING OF STATE ROAD 951 FROM U.S. 41 TO
THE MARCO RIVER BRIDGE.
WHEREAS, pursuant to authorization that the Secretary of the
Florida Department of Transportation has had a part of State Road
951 in Collier County, Florida, located and surveyed: and
WHEREAS, on January 15, 1985 the Board of County
Commissioners entered into an Agreement with the State of Florida
Department of Transportation wherein the County agreed to assume
the obligation to acquire the entire right-of-way for the
widening of State Road 951 from U.S. 41 to th~ Marco Island
Bridge: and
WHEREAS, the State of Florida Department of Transportation
has requested that the County have the entire right-of-way for
this project obtained by December, 1988.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that it is the judgment
of said Board that the construction of said roadway is necessary
and in the best interests of Collier County.
AND, FURTHER, IT IS THEREFORE RESOLVED BY THE BOARD OF
COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County
staff is authorized to acquire by gift, purchase, or condemnation
in accordance with the provisions of Chapters 73, 74, and 127,
Florida Statutes, fee simple title in the lands designated as
Parcel 141 and more particularly described in the attached
Exhibit itA", attached hereto and incorporated herein, to be used
for the construction and maintenance of road and drainage
facilities, roadbeds, drainage ditches and borrow pits for such
roadway improvements for said four-laning of State Road 951 from
U.S. 41 to the Marco Island Bridge.
