RESOLUTION 89~
RELATING TO PETITION NO. PU-87-22C FOR
EXTENSION OF PROVISIONAL USE OF
PROPERTY HEREINAFTER DESCRIBED IN
COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature of the state of Florida in Chapter
125 Florida Statutes, has conferred on all Counties in Florida
the power to establish, coordinate, and enforce ~oning and such
business regulations as are necessary for the pre.tection of the
public; and
WHEREAS, the County pursuant thereto has adopted a
Comprehensive zoning Ordinance establishing regulations for the
zoning of particular divisions of the County, a~ong which is the
granting and extending the time period of provisional Uses; and
WHEREAS, on January 26, 1988, the Board of zoning Appeals
enacted Resolution 88-31, which granted a provisional use,
"
pursuant to Ordinance 82-2, to Thomas E. Kuck, representing
Highway Pavers, Inc., to allow a portable asphaltic concrete
batch plant, on the below described property; and
WHEREAS, Section 13.1(e), Ordinance No. 82-2, provides that
the Board of zoning Appeals may grant an extension of the one
(1) year time period for a provisional use which has not been
commenced;
NOW, THEREFORE BE IT RESOLVED by the Board of zoning
Appeals of Collier County, Florida, that the written request qf
Thomas E. Kuck of Highway Pavers, Inc., in interest of the
following described property:

Exhibit "A"
is hereby approved pursuant to section 13.1(e), Ordinance No.
82-2, and the expiration date for the provisional use "0" of
the A-2 District is hereby extended for one year until January
19, 1990.
BE IT FURTHER RESOLVED that this Resolution be recorded in
the minutes of the Board and in the records of the Petition for
which the
extension ~anted. .
