Executive Summary
Recommendation to adopt an Ordinance repealing and replacing Ordinance No. 2004-06 to restructure the Domestic
Animal Services Advisory Committee, provide for the creation, purpose, powers and duties, provide for appointment and
composition, terms of office, attendance and removal from office, provide for officers, quorum, and rules of procedure.
OBJECTIVE: To better define the powers and duties of the Domestic Animal Services Advisory Committee and
broaden the Advisory Committee’s purpose.
CONSIDERATIONS: On January 27, 2004, the Board of County Commissioners of Collier County, Florida (“Board”)
adopted Ordinance No. 2004-06 establishing the Animal Services Advisory Committee ("Advisory Committee”) at the
recommendation of the National Animal Control Association in order to generate community involvement in animal
services and related activities. The Board wishes to repeal Ordinance No. 2004-06 and replace it with an Ordinance to
reestablish the Advisory Committee to provide independent review, guidance, and recommendations regarding the
operations of Domestic Animal Services including internal operations proficiency, fiscal management, department
branding, volunteer program development and community outreach.
The proposed Ordinance provides for the creation, purpose, powers and duties of the Advisory Committee, provides for
the appointment and composition of Advisory Committee members, including the terms of office, attendance
requirements and removal from office, and provides for the election of officers, quorum policies, and rules of procedure.
FISCAL IMPACT: There is no fiscal impact associated with this action.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote of the

OFFICE, ATTENDANCE AND REMOVAL FROM OFFICE;
PROVIDING FOR OFFICERS, QUORUM, RULES OF
PROCEDURE; PROVIDING FOR THE REPEAL OF
ORDINANCE NO. 2004-06; PROVIDING FOR CONFLICT
AND SEVERABILITY; PROVIDING FOR INCLUSION IN

BE IT ENACTED BY THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA:
WHEREAS, on January 27, 2004, the Board of County Commissioners of Collier County
(“Board”) adopted Ordinance No. 2004-06, the Collier County Animal Services Advisory Board
Ordinance; and
WHEREAS, the Board wishes to repeal and replace the Ordinance in order to better define
the powers and duties of the Advisory Committee and broaden its purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY FLORIDA, THAT:
SECTION ONE: CREATION AND PURPOSE
The Board of County Commissioners hereby reestablishes the Domestic Animal Services
Advisory Committee (“Committee”) to provide independent review, guidance and
recommendations regarding the operations of Domestic Animal Services, including: internal
operations proficiency, fiscal management, department branding, volunteer program development
and community outreach.

SECTION TWO: FUNCTIONS, POWERS AND DUTIES
The Committee will act in an advisory capacity only and all recommendations will be
submitted to the County Manager or designee for approval before action.
1. Operational Review
a. Evaluate procedures for intake, fostering, adoption and return-to-owner for
efficiency and effectiveness, ensuring consistency with Florida Statutes including
but not limited to Section 823.15 and 823.151.
b. Review staffing, workflow and training programs.
c. Review operations to ensure best practices in shelter management, cleaning
standards, safety, customer service and administrative functions.
2. Fiscal Oversight
a. Review the proposed annual Domestic Animal Services budget and provide
advisory recommendations on priorities, allocation, and efficiency.
b. Assess fee schedules, donations, and grants for transparency, sustainability, and
effectiveness.
c. Monitor fiscal accountability to ensure efficient and effective use of resources.
3. Veterinary and Medical Considerations
a. Recognize that all medical decisions rest exclusively with a licensed veterinarian
employed or contracted by Domestic Animal Services.
b. Provide input only on non-clinical aspects of veterinary operations, including
budget and resource adequacy.
c. The Domestic Animal Services Advisory Committee shall not interfere with, or
substitute for, veterinary clinical decisions.
4. Volunteer and Behavior Programs
a. Support the development of volunteer programs that expand Domestic Animal
Services service capacity.
b. Encourage partnerships with animal behaviorists, rehabilitation specialists, trainers,
and enrichment organizations.
c. Recommend strategies to recruit, train, and retain volunteers.
d. Promote initiatives to expedite compliance with Section 823.151(2)(a)5, Florida
Statutes, regarding the direct return of animals to identified owners, and Section

823.151(2)(a), Florida Statutes, regarding the rehoming of animals that become
property of the County.
5. Community Outreach and Branding
a. Encourage Domestic Animal Services’ participation in community events and
adoption fairs.
b. Provide guidance on branding, marketing materials, and messaging.
c. Strengthen partnerships with community organizations and businesses.
d. Advise on communication strategies to promote transparency and responsible pet
ownership.
6. Accountability and Reporting
a. Review quarterly and annual reports on operations, staffing, expenditures, and
outcomes.
b. Working with the County Manager, or designee, submit an Annual Report to the
Board of County Commissioners summarizing findings, activities, and
recommendations.
c. Provide interim reports upon request of the Board of County Commissioners or
County Manager.
SECTION THREE: APPOINTMENT AND COMPOSITION
The Committee shall be composed of five members with experience including, but not
limited to, the following:
1. One Finance/Accounting or Business Professional
2. One Animal Welfare or Rescue Organization Representative
3. One Community Outreach Representative
4. One Volunteer Program or Nonprofit Management Representative
5. One Citizen At-Large
Excepting the Patty Baker Humane Society, Naples, individuals from rescue groups and
other animal agencies are not eligible for membership on the Board.
Members shall be appointed and serve at the pleasure of the Board of County
Commissioners. Said members will be permanent residents and electors of Collier County.

SECTION FOUR: TERMS OF OFFICE
The initial terms of office of the Committee members shall be as follows:
1. Three members will serve a term of four years.
2. Two members will serve a term of three years.
Thereafter, each appointment shall be for a term of four years. All appointments shall be
in accordance with Collier County General Advisory Board’s Ordinance No. 2001-55, as it may
be amended or by its successor Ordinance. Existing terms will be kept.
SECTION FIVE: ATTENDANCE REQUIREMENTS; REMOVAL FROM OFFICE
Any member of the Committee may be removed from office, with or without cause, by a
majority vote of the Board of County Commissioners.
Committee member attendance requirements, including failure to attend meetings and
removal from office are governed by Collier County Ordinance No. 2001-55, as it may be amended
or by its successor ordinance.
SECTION SIX: OFFICERS; QUORUM; RULES OF PROCEDURE
1. Annually, the membership of the Committee shall elect a chairman, vice chairman and
secretary from among the members. Officers’ terms shall be one year with eligibility for
reelection.
2. The presence of three or more members shall constitute a quorum of the Committee
necessary to take action and transact business. In addition, an affirmative vote of three or
more shall be necessary in order to take official action.
3. The Committee shall, by a majority vote of the entire membership, adopt rules of procedure
for the transaction of business and shall keep a written record of meetings, resolutions,
findings and determinations.
4. The conduct of all meetings of the Committee shall be in accordance with the Government
in the Sunshine Manual and Roberts Rules of Order.
SECTION SEVEN: REIMBURSEMENT OF EXPENSES
Members of the Committee shall serve without compensation but shall be entitled to receive
reimbursement for expenses reasonably incurred in the performance of duties upon prior approval
of the Board of County Commissioners.

SECTION EIGHT: REPEAL OF ORDINANCE NO. 2004-06
Ordinance No. 2004-06 is hereby repealed in its entirety.
SECTION NINE: CONFLICT AND SEVERABILITY.
In the event this Ordinance conflicts with any other ordinance of Collier County or other
applicable law, the more restrictive shall apply. If any phrase or portion of the Ordinance is held
invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct and independent provision and such holding shall not affect the validity of the
remaining portion.
SECTION TEN: INCLUSION IN THE CODE OF LAWS AND ORDINANCES.
The provisions of this Ordinance shall become and be made a part of the Code of Laws and
Ordinances of Collier County, Florida. The sections of the Ordinances may be renumbered or
relettered to accomplish such, and the word "ordinance" may be changed to "section," "article," or
any other appropriate word.
SECTION ELEVEN: EFFECTIVE DATE.
This Ordinance shall be effective upon filing with the Department of State.

Board shall be submitted to the appropriate County staff a minimum of 7 days prior to the public hearing. All materials
