Executive Summary
Recommendation to approve the Third Amendment to the Lease Agreement with Alpert Tower, LLC for the installation
of an additional microwave dish added to the communications tower at 1515 Benton Road, Naples, FL 34117, resulting
in a monthly rent increase of $382.50.
OBJECTIVE: To approve a Third Amendment (“Amendment”) to the Lease Agreement (“Lease”) with Alpert Tower,
LLC, for the installation of an additional microwave dish added to the communications tower at 1515 Benton Road,
Naples, FL 34117, resulting in a monthly rent increase of $382.50.
CONSIDERATIONS: On August 22, 1995, the Board of Collier County Commissioners (“Board”), as the tenant,
approved a Lease Agreement with Alpert Tower, LLC, f/k/a Alpine Broadcasting Corporation, a Florida corporation.
The First Amendment was executed on April 11, 2003, and the Second Amendment was approved on December 8,
2020,Item 16.C.13.
Improvements to the County’s public safety radio system located on the tower require additional equipment, including
one 6-foot microwave dish to improve the resiliency of the P25 system’s backhaul network. This addition results in a
monthly rent increase of $382.50 (from $14,789.63 to $15,172.13 per month), effective October 1, 2025, for an annual
rent of $182,065.56. The Telecommunications Manager has reviewed the amendment to confirm all equipment is
correctly documented.
Key Terms (from the lease, as amended, unchanged except for rent):
• Term - Lease runs through December 7, 2028, with one option to renew for five years.
• Termination - County may terminate with 60 days’ written notice, with or without cause.
• Utilities - County will continue to be responsible for all applicable utilities.
• Rent (As Amended by Third Amendment): $182,065.56 annually, with a 4% annual escalator throughout the
remaining life of the lease.
This item is consistent with the Collier County strategic plan objective to maintain a fully responsive, best-in-class

FISCAL IMPACT: The monthly rent of $15,172.13 will be paid from the 800MHz Inter-Governmental

GROWTH MANAGEMENT IMPACT: The item is consistent with the Growth Management Plan.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority vote for Board

Company, successor to Alpine Broadcasting Corporation, whose mailing address is 353
Chancery Cir., Naples, Florida 341 10-4404, hereinafter referred to as "LESSOR', and Collier
County, a political subdivision ofthe State ofFlorida, whose mailing address is, in care ofReal
Property Management, 2685 Horseshoe Drive S., Naples, Florida 34104, hereinafter referred
to as "LESSEE";
WI'I'NESSETH
WHEREAS, LESSOR and LESSEE have previously entered into a Lease Agreement
dated August 22, 1995, amended by the First Amendment on April 1 1, 2003, and amended by
the Second Amendment on December 8, 2020, attached hereto as Exhibit A (the "Lease
Agreement"): and
WHEREAS, the LESSOR and LESSOR are desirous of amending the Lease
Agreement to add a fourth additional microwave dish.
NOW, THEREFORE, for and in consideration of the mutual covenants and agreements
contained lrerein, and other good and valuable consideration, the receipt and sufirciency of
which are hereby acknowledge, the Parties agree as follows:
i. The Landlord hereby grants the Tenant permission to install a fourth microwave dish on
the existing tower at an approximately height of I 70 ft.
2. As ofOctober 1,2025, the annual base rent shall increase by $382.50 per month and shall
be automatically increased by four percent annually throughout the life of the lease.
3. Except as expressly provided herein, the Lease Agreement remains in full force and effect
according to the terms and conditions contained therein and said terms and conditions are
applicable hereto except as expressly provided otherwise herein.
