Agenda 09/23/2025 Item #16B 7 (Approve a Joinder and Consent to Utility Easement authorizing Rural Neighborhoods, Inc., to convey an Underground Utility Easement to Florida Power & Light Co)9/23/2025 Item # 16.B.7 ID# 2025-3480 Executive Summary Recommendation to approve a Joinder and Consent to Utility Easement authorizing Rural Neighborhoods, Inc., to convey an Underground Utility Easement to Florida Power & Light Co., to provide electrical services for construction of Renaissance Hall at Old Course, LLC, located at 4150 Golden Gate Parkway; and to authorize the County Manager or designee(s) to execute future necessary utility easements for both phases of this affordable housing construction project. OBJECTIVE: To obtain approval for the conveyance of an Underground Utility Easement to Florida Power & Light Company, a Florida Profit Corporation (hereinafter referred to as “FPL”), and execute the accompanying Joinder and Consent to Utility Easement. CONSIDERATIONS: Collier County has entered into a Collier County Standard Form Long-Term Ground Lease (“Lease”) for an affordable housing project (“Project”) at the former Golden Gate Golf Course, which authorizes the developer to grant easements needed to serve the Project, provided that the County, as the fee simple owner, joins in and consents to such easements. In accordance with the Lease, a Site Development Plan for Renaissance Hall at Old Course was approved on March 22, 2024, and the Project is now in Phase I of construction. To provide electrical service, FPL requires a recorded utility easement on the property. The Easement is for underground electric utility facilities (including cables, conduits, appurtenant equipment, and appurtenant above-ground equipment to be installed from time to time, with the right to reconstruct, improve, add to, enlarge, change the voltage as well as the size of, and remove such facilities or any of them within the easement areas, to service the electrical demands of the buildings. Since the County is the fee owner of the property, a Joinder and Consent to the recording of the utility easement is required by FPL. The accompanying Joinder and Consent to Utility Easement will be recorded concurrently with the FPL Easement. As the Project moves forward, additional easements may be necessary to provide essential services and utilities to the Project. Accordingly, this item also requests authority for the County Manager or designee to execute future Joinder and Consents to Utility Easement in lieu of bringing each before the Board. The Easement encompasses approximately 25,567 square feet, as shown and described on Exhibit “A” and Exhibit “B” of the Easement, with access to the existing right-of-way. This Easement has been reviewed and approved by FPL and Rural Neighborhoods, Inc., and is ready to be executed and recorded as required. To plan and build public infrastructure and facilities to effectively, efficiently, and sustainably meet the needs of our community. FISCAL IMPACT: Recording costs shall not exceed $61. GROWTH MANAGEMENT IMPACT: There is no impact to the Collier County Growth Management Plan.
