WHEREAS, Collier County (the "County") is authorized by Chapter 73 and 74, Florida Statutes to condemn necessary lands and property for public purposes or uses; and WHEREAS, the fee simple interests in land hereinafter described in Exhibit "A", attached hereto and incorporated herein (the "Property") are needed for the construction of stormwater ponds required for the expansion of Wilson Boulevard from two lanes to four lanes between Golden Gate Boulevard and Immokalee Road(Project No. 60229) (hereinafter referred to as "the Project"); and WHEREAS, acquisition of the Property and construction of the Project addresses long- range planning and safety needs and is included in the Capital Improvement Element of the Collier County Growth Management Plan, as approved by the Florida Department of Economic Opportunity; and WHEREAS, construction of the Project will require the acquisition of the Property; and WHEREAS, the location for the construction of the proposed ponds has been fixed by survey and is collectively represented by the legal descriptions comprising Exhibit "A"; and WHEREAS, after consideration of the availability of alternate routes and locations, the comparative costs of the stormwater pond site alternatives, various impacts upon the environment, long range planning options, and public safety considerations,the Board desires to exercise its right to condemn property for public use or purpose and the Property to be condemned is necessary for that use. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: 1. The above recitals are incorporated herein and made a part hereof by this reference. 2. The Board declares that it is necessary to acquire by eminent domain, fee simple CAv 1 iB 4 title to the land described in Exhibit "A" ("the Property") for the public purpose of construction of the proposed ponds as part of the Project to protect the health, safety, and welfare of the citizens of Collier County. 3. The Board has considered alternative locations for the proposed ponds, various impacts to the environment, public health, safety and welfare considerations associated with the design and construction of the Project, long range planning, and the costs associated with the property rights acquisition and construction of the Project; and the Board finds that after consideration of these issues, the most feasible location for construction of the proposed ponds is collectively represented by the legal descriptions comprising Exhibit "A." 4. The County Manager or her designee and the Office of the County Attorney are hereby authorized and directed to immediately acquire by gift, purchase, or condemnation, in accordance with the provisions of Chapters 73, 74 and 127, Florida Statutes, the Property more particularly described in Exhibit "A", attached hereto and incorporated herein.
