Executive Summary
Recommendation to approve and authorize the Chairman to sign an Immokalee Impact Fee Installment Payment Plan
Agreement with Immokalee Fair Housing Alliance Inc., to allow a $195,160.96 impact fee to be paid over 30 years with
5% interest as a special assessment for an affordable 16-unit Multi-Family Rental Housing Project.
OBJECTIVE: To administer the Immokalee Impact Fee Installment Payment Program.
CONSIDERATIONS: On July 11, 2017, the Board of County Commissioners (“Board”) adopted Ordinance No. 2017-
34, which established the Program for the Immokalee Community Redevelopment Area (CRA). The Program provides
an alternative to paying impact fees in full as a prerequisite to the issuance of a Certificate of Occupancy, a feepayer
may pay their impact fees in installments rather than a lump sum by entering into an impact fee installment payment
program agreement with Collier County which provides that the installment payments shall be by special assessment
levied as non-ad valorem assessments against the subject property.
On July 25, 2023, Agenda Item 10.A, the Board approved to extend the Program through September 2028, and to
continue the program with a term of payments over 30 years, capping the Program interest rate at 5% in order to be
consistent with the interest rate utilized for the Countywide Impact Fee Deferral Program, and continue the waiver of
any application fees for any new residential and commercial development.
On May 22, 2025, Immokalee Fair Housing Alliance Inc. applied for the Immokalee Impact Fee Installment Payment
Plan for a 16-unit multi-family rental housing unit project located on 2081 Corazon De La Comunidad Circle,
Immokalee, FL, 34142, to allow for a total of $195,160.96 in deferred impact fees with a 5% interest rate to be paid
through a special assessment levied as non-ad valorem assessments against the subject property over a 30-year term.
County Staff, in consultation with County Attorney’s Office, determined that the applicant is within the parameters of
the program in accordance with Section 74-201(h)(2)of the Collier County Laws and Ordinances and the Board’s July
25, 2023 direction. The attached proposed Immokalee Impact Fee Installment Payment Plan Agreement with Immokalee
Fair Housing Alliance Inc. effectuates the application and Program.
FISCAL IMPACT: This agreement includes the repayment of a total of $195,160.96 in deferred impact fees, carrying a
5% interest rate, to be paid through a special assessment levied as non-ad valorem assessments against the subject
property over a 30-year term. Annual payments will be deposited proportionally within the appropriate impact fee funds.
GROWTH MANAGEMENT IMPACT: Objective 2 of the Capital Improvement Element (CIE) of the Collier County
Growth Management Plan (GMP) states: “Future development will bear a proportionate cost of facility improvements
necessitated by growth” which is accomplished, in part by the payment of impact fees. The program provides for the
payment of impact fees in installments.
Additionally, Policy 1.9 of the Economic Element of the GMP provides: “Collier County, in response to the current and
projected needs of its residents, will encourage a diverse mix of housing types, sizes, prices, and rents” and Objective 3
of the Economic Element states: “Collier County will support programs which are designed to promote and encourage
the recruitment of new industry as well as the expansion and retention of existing industries in order to diversify the
County's economic base.”
The program is continuing to be analyzed regarding allowing the payment of impact fees by an installment program, as a
voluntary alternative to paying the fees in a single, up-front payment, will have a positive effect on both the costs of
housing and economic growth, and is consistent with the goals and objectives of the Economic Element of the GMP as
listed above.
