Executive Summary
Recommendation to approve a Resolution providing for the formal acceptance of all real property conveyances by
dedication of easement to Collier County, on all administratively approved plats recorded with the Clerk of Courts in
accordance with Section 177.071 F.S.
OBJECTIVE: To have the Board of County Commissioners (Board) approve a resolution providing for the formal
acceptance of all real property conveyances by dedication of easement to Collier County or to the Collier County Water-
Sewer District, on all administratively approved plats recorded with the Clerk of Courts in accordance with Section
177.071 F.S.
CONSIDERATIONS: During the 2025 Legislative session, SB 784 was passed, which revised Section 177.071,
Florida Statutes, to require administrative approval, approval with conditions, or denial of a proposed plat or replat.
On July 8, 2025, the Board adopted Resolution No. 2025-131, designating the Development Review Division within the
Growth Management Community Development Department as the Administrative Authority to review and process plat
or replat submittals, and delegating authority to the following positions to sign the plat/replat and the Construction and
Maintenance Agreement on behalf of the Board: County Manager, Deputy County Manager, Growth Management
Community Development Department Head, Development Review Division Director and/or the Zoning Division
Director.
Dedications to Collier County or the Collier County Water-Sewer District on subdivision plats are offers to convey until
such time as the Board accepts the Dedications. Since staff is administratively approving plats, a resolution of the
Board accepting the Dedications to Collier County or the Collier County Water-Sewer District is needed to complete the
real estate conveyance.
FISCAL IMPACT: There is no fiscal impact to the County associated with this action; all costs for recordation of plats
are borne by the applicant.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for
Board approval.-HFAC

A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA
PROVIDING FOR THE ACCEPTANCE OF ALL REAL
PROPERTY CONVEYANCES BY DEDICATION OF
EASEMENT TO COLLIER COUNTY OR TO THE
COLLIER COUNTY WATER-SEWER DISTRICT ON
ALL PLATS RECORDED WITH THE CLERK OF
COURTS AFTER ADMINISTRATIVE APPROVAL OF A
PLAT BY THE ADMINISTRATIVE OFFICIAL IN
ACCORDANCE WITH FLORIDA STATUTES SECTION
177.01(1)(a).
WHEREAS, the Development Review Division within the Growth Management
Community Development Department as the County Manager’s designee under Land
Development Code (LDC) Section 10.02.04.B.3 is currently responsible for the review of the
subdivision plat and replat process, including, but not limited to, engineering review, planning
review, environmental review, and the County Surveyor review; and
WHEREAS, during the 2025 Legislative session, Senate Bill 784 was approved, which
revised Florida Statutes Section 177.071(1)(a) to require administrative approval, approval with
conditions, or denial of a proposed plat or replat; and
WHEREAS, by Resolution No. 2025-131, the Board of County Commissioners (Board)
designated the County Manager, Deputy County Manager, Community Development Department
Head, Development Review Director and/or Zoning Division Director as Administrative Officials
authorized to administratively approve a plat or replat pursuant to Florida Statutes Section
177.071(1)(a); and
WHEREAS, the Board desires to provide for formal acceptance of easement conveyances
on each and every administratively approved plat to be effective upon recording of the plat with
the Collier County Clerk of Courts.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. The Board hereby accepts all real property conveyances by dedication of easement to
Collier County or to the Collier County Water-Sewer District on each and every plat
recorded with the Collier County Clerk of Courts after administrative approval of a plat
by the Administrative Official in accordance with Florida Statutes Section
177.071(1)(a).
2. Final acceptance of subdivision required improvements will continue to be by resolution
of the Board pursuant to LDC Section 10.02.05.C.
