CENA20240007156 and CEV20240007158, entitled Board of County Commissioners, Collier County, Florida, vs. Sergey Yurevich Terekhov. OBJECTIVE: To obtain Board authorization for the Office of the County Attorney to initiate foreclosure proceedings pursuant to Section 162.09, Florida Statutes, in relation to $60,746.90 in accruing code enforcement liens against all real and personal property owned by Sergey Yurevich Terekhov, for ongoing violations at 3580 2nd Ave. NE, Naples, Florida. CONSIDERATIONS: The property is located at 3580 2nd Ave. NE, Naples, FL 34117, Folio No. 40686720007, in Collier County, is owned by Sergey Yurevich Terekhov, pursuant to the Collier County Property Appraiser. Case No. CENA20240007156: On January 10, 2025, after a public hearing, the Code Enforcement Special Magistrate (OSM) entered an order finding the property owner in violation of Collier County’s ordinances. The violations consisted of litter and prohibited outdoor storage, including but not limited to the following: furniture, auto parts, glass, metal, plastic, wood, tires, barrels, outboard motors, and pallets, on an improved Estates zoned property. The order imposed a $12,823.45 lien on all real and personal property owned by the property owner, and which provided for continuing accrual of fines until abatement. The lien order was recorded on February 4, 2025, at O.R. Book 6435, Page 3241, of the Official Public Records of Collier County. Fines continued to accrue; therefore, the lien amount of $40,200.00 is based on 201 days of accrued fines ($200 per day from November 9, 2024, through May 28, 2025), plus operational costs of $223.50, totaling $40,423.50. Case No. CEV20240007158: On January 10, 2025, after a public hearing, the Code Enforcement Special Magistrate (OSM) entered an order finding the property owner in violation of Collier County’s ordinances. The violations consisted of multiple unlicensed/inoperable vehicles on site, including but not limited to the following: a large beige RV next to the primary structure, an approximately 20-foot boat, small utility trailers, and a blue tow located behind an RV on an improved Estates zoned property. The order imposed a $6,523.45 lien on all real and personal property owned by the property owner, and which provided for continuing accrual of fines until abatement. The lien order was recorded on February 4, 2025, at O.R. Book 6435, Page 3244, of the Official Public Records of Collier County. Fines continued to accrue; therefore, the lien amount of $20,100.00 is based on 201 days of accrued fines ($100 per day from November 9, 2024, through May 28, 2025), plus operational costs of $223.50, totaling $20,323.45. FISCAL IMPACT: The fiscal impact of initiating a foreclosure suit is approximately $410.00 (representing a $400.00 filing fee plus the cost of service). Costs for maintaining the lawsuit (including, as necessary, any title review, copies, mailings, service, transcripts, and other routine litigation costs) should not exceed $6,000. The County should ultimately recover all costs in initiating and pursuing this lawsuit. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive Summary. LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and legality. This item requires a majority vote for approval.
