Executive Summary
Recommendation to approve the release of two code enforcement liens with an accrued value of $118,400, for a reduced
payment of $17,424, in the code enforcement action titled Board of County Commissioners vs. United Props, LLC., in
Code Enforcement Board Case Nos. CENA20220004559 and CESD20220005465, relating to the property located
at 5780 Dogwood Way, Collier County, Florida.
OBJECTIVE: For the Board of County Commissioners to accept an offer to release two code enforcement liens with an
accrued value of $118,400 for a reduced payment of $17,424 in Code Enforcement Board (CEB) Case Nos.
CENA20220004559 and CESD20220005465.
CONSIDERATIONS: In Case No. CENA20220004559, the CEB ordered the imposition of a lien against United
Props, LLC., for a code violation at 5780 Dogwood Way. The violation consisted of construction debris on the property,
including siding, plastic sheeting/scrap, wood pallets, and wood scraps. The lien was recorded in the Official Records on
June 14, 2023, at O.R. Book 6258, Pages 1647-1648, in the amount of $15,368.56. Fines continued to accrue for 156
days ($250 per day from March 26, 2023, through August 28, 2023), totaling $39,000. The owner brought the property
into compliance on August 28, 2023.
In Case No. CESD20220005465, the CEB ordered the imposition of a lien against United Props, LLC., for a violation
consisting of unpermitted removal of vinyl siding and kitchen renovation. The lien was recorded in the Official Records
on February 12, 2024, at O.R. Book 6329, Pages 1085-1087 in the amount of $66,918.56. Fines continued to accrue for
397 days ($200 per day from February 26, 2023, through March 28, 2024), totaling $79,400. The owners brought the
property into compliance on March 28, 2024.
Pursuant to Resolution No. 2023-90, a request for a reduction of fines may be considered when payment of the lien
would impose severe financial hardship on the owner. The property is being actively maintained, and United Props,
LLC., offers to pay $8,228.72 to release the liens; however, Code Enforcement recommends accepting payment of
$17,424.
The recommended payment of $17,424 is ten percent of the Collier County Property Appraiser’s Assessed Value of
$174,424 and meets the criteria outlined in Resolution 2023-90. There are currently no known violations on the
property.
This item is consistent with the Collier County strategic plan objective to preserve and enhance the character of our
community.
FISCAL IMPACT: Acceptance of a payment of $17,424 to settle the lien will correlate to what is outlined in Collier
County Resolution 2023-90.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and
legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution
2023-90. RTT
RECOMMENDATIONS: To approve a reduction of fines in the amount of $100,976, accept payment in the amount of
$17,424, release the liens, and authorize the Chairman to sign the attached releases and satisfaction of liens for recording
in the Official Public Records.

Property: 5780 Dogwood Way, Naples, Florida 334116 (“Property”)
My name is David Efrat and I am the owner and managing member of United Props LLC, the
owner of the Property. I submit this continuation of the application for lien reduction as to the
above-referenced Code Case Numbers.
On or about March 15, 2022, an agreement with a contractor, B&B Investment Development LLC,
with Manuel E. Blanco as its principal and a License number of CGC1513249 (“Contractor”) was
entered into for certain work and construction services to be performed to the Property
(“Agreement”). A copy of said Agreement is attached and incorporated hereto as Exhibit “A.”
According to the Agreement, the anticipated time required to complete the work under the
Agreement was 180 days from when the permit was issued—to which Contractor was obligated
to obtain under the Agreement per Article II. Likewise, the Agreement required Contractor to
“comply with all lawful requirements applicable to the work.” Id. Further, the Agreement required
the Contractor to maintain the Property in a clean condition and to promptly remove all debris,
material, equipment, etc. from the Property per Article IV of the Agreement.
Notwithstanding the foregoing, at all material times hereto the Contractor failed to comply with
the terms of the Agreement and applicable laws, failed to obtain all necessary permits prior to
performing the work under the Agreement, and to maintain the Property in a clean condition. To
date, the Contractor has failed to complete the project under the Agreement and all Contractor did
was knock down the shell of the structure on the Property in an unworkmanlike manner, despite
being paid $80,000.00, which far exceeds the value of the work performed. Further, Contractor
left the Property in disarray and with debris on the Property, which resulted in code violations
being assessed to the Property. Eventually, the Contractor failed to return any communications and
ignored the responsibilities under the Agreement and as a Contractor.
During this time, I, Daivd Efrat, was residing outside the country in Israel, while the war was going
on and continues. As a result, I was relying upon the Contractor to perform the services under the
Agreement per its terms and per the applicable laws. Unfortunately, the Contractor failed to comply
with the terms of the Agreement and his obligations under applicable laws as a licensed contractor
in Florida, and the Contractor improperly left the Property in a mess for me to handle.
My ability to travel to the United States in 2022 and 2023 was severely limited, due to the ongoing
war in Israel, if permitted at all. I did not personally receive notice of the code violations prior to
the fines being assessed. If I had known about the code violations, then I would have done
everything in my power to address them promptly.

In addition to what I paid to the Contractor under the Agreement as stated above, I incurred
additional expenses to bring the Property into compliance and to address the permitting issues,
which would not have been needed if the Contractor performed under the Agreement in accordance
with its terms.
As a result, I am faced with a substantial financial hardship due to the overpayment to the
Contractor for incomplete work under the Agreement that was done in a manner that caused liens
to be assessed upon the Property, I had to incur additional expenses to remediate the Contractor’s
errors and omissions, and I have to complete the construction project with another contractor.
Based on the foregoing, I respectfully request a reduction of the liens on the Property to be granted.
