(Companion Items 11C and 11D) OBJECTIVE: To have the Board of County Commissioners review and consider the release of three (3) code enforcement liens with an accrued value of $789,650 for a reduced payment of $56,064.80, or direct staff to proceed with the foreclosure sale scheduled for September 18, 2025, to close Code Enforcement Board (CEB) Cases CEPM20170013023, CEPM20220004129, and CENA20230003919. CONSIDERATIONS: The Code Enforcement Board (CEB) ordered the imposition of liens against S & O, LLC., for multiple code violations at their property located at 1790 40th Ter SW, Folio 35832160002. • Code Case CEPM20170013023 - violations consisted of the deteriorated and/or decayed exterior surfaces on a commercial structure on an unimproved, unoccupied, commercial property. The lien was recorded in the Official Records on August 21, 2018, at O.R. Book 5544, Pages 3609 - 3611, in the amount of $6,511.70. Fines accrued for 2,362 days at a rate of $200 per day, starting from July 3, 2018, through December 19, 2024, totaling $472,400. The owner brought the property into compliance on December 19, 2024. Code Case CEPM20220004129 - violations consisted of a dangerous structure on the property as determined by the Building Official. The lien was recorded in the Official Records on October 27, 2023, at O.R. Book 6300, Pages 3792 - 3794, in the amount of $100,612.10. Fines accrued for 402 days at a rate of $250 per day, starting from October 14, 2023, through December 13, 2024, totaling $106,750. The owner abated the violation by obtaining demolition permit PRDM241042461, and the Certificate of Completion was issued on December 19, 2024. • Code Case CENA20230003919 - violations consisted of litter/prohibited outside storage, including, but not limited to, cardboard, blankets, cans, and bags on the property. The lien was recorded in the Official Records on December 27, 2023, at O.R. Book 6316, Pages 3741-3743, in the amount of $12,473.45. Fines accrued for 427 days at a rate of $250 per day starting from October 14, 2023, through December 13, 2024, totaling $106,750. The owner brought the property into compliance on December 13, 2024. The Board of County Commissioners voted to allow the Collier County Attorney's Office to initiate foreclosure proceedings on May 28, 2024 (Agenda Item 16 A 12). The Collier County Attorney's Office sent a pre -foreclosure letter via certified mail to Properties of S & O LLC's Registered Agent which was delivered on October 1, 2024. After no response, a foreclosure complaint was filed with the Clerk of Court on December 13, 2024 (Case No. 24-CA-2597). After receiving the foreclosure notice, the owners abated the violations in December 2024 and paid delinquent property taxes. Code Violations related to two other properties belonging to S & O LLC, Folio's 75212920000 and 00131360004, were required to be brought into compliance to be able to qualify for Code Lien Relief. Now that all elements of Resolution No. 2023-90 are met, the property owners are seeking relief. The property is being actively maintained, and the owners are offering to pay $56,064.80 to release the liens. 8/26/2025 Item # 11.E ID# 2025-2567 This item is consistent with the Collier County strategic plan objective to preserve and enhance the character of our community FISCAL IMPACT: Acceptance of a reduced payment of $56,064.84 to settle the liens would be in compliance with Collier County Resolution 2023-90. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed this item and approved it as to form and legality. Majority support is required for approval. This item conforms to the Board's policy contained in Resolution 2023-90.
