Executive Summary
Recommendation to authorize the County Attorney to file a lawsuit on behalf of Collier County Board of County
Commissioners against Gulf Coast Custom Cable, Inc., Sosa Line, LLC and NR Pino Underground, Inc. and any other
responsible parties for $98,824.18 in damages caused to a Water Main, the road, a power pole, a sidewalk, a storm drain,
and adjacent private property located at or near intersection of 6387 Airport Road by J & C Boulevard.
OBJECTIVE: To recover the money spent by Collier County to repair a water main line, a power pole, the sidewalk
and a storm drain damaged by a negligent contractors Gulf Coast Custom Cable, Inc., Sosa Line, LLC and NR Pino
Underground, Inc.
CONSIDERATIONS: On or about September 22, 2021, said entities performed an excavation at or near 6387 Airport
Pulling Road by J & C Blvd., in Collier County, Naples, Florida in the form of a directional drill that bored into the
County’s Water Main at the Intersection, causing damage to a Water Main, the road, a power pole, a sidewalk, a storm
drain, and adjacent private property. The County engaged emergency contractors and allocated staff resources to repair
the County’s Water Main and other damages referenced herein, incurring $98,824.18 in damages. The County
Attorney’s Office sent a demand to Gulf Coast Custom Cable, Inc., the contractor of record, and Gulf Coast Custom
Cable, Inc. has denied liability for this claim.
The County recommends Board approval to file a lawsuit in the Circuit Court to recover the damages. Attached is a
draft copy of the complaint, along with corresponding backup materials documenting the damage and amounts thereof.
By filing this lawsuit to recover damages, the County puts contractor/subcontractors on notice that they will be held
responsible for their negligent actions.
FISCAL IMPACT: The cost to file and serve a Complaint is approximately $450.00 and funds are budgeted and
available in the Risk Management Property & Casualty Fund 5016.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this item.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for
Board approval. – CLD

COMPLAINT
Plaintiff, BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY,
FLORIDA, (“COUNTY”), by and through its undersigned counsel, sues Defendants, GULF
COAST CUSTOM CABLE, INC. (“GULF COAST”), a Florida Profit Corporation, SOSA LINE
LLC (“SOSA”), a Florida Limited Liability Company, and NR PINO UNDERGROUND, INC.
(“NR PINO”), a Florida Profit Corporation (collectively, “DEFENDANTS”), and states as
follows:
NATURE OF CLAIMS, THE PARTIES, JURISDICTION, AND VENUE
1. The COUNTY’s claims stem from damage to the COUNTY’s personal property,
specifically a COUNTY water main line (“Water Main”), owned, operated, and maintained by the
COUNTY, and the resulting cost of repair and mitigation incurred by the COUNTY.

2. This Court has jurisdiction over this matter, as it is an action to recover damages in
the amount of $98,824.18, exclusive of interest, costs, and attorneys’ fees.
3. In personam jurisdiction is properly exercised over DEFENDANTS because
DEFENDANTS are Florida corporations and Florida courts have personal jurisdiction over all
Florida residents. See, e.g., Subic Bay Marine Exploratorium, Inc. v. JV China, Inc., 257 So. 3d
1139, 1141 (Fla. 5th DCA 2018).
4. The COUNTY, as the governing body for Collier County, Florida, a political
subdivision of the State of Florida, and as the ex-officio governing board of the Collier County
Water-Sewer District, an independent special district created by the Florida Legislature, is the
owner of the personal property that is the subject of this litigation and is thus authorized to bring
this action.
5. GULF COAST is a profit corporation organized under the laws of Florida, with its
principal place of business at 10915 U.S. 92, Seffner, Florida 33584, and is authorized to and does
conduct business throughout the State of Florida, including in Collier County.
6. SOSA is a limited liability company organized under the laws of Florida, with its
principal place of business at 3052 Road Runner Road, Zephyrhills, Florida 33543, conducts
business throughout the State of Florida, including in Collier County.
7. NR PINO is a profit corporation organized under the laws of Florida, with its
principal place of business at 3105 27th Street SW, Lehigh Acres, Florida 33976, and conducts
business throughout the State of Florida, including in Collier County.
8. Venue is proper in Collier County, Florida, pursuant to Sections 47.011 and 47.051,
Florida Statutes, because (i) this is an action against a domestic corporation, (ii) Collier County is
where the instant cause of action accrued, (iii) Collier County is where the property in litigation is

located, (iv) the property damage occurred in Collier County, and (v) the amounts due to the
COUNTY are due in Collier County.
FACTUAL ALLEGATIONS
9. In 1993, the Florida Legislature enacted the “Underground Facility Damage
Prevention and Safety Act,” Chapter 556, Florida Statutes (“the Act”), to prevent injury to persons
or property and the interruption of services resulting from damage to an underground facility
caused by excavation or demolition operations. Fla. Stat. § 556.101(3)(a).
10. The Act created a not-for-profit corporation called Sunshine State One-Call of
Florida, Inc. (the “Corporation”), and requires the Corporation to maintain a free-access
notification system (the “One-Call System” or “System”) which excavators can use to notify
owners of underground facilities of planned excavation or demolition activities. See Fla. Stat. §§
556.103, 556.104.
11. The Corporation is comprised of the owners of underground facilities in the State
of Florida, which are called “member operators” by the Act. Fla. Stat. § 556.104.
12. The County is a “member operator” under the Act.
13. Under the Act, “excavators” and “excavating contractors” are required to notify the
System and provide information about a planned excavation at least two full business days before
beginning any excavation. Fla. Stat. § 556.105(1). The System then notifies member operators
with underground facilities near the planned excavation, who are required to “identify the
horizontal route by marking to within 24 inches born the outer edge of either side of the
underground facility by the use of stakes, paint, flags, or other suitable means within two full
business days after the time the notification is received” from the System. Fla. Stat. § 556.105(5)
(emphasis added).

14. Summit Broadband Inc. hired GULF COAST to perform underground boring work
at 6387 Airport Pulling Road by J & C Blvd., in Collier County, Naples, Florida (the “Project”).
15. Summit Broadband Inc. submitted a Right-of-Way Application for the Project
identifying GULF COAST as the Contractor of Record, a true and correct copy of which is
attached hereto as Exhibit “A.”
16. GULF COAST is a licensed Certified Underground Utility and Excavation
Contractor in Florida with a license number CUC1225385.
17. Thereafter, GULF COAST engaged SOSA as a subcontractor to perform the
excavation services under GULF COAST’s supervision and direction.
18. Upon information and belief, SOSA subsequently hired NR PINO to perform
excavation work in combination with SOSA on the Project.
19. Upon information and belief, SOSA nor NR PINO are licensed to perform
excavation and/or underground boring work in Florida.
20. SOSA and NR PINO are “excavator(s)” and/or “excavating contractor(s)” under
the Act because they performed the excavation work at issue.
21. Under the Act, “[w]hen an excavation site cannot be described in information
provided under s. 556.105(1)(a) with sufficient particularity to enable the member operator to
ascertain the excavation site, and if the excavator and member operator have not mutually agreed
otherwise, the excavator shall premark the proposed area of the excavation before a member
operator is required to identify the horizontal route of its underground facilities in the proximity
of any excavation. However, premarking is not required when the premarking could reasonably
interfere with traffic or pedestrian control.” Fla. Stat. § 556.114(3).

22. On September 16, 2021, SOSA’s representative, Angelina Digioia, notified the
System of a planned excavation at 6387 Airport Pulling Road by J & C Blvd. (the “Intersection”).
23. On September 16, 2021, the System sent a Notice to the COUNTY of the
excavation work to begin on September 20, 2021.
24. On or about September 17, 2021, in response to the Notice, the COUNTY provided
a positive response code “3N” and requested that the excavator “white line” the proposed
excavation.
25. The System provides response codes on its website
https://sunshine811.com/response-codes, stating “[n]ext to getting your locate ticket, confirming
and verifying member positive responses is essential to preventing damage to underground
facilities. By comparing what you see at your excavation/dig site to the positive response codes
for your locate ticket, you can determine whether it's safe to begin digging or do some follow up
with the member operator.”
26. The System’s definition of the 3N positive response code on its website
https://sunshine811.com/response-codes is as follows:
3N Unmarked: Locate description is insufficient - white lining is required per s.
556.114(3), F.S. Please contact the utility when white lining is completed.
Excavation site is unmarked. Based on the written description on the ticket, the
locate technician could not determine the exact area that needed locating. White
lining is required per s. 556.114(3), F.S., when the written description of the area
to be located is not understandable and when the marks don't interfere with traffic
or pedestrian control (i.e. placing white marks on the ground could be confused
with the lines already on pavement directing pedestrian and car traffic).
27. On or about September 22, 2021, SOSA and/or NR PINO performed an excavation
at or near the Intersection in the form of a directional drill that bored into the COUNTY’s Water
Main at the Intersection, causing damage to the Water Main, the road, a power pole, a sidewalk, a
storm drain, and adjacent private property.

28. Upon information and belief, at the time SOSA and/or NR PINO performed the
excavation work at issue, SOSA and/or NR PINO had not resolved the COUNTY’s 3N positive
response code.
29. On or about September 22, 2021, GULF COAST’s representative, Carlos Cedeno,
provided the COUNTY with his business card and identified himself as in charge of the directional
drill at the Intersection.
30. “If any excavator fails to discharge a duty imposed by [the Act], the excavator, if
found liable, is liable for the total sum of the losses to all parties involved as those costs are
normally computed.” Fla. Stat. § 556.106(2)(b).
31. Accordingly, SOSA and NR PINO are liable to the COUNTY for the total sum of
the losses to repair the damage caused by SOSA and NR PINO.
32. Moreover, GULF COAST is liable to the COUNTY as a result of its negligent
hiring and supervision of SOSA and NR PINO.
33. All conditions precedent to the relief demanded herein have been performed or
waived.
COUNT I – NEGLIGENCE
(AGAINST SOSA AND NR PINO ONLY)
Breach of SOSA’s and NR PINO’s duty to use System before excavating
34. The COUNTY re-alleges and incorporates by reference its allegations in
paragraphs 1–32, as if fully set forth herein.
35. SOSA and NR PINO had a duty to notify the System and provide information about
their planned excavation at least two full business days before beginning any excavation. Fla. Stat.
§ 556.105(1).

36. SOSA and NR PINO breached the aforementioned duty by failing to notify the
System pursuant to Section 556.105(1), Florida Statutes.
37. SOSA’s and NR PINO’s breach of their duty to notify the System is the direct,
proximate, and foreseeable result of the damage caused to the COUNTY’s damaged Water Main
and immediate surroundings.
38. As a result of SOSA’s and NR PINO’s negligence, the COUNTY incurred
monetary damages including, but not limited to, the $95,824.18 incurred to repair the damaged
Water Main and immediate surroundings, and other direct and consequential damages. Relevant
backup materials, including paid invoices and pictures, are attached hereto as Exhibit “B.”
WHEREFORE, the COUNTY demands judgment against Defendants, SOSA LINE LLC
and NR PINO UNDERGROUND, INC., for damages, together with prejudgment interest and
costs, and for such other or further relief as this Court deems equitable and just under the
circumstances.
COUNT II – NEGLIGENCE
(AGAINST SOSA AND NR PINO ONLY)
Breach of SOSA’s and NR PINO’s duty to use reasonable care and locate underground facilities.
39. The COUNTY re-alleges and incorporates by reference its allegations in
paragraphs 1–32, as if fully set forth herein.
40. Should a member operator not mark its utilities, the Act imposes a duty on
excavators to proceed only “if the excavator does so with reasonable care and if detection
equipment or other acceptable means to locate underground facilities are used.” Fla. Stat. §
556.105(6)(a).
41. SOSA and NR PINO had a duty to use increased caution to use reasonable care and
locate the COUNTY’s Water Main.

42. SOSA and NR PINO breached the aforementioned duty by failing to use reasonable
care and failing to locate the COUNTY’s Water Main before proceeding with its excavation in the
Intersection on or about September 22, 2021.
43. SOSA’s and NR PINO’s breach of their duty to use reasonable care and failing to
locate the COUNTY’s Water Main before proceeding with the excavation is the direct, proximate,
and foreseeable result of the damage caused to the COUNTY’s Water Main and immediate
surroundings.
44. As a result of GULF COAST and SOSA’s negligence, the COUNTY incurred
monetary damages including, but not limited to, the $95,824.18 incurred to repair the damaged
Water Main and immediate surroundings, and other direct and consequential damages. See Ex. B.
45. SOSA and NR PINO are liable to the COUNTY for the total sum of the losses
incurred by the COUNTY as a result of SOSA’s and NR PINO’s negligence. Fla. Stat. §
556.106(2)(b).
WHEREFORE, the COUNTY demands judgment against Defendants, SOSA LINE LLC
and NR PINO UNDERGROUND, INC., for damages, together with prejudgment interest and
costs, and for such other or further relief as this Court deems equitable and just under the
circumstances.
COUNT III – NEGLIGENCE
(AGAINST SOSA AND NR PINO ONLY)
Breach of the common law duty to exercise due care in the performance of work.
46. The COUNTY re-alleges and incorporates by reference its allegations in
paragraphs 1–32, as if fully set forth herein.
47. At all times material and relevant hereto, SOSA and NR PINO had a duty to
exercise due care in the performance of its excavation at the Intersection on or about September

22, 2021, which required SOSA and/or NR PINO to exercise the degree of care that a reasonably
careful excavator would use under like circumstances.
48. SOSA and/or NR PINO breached their duty to exercise due care in the performance
of its excavation at the Intersection on or about September 22, 2021, in the following ways:
a. SOSA and NR PINO knew or should have known that the COUNTY had utilities
in the vicinity of the proposed excavation.
b. SOSA and NR PINO failed to use the System altogether to provide information
about its planned excavation at least two full business days before beginning any
excavation. Fla. Stat. § 556.105(1).
c. SOSA ignored the COUNTY’s positive 3N response requesting that the proposed
excavation be white lined. See Fla. Stat. § 556.114(3).
d. SOSA failed to coordinate with the COUNTY and provide additional information
or a white line of the proposed excavation.
e. SOSA ignored calls the COUNTY made to the representative listed on its System
Notice ticket.
f. SOSA and/or NR PINO performed an excavation by directionally drilling
underneath the Intersection without first locating the COUNTY’s Water Main or
coordinating the excavation with the COUNTY.
49. The damage caused to the COUNTY’s Water Main and immediate surroundings
was the direct, proximate, and foreseeable result of SOSA’s and NR PINO’s malfeasance
described in Paragraph 34, a.– f.

50. As a result of SOSA’s and NR PINO’s negligence, the COUNTY has incurred
monetary damages including, but not limited to, the $98,824.18 incurred to repair the damaged
Water Main and immediate surroundings, and other direct and consequential damages. See Ex. B.
51. SOSA and NR PINO are liable to the COUNTY for the total sum of the losses
incurred by the COUNTY as a result of SOSA’s and NR PINO’s negligence.
WHEREFORE, the COUNTY demands judgment against Defendants, SOSA LINE LLC
and NR PINO UNDERGROUND, INC., for damages, together with prejudgment interest and
costs, and for such other or further relief as this Court deems equitable and just under the
circumstances.
COUNT IV – NEGLIGENCE
(AGAINST GULF COAST ONLY)
Breach of the duty to properly and competently supervise SOSA.
52. The COUNTY re-alleges and incorporates by reference its allegations in
paragraphs 1–32, as if fully set forth herein.
53. GULF COAST, as the General Contractor of Record on the Project, had a duty to
properly and competently supervise its subcontractor, SOSA, and SOSA’s subcontractor, NR
PINO, in the performance of the excavation work.
54. GULF COAST breached its duty to properly and competently supervise SOSA and
NR PINO on the Project.
55. GULF COAST’s breach of its duty to properly and competently supervise SOSA
and NR PINO was the direct, proximate, and foreseeable result of the damage caused to the
COUNTY’s Water Main and immediate surroundings.

56. As a result of GULF COAST’s negligence, the COUNTY has incurred monetary
damages including, but not limited to, the $98,824.18 incurred to repair the damaged Water Main
and immediate surroundings, and other direct and consequential damages. See Ex. B.
WHEREFORE, the COUNTY demands judgment against Defendant, GULF COAST
CUSTOM CABLE, INC., for damages, together with prejudgment interest and costs, and for such
other or further relief as this Court deems equitable and just under the circumstances.
COUNT V – NEGLIGENCE
(AGAINST GULF COAST ONLY)
Breach of the duty to make appropriate investigation of SOSA prior to hiring SOSA to perform
work on the Project.
57. The COUNTY re-alleges and incorporates by reference its allegations in
paragraphs 1–32, as if fully set forth herein.
58. GULF COAST, as the General Contractor of Record on the Project, was
responsible for hiring subcontractors to perform the work on the Project.
59. GULF COAST had a duty to make an appropriate investigation of SOSA prior to
hiring SOSA to perform underground boring work on the Project.
60. GULF COAST hired SOSA to perform specialized work that requires a Certified
Underground Utility and Excavation Contractor license which is beyond the knowledge,
experience, and skill of the average contractor.
61. GULF COAST was required to perform an appropriate investigation into
prospective subcontractors to perform the underground boring work due to the inherent danger or
injuring persons or property and the interruption of essential services resulting from damage to
underground facilities in and throughout Collier County, Florida.

62. If GULF COAST performed an appropriate investigation into SOSA prior to hiring
SOSA as a subcontractor on the Project, the investigation would have revealed that SOSA was
unlicensed and unqualified to perform the underground boring work on the Project.
63. GULF COAST’s breach of its duty to perform an appropriate investigation and hire
a competent and skilled subcontractor to perform the underground boring work on the Project was
the direct, proximate, and foreseeable result of the damage caused to the COUNTY’s Water Main
and immediate surroundings.
64. As a result of GULF COAST’s negligence, the COUNTY has incurred monetary
damages including, but not limited to, the $98,824.18 incurred to repair the damaged Water Main
and immediate surroundings, and other direct and consequential damages. See Ex. B.
WHEREFORE, the COUNTY demands judgment against Defendant, GULF COAST
CUSTOM CABLE, INC., for damages, together with prejudgment interest and costs, and for such
other or further relief as this Court deems equitable and just under the circumstances.
COUNT VI – NEGLIGENCE
(AGAINST SOSA ONLY)
Breach of the duty to make appropriate investigation of NR PINO prior to hiring NR PINO to
perform work on the Project.
65. The COUNTY re-alleges and incorporates by reference its allegations in
paragraphs 1–32, as if fully set forth herein.
66. SOSA had a duty to make an appropriate investigation of NR PINO prior to hiring
NR PINO to perform underground boring work on the Project.
67. SOSA hired NR PINO to perform specialized work that requires a Certified
Underground Utility and Excavation Contractor license which is beyond the knowledge,
experience, and skill of the average contractor.

69. If SOSA performed an appropriate investigation into NR PINO prior to hiring NR
PINO as a subcontractor on the Project, the investigation would have revealed that NR PINO was
unlicensed and unqualified to perform the underground boring work on the Project.
70. SOSA’s breach of its duty to perform an appropriate investigation and hire a
competent and skilled subcontractor to perform the underground boring work on the Project was
the direct, proximate, and foreseeable result of the damage caused to the COUNTY’s Water Main
and immediate surroundings.
71. As a result of SOSA’s negligence, the COUNTY has incurred monetary damages
including, but not limited to, the $98,824.18 incurred to repair the damaged Water Main and
immediate surroundings, and other direct and consequential damages. See Ex. B.
WHEREFORE, the COUNTY demands judgment against Defendant, SOSA LINE LLC,
for damages, together with prejudgment interest and costs, and for such other or further relief as
this Court deems equitable and just under the circumstances.

FIELD OBSERVATIONS: The contractor was working on a 3N ticket that has been 3N’d numerous times. Justin’s
notes were ‘’ White line requested. White line on site runs on the sidewalk and the curb. Spoke to Samir at 7:24 AM
he clarified that he only put the white line down to get all utilities on site located that his white line is NOT his run line.
I asked how far off of the curb and sidewalk contractor would be and he would not give me an answer. pics on ticket
#229108120’’. The morning of the damage Justin Williams called the contact 2 times along with texting the contacts
number and could not get an answer.The contractor never white lined his intended run line and worked on the job
