Executive Summary
Recommendation to approve a Second Amendment to the Radio Tower Lease Agreement with The Chalet of San Marco
Condominium Association, Inc., allowing continued operation of the public safety radio system for emergency
communications by the Public Safety Office.
OBJECTIVE: To approve the Second Amendment (“Amendment”) to the Radio Lease Tower Agreement (“Lease”)
with The Chalet of San Marco Condominium Association, Inc., allowing continued operation of the public safety radio
system for emergency communications by the Public Safety Department.
CONSIDERATIONS: On April 22, 1995, the Board of Collier County Commissioners (“Board”) approved a Radio
Tower Lease Agreement with The Chalet of San Marco Condominium Association, Inc. as Agenda Item 8.F.1. Collier
County has since utilized rooftop space on the north and south walls of the 13th floor cooling tower for antennas, and
440 square feet of firewalled masonry floor space for communications equipment on the southwest corner area of the
14th floor. On July 22, 2008, the Board approved the First Amendment as Agenda Item 16.E.1. The current Lease
expires on August 14, 2025.
The County will continue using the five existing coaxial feedlines and antenna hardware installed between the
equipment room and the rooftop, and the existing waveguide feedline between the equipment room and the rooftop for a
microwave dish. The County proposes a second microwave dish and new waveguide feedline, along side to the existing
dish on the 13th floor rooftop, while continuing to use the 14th floor equipment room. This proposed additional
microwave dish and communication antenna, the fourth antenna in total, will increase monthly rent from $3,422.23 (as
of July 2025) to a proposed $4,264.90, or by $10,112.04 annually. The second microwave dish, the fourth 800 MHz
antenna, and new waveguide feedline help to justify the increase in rent.
Key Terms of the Amendment:
Term: Extended to August 14, 2035, with the County having the option to renew for two additional five-year terms, for
a maximum lease term through August 14, 2045.
Termination: County may terminate with 30 days written notice if approvals necessary for construction or operation are
denied/revoked, costs are prohibitive, or the site is unsuitable. The landlord can only terminate upon the County's
default.
Utilities: The Tenant will continue to be responsible for providing electricity to the County’s equipment.
Rent: $51,178.80 annually, with a 3% annual escalator throughout the remaining life of the Lease.
This item is consistent with the Collier County strategic plan objective maintain a fully responsive, best-in-class
emergency management capability
FISCAL IMPACT: The annual rent of $51,178.80 will be paid from the 800MHz Inter-Governmental Communications
Program account number 1060-140480-644600. These costs were factored into the FY25 budget for fund 1060.
GROWTH MANAGEMENT IMPACT: The item is consistent with the Growth Management Plan.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority vote for Board

RECOMMENDATIONS: To approve and authorize the Chairman to execute the attached Second Amendment to the
Radio Tower Lease Agreement.

Boulevard,Island, Florida 34145, hereinafter referred to as "LESSOR', and Collier County, a political
subdivision of the State ofFlorida, whose mailing address is 3301 East Tarniami Trail, Naples, Flprida 34112,
hereinafler refered to as 'LESSEE".
WITNESSETH
WHEREAS, the LESSEE and LESSOR have previously entered into a Radio Tower Lease Agre€ment ("Lease
A$eem€nt") dated August 22, 1995;
WHEREAS, the LESSEE and LESSOR are desirous ofalncnding the Lease Agreemenl;
NOW, THEREFORE, iD consideraiion of tie covcrants ard agrcoments providcd within the said L€ase
Ag.eement dated August 22, 1995, and Ten Dollars ($10.00) and other valuable consideration, the l-€ase
Agreement is h€reby amended as follows:
l. Section I A is deleted in its cntir€ty and replaced with lhe following:
Approximately four hundred and fofiy (440) square feet of masonry firewalled floor space in the
soutlwest comer area of the fourteenth (l4h) floor.
2. In Section 4 A, the monthly rental 1,2008 shall be Two Thousand One Hundred
Twenty-four Dollars and Seventy-four
3. Except as expressly provided herein, the Agreement remains in Iirll force and effect according to
the terms and condilions contained tierein, and said terms a condilions are applicable h€relo except as
expressly provided otherwise herein.
