OBJECTIVE: The public purpose is to maintain compliance with local, state, and federal laws, regulations, standards, policies and operating permits. This action is to authorize expenditures under an exemption from competive process with the Florida Department of Environmental Protection (“FDEP”), to procure required fees for the Water, Wastewater, Engineering and Project Management, Facilities Management, Solid and Hazardous Waste Management, Transportation Engineering, Parks and Recreation, Development Review and other County divisions. CONSIDERATIONS: Section 8 of Collier County Procurement Ordinance No. 2017-08, as amended, provides that purchases from another government agency authorized to do business in the State of Florida, may be eligible for exemption from the competitive process based upon the determination of the County Manager or designee Procurement Services Director, that approval of such an exemption is in the best interest of the County. The required exemption form, approved by Procurement Services, is attached. The requested exemption will replace current approved exemptions and will allow any County division to use the exemption. FDEP fees are required per various Florida Administrative Codes, including FAC 62-4.050 (Permit Fees), FAC 218.075 (Annual Water District Fee), FAC 62-4.053 (Operator License Fees), and FAC 62.257.301 (Asbestos Notification Procedure and Removal Fee) as examples. FDEP is one of the regulatory agencies overseeing the Collier County Water-Sewer District and various other County divisions. FDEP provides many services to those entities, which require the payment of fees throughout the fiscal year. Examples of the fees that are paid include: • Obtaining water and wastewater operator licenses, which are required in order to operate the regional water treatment plants and water distribution system. • Obtaining or renewing operation permits, including for the water and wastewater treatment facilities, deep injection wells, annual asbestos removal and National Pollution Discharge Elimination System. • Solid Waste local Government Information Systems for tank permit registration fees. • Solid Waste FDEP fees related to construction, stormwater, air and water activities. • The Coastal Zone Management, within the Transportation Engineering Division, manages beach renourishment and pass dredging projects that require FDEP permits. Although the initial permits are usually valid for an extended period, applications for permit modifications still require permitting fees. • Submerged Land Leases provide public access to waterways. The County currently has three Submerged Land Leases with FDEP at the Caxambas, Cohohatchee, and Goodland Marina locations. In addition to the Submerged Land Leases, the County also incurs expenses for operating license fees at the Collier Boulevard Boat Ramp. The maintenance of these leases is essential to continue providing the public with access to waterway launch locations throughout the County. • Permit Application Fees/Operating License Fees (renovations and other related projects) maintain County beach facilities and Conservation Collier Preserve Wetland Restoration. • Permit fees are required for construction projects, including to obtain permission to extend or replace water and forcemains. This item is consistent with the Collier County strategic plan objectives to protect our natural resources and develop integrated and sustainable plans to protect and manage water resources. This item is aligned with the Annual Update and Inventory Report (AUIR) and other planning tools that establish and implement plans for availability and adequacy of Page 1575 of 3949 8/12/2025 Item # 16.C.5 ID# 2025-2412 public facilities and remain in compliance with all regulatory requirements. FISCAL IMPACT: Funds are available in the various County funds and cost centers. The Exemption is for a not-to- exceed amount of $300,000 per fiscal year. GROWTH MANAGEMENT IMPACT: This request meets current Growth Management Plan standards to ensure the adequacy and availability of viable public facilities.
