MINUTES OF THE HEARING OF THE
COLLIER COUNTY SPECIAL MAGISTRATE
Naples, Florida, July 11, 2025
LET IT BE REMEMBERED the Collier County Special Magistrate, having conducted
business herein, met on this date at 9:00 AM in REGULAR SESSION in Administrative
Building “F,” 3rd floor, Collier County Government Complex, Naples, Florida, with the
following persons present:

The Honorable Special Magistrate Patrick H. Neale called the Hearing to order at 9:00 AM. All those
testifying at the proceeding did so under oath.

Jose Jaramillo testified he is working on abating the violation however financial issues have

Director Iandimarino noted Operational Costs and Civil Penalties related to the case have not
been paid and requested the fines beginning to accrue.
Special Magistrate Neale noted the case has been ongoing for a year without resolution.
Special Magistrate Neale, after considering the testimony, DENIED the Respondent’s Motion
for Extension of Compliance Deadline and the fines will begin accruing.

VIOLATIONS: Collier County Code of Laws and Ordinances, Chapter 22, Article VI, Section
22-236. Dwelling that was damaged due to a fire declared by the County
Building Official to be a dangerous structure.

Deadline for a period of 30 days.

VIOLATIONS: Collier County Land Development Code 04-41, as amended, Sections

and vegetation removed from lot and fill brought into lot without issuance of
appropriate Collier County permits or other approvals.

Officer Packard and Assistant County Attorney Richard Tomasko represented the County.
Luce Goemaere and Liping Wu testified their attorney submitted a summary on their “Right to
Farm.”
Special Magistrate Neale noted he read the summary and the County’ submittal and queried on
the use of the property before they purchased it.
Mr. Goemaere testified:
A contractor owned the property for 20 years and utilized it for storage.
They purchased the property for agricultural use and continued to mow the open areas,
repaired the fencing, re-graded existing material on site and brought in approximately 600
animals.
They currently have bee hives on site, sell honey/eggs, breed and sell cows and are working
with the South Florida Management District on any permits required for their cleared areas.
When he purchased the property, he met with County officials and was told he didn’t need
any permits for the operation and obtained an agricultural license from the State of Florida.
Immediately thereafter the County notified him permits may be required for some activities.
The only vegetation he removed was Melaleuca as it can be dangerous if animals consume
it as he lost 2 donkeys due to poisoning.
He contends he doesn’t need a permit from the County for clearing land for agricultural use.
Officer Packard requested the fines begin to be imposed as the violation has not been abated.
Special Magistrate Neale noted approximately a year ago, Mr. Goemaere signed a stipulation
agreeing to abate the violation.
Mr. Goemaere stated he made a mistake when he signed the stipulation as the County Code
Enforcement Official told him it was the most favorable avenue to address the issue.
Mr. Tomasko noted the stipulation was signed on June 6, 2024 and Mr. Goemaere never
requested a re-consideration in the matter.
Special Magistrate Neale noted Mr. Goemaere appeared at the hearing and stated he understood
the terms of the stipulation at the time he signed it.
Mr. Tomasko stated even with the bona fide agricultural use, a permit for vegetation removal from
the South Florida Water Management District and County notification of land clearing or issuance
of a permit is required.
Officer Packard noted representatives of the South Florida Water Management District have
referred the case to counsel for lack of progress.
Mr. Goemaere noted his attorney is working with South Florida Water Management District and it
has been difficult engaging an environmental engineer for an agricultural project.
Special Magistrate Neale, after considering testimony and factors of the case, DENIED the
Respondent’s Motion for Extension of Compliance Deadline and the fines will begin accruing.

a final inspection to confirm abatement. If the Respondent fails to abate the violation the
County may abate the violation and may use the assistance of the Collier County Sheriff’s

He noted a permit was obtained and expired however the Governor’s office may issue an
extension until the August timeframe but no request has been made by the Respondent.
Ms. Brown objected to the testimony as it was not relevant to the case.
Special Magistrate Neale Overruled the Objection.
Ms. Brown testified the fire occurred on July 4, 2023 as the result of a firework discharged in the
neighborhood. Mr. Lamento is in litigation with the neighbors and abating the violation is a
financial burden. An award of damages through the legal process will provide funds to address the
issue. He has obtained a proposal to demolish and rebuild the structure at a cost of $700,000,
however he does not have the funds for the work. She requested a 12-month continuation in the
case.
Speakers
Ms. Brown objected to the neighborhood individuals providing testimony as it is not relevant to
the case.
Special Magistrate Neale Overruled the Objection.
Patricia Campbell, President, Riveria Golf Estates noted the property is in violation of
Association rules and a fine has been imposed on the owner. The property is infested with rats and
other wildlife and the lawn areas have not been mowed.
Larry Day, Adjacent homeowner noted wildlife and other animals are present in the home and it
has not been boarded. The building is detrimental to potential home sales in the area. The property
owner was not carrying insurance which is a violation of the community’s governing documents.
Letitia Clark noted the property is detriment to her home in the community and recommends it be
demolished as there is a mold issue associated with the building. It is her understanding the Fire

Marshall determined the fire was not caused by a firework – During questioning by Ms. Brown,
Ms. Clark noted she is not an expert in mold or causes of fires.
Marcia Reff, noted she has lived adjacent to the property for 30 years and the property is a blight
on the community as the hedges are overgrown and the home harbors rats and other wildlife.
Ms. Brown objected to the testimony of the speakers noting homeowner association issues are not
relevant to the case.
Special Magistrate Neale noted he would consider the testimony in relation to the speaker’s
observations and not expert testimony on any of the issues.
Special Magistrate Neale queried why there has been no progress in abating the violation.
Officer Musse noted the garage door opening has been boarded but the rest of the building is
unsecured. The home has been declared a Dangerous Building by the County.
Eugene Lamaento, owner, testified he is in litigation with the neighbors and homeowners’
association to obtain the necessary funds to abate the violation and construct a new home. He
alleged the prior hearing where he was found in violation of the ordinance was improper.
Special Magistrate Neale, after hearing the testimony and considering the factors of the case,
GRANTED the County’s Motion for Imposition of Fines and Liens in the amount of
$25,311.80 with fines continuing to accrue. Said amount payable within 30 days of this
hearing and become a lien on the property.

master bathroom causing water damages to the drywall and floor.

violation and he provided photographs of the work. A permit application has been submitted for
any necessary work and a “correction letter” was issued by the County on July 2, 2025.
Special Magistrate Neale CONTINUED the case to the October 2025 Special Magistrate hearing
date with fines continuing to accrue. Operational Costs for today’s hearing in the amount of

Gary Carman, Attorney represented the Respondent testifying some items have been abated and
routine refuse patrol has been instituted on the property. Repairing the asphalt on site is a major
project which will take additional time (approximately 120 days). A check in the amount of
$4,372.60 has been issued to the County to pay for past Civil Penalties and Operational Costs due
for several cases.

1. Pay Operational Costs in the amount of $111.70 incurred in the prosecution of this case
within 30 days of this hearing.
2. Obtain all required Collier County Building Permit(s), or Demolition Permits, Inspections
and Certificate of Completion for the repairs to the roof to bring the property into
compliance with the requirements of the Collier County Property Maintenance Code
within 60 days of this hearing or a fine of $250.00 per day will be imposed until the
violation has been abated.
3. Notify Code Enforcement Investigator when the violation has been abated in order to
conduct a final inspection to confirm abatement. If the Respondent fails to abate the
violation the County may abate the violation and may use the assistance of the Collier

Claudia Hernandez de Leon represented the Respondent and read a letter into the record
explaining she is in the middle of resolving construction, legal and permit issues associated with
the purchase of the property and requested 6 months to abate the violation. Additionally, she
engaged a contractor to assist in the matter and after paying a deposit, it was determined he was
unable to perform the permitting work and returned her deposit. Subsequently, she engaged
another contractor who is working on obtaining the necessary permits for the work performed.

Special Magistrate Neale, after hearing the testimony and reviewing the evidence, found the
Respondent GUILTY of the alleged violation and was ordered to:

application which should be completed this week. Financial issues delayed abating the violation.

Fact” permit.

with abating the violation and communication with the Respondent has been limited.
Ms. Acosta testified the consultant is working on the permit application today and they were
unaware permits were required to rebuild the area as it was damaged by Hurricane Ian.
Director Iandimarino requested the fines be imposed.
