Changes to specialty licenses Michael Bogert, Licensing Supervisor As part of Florida's statutory preemption of local contractor licensing, effective July 1, 2025, our jurisdiction will officially sunset 24 local specialty licenses. This action is in compliance with the State's directive under FlorRecertifytes 49.113 and 49.117 and related legislative amendments which restrict local governments from issuing and requiring licenses for contractor work not subject to State certification or registration. The list of 24 specialty licenses slated for sunset can be found, on page 12 of the Agenda packet. These licenses were previously reviewed by myself and the former Contractor Licensing Supervisor, Timothy Crotts, in consultation with Assistant County Attorney Ronald Tomasco. Any questions from the board? Kyle Lantz So if I want to hire now a painter, they just have to have a tax certificate? Michael Bogert That is correct. Kyle Lantz And there's no government checking now to see if they have workers comp. or anything of that sort. Michael Bogert We do not regulate the license, so we will not be looking for those standards. Kyle Lantz So if you show up to a job site and somebody has a painter there who doesn't have workers comp. there's no punishment. Michael Bogert We would not be going after them. That would be on the responsibility of the GC to make sure whoever is working for them would have the appropriate insurances. Page 4 of 194 3 Kyle Lantz So I can get all my painters and tile setters and make them subs and save a bunch of money. Take a little risk, save some money. 7. REPORTS None 8. Wayne Gonzalez, WG Construction Enterprise Inc., Review of Experience Michael Bogert • Mr. Gonzalez has submitted an application for the issuance of the license as a registered residential contractor, which requires 48 months of experience. Mr. Gonzalez currently holds a Collier County excavation license with issuance 201-90000332 under SSS Excavator, LLC. As part of the application process for the issuance of a registered residential contractor license, Mr. Gonzalez was required to submit documentation showing his experience. • As part of the review process by staff, Mr. Gonzalez has submitted the following verification of experience documents. Review of these documents shows the following Verification of construction experience. Submitted by Samuel Rodriguez, president and qualifier for Triple S Excavator, LLC. State License CGC 1535397. • Dates of employment are from 2006 through 2009. Mr. Gonzalez scope of work is listed as preparing land for future homes and spend time with masonry, block and concrete work. • Verification of construction experience number two. Submitted by Carlos Castillo, president of CC Grading Services Corp. an unlicensed business entity. Dates of employment are from 2015 through 2017. Mr. Gonzalez's scope of work is listed as job site operations operator, taking measurements, elevation and set hubs for paths and driveways. • Verification and construction experience number three. Submitted by Oscar Hernandez, president and qualifier for Hurricane Shell and Steel, Inc. State License CGC 1532454. Dates of employment are from 2020 through 2025. Mr. Gonzalez scope of work is listed as daily operations, scheduling, job site operations, supervision, permitting, planning and inspections. • Four reference letters have also been submitted recommending Mr. Gonzalez for roles as a salesperson and installer of windows and doors, as well as for supervisory responsibilities on various construction sites. Based on the information received, it is staff's opinion that Mr. Gonzalez does not meet the minimum requirements as set forth in the Collier County Code of Laws and Ordinances, Section 22183A1 and 22183B1 as it Page 5 of 194 4 relates to experience and time required in the trade under section 22162, residential contractor. • Mr. Gonzalez is being referred to the Board under section 22184B. Referral of application to the Contractor's Licensing Board for a decision. Mr. Wayne Gonzalez I've been driving Tampa, Miami for over four years. I want to be here, sell small things, like home additions, and remodeling. Additionally, all cabinets and countertops were installed. • Verification of construction experience number two. Submitted by Ray Elaine, president and qualifier for Acadian Inc. State certified general contractor with license CGC 1505003. Dates of employment are listed from January 2016 through present. Mr. Paredes scope of work is listed as manages all phases of construction, permitting and completion. • Verification of construction experience number three. Submitted by Allan Hancock, owner and qualifier for Hancock Plumbing, Inc. License CFC 1428957. Dates of appointment are listed as January 2017. Through presentation, Mr. Paredes scope of work is listed as repair, replace, tile, drywall and framing. • Three reference letters have also been submitted recommending Mr. Paredes based on his experience in residential and commercial construction, including work involving electrical and plumbing. • Based on the information received, it is staff's opinion that Mr. Paredes does not meet the minimum requirements as set forth in the Collier County Code of Laws and Ordinances, Page 6 of 194 5 Section 22183 and 22 183B1 as it relates to experience and time required in the trade under section 22162. Registered building contractor. • Mr. Paredes is being referred to the Board under section 22 184B. Referral of application to the Contractor's Licensing Board for decision. Mr. Diego Paredes Since 2016 working hand to hand with a lot of contractors, especially the ones that have the qualifications doing renovations, remodeling houses, additions, commercial trades. Separate from that, I supervised the jobs for them. I was responsible for doing the whole project from framing to drywall until it's finished. I would like to enter the preamble and packet for case number 2025- 07 Kyle Lantz motioned to accept the packet Richard Joslin seconded Motion passed 9-0 Michael Governale • The respondent, Glenn Allen Montgomery Jr. A Collier County licensed landscaping restricted contractor with issuance number 202-200-002950 is the qualifier for and owner of Premier Landscape and Pool Design LLC. • Mr. Montgomery contracted and received payment to remove the existing driveway pavers and replace them with shell stone pavers and to rebuild the front stoop that included a step down and footer located at 338 Fourth Ave north in the city of Naples without a permit where one is required. • Mr. Montgomery appeared before the Contractor Licensing Board in December 2024 regarding obtaining an aluminum contractor license in which he chose to withdraw his application. • Mr. Montgomery is in violation of Collier County code of laws and ordinances section 22 2012, which states in pertinent hart that it is a misconduct for a holder of a Collier county certificate of competency to contract to do work outside the scope of his or her competency as listed in his or her competency card and is defined in this ordinance or as a restricted by the Contractor Licensing Board. • Mr. Montgomery is also in violation of Collier county code of Laws and Ordinances, Section 22 20182, which states in pertinent part that it is a misconduct by the holder of a Collier County certificate of competency to proceed on any job without obtaining permits or inspections from the city building or zoning division or the county building review and permitting department. Mr. Glen Montgomery • In regards to the driveway itself, I honestly did not realize a permit was needed. It was an existing driveway that was there. • We were simply there to remove the pavers and replace them with new. We also removed pavers from the backyard. There was a walkway back there, and we replaced that with sod. • The setbacks and all of the existing driveway were within the parameters of the required setbacks in the county. I originally submitted a permit on March 26 to the city of Naples for that, and I paid the fee, but I did not hear back from anybody, so I ended up getting educated. Mike and Larry have both been gentlemen. I didn't realize it was in it right away. Otherwise I would have gotten a permit for it. • I didn't change the pervious or impervious coverage at all. I thought I didn't need a permit, and I'm being very honest about that because we're just changing basically pavers from old to new. Chairman Allen motioned to close the public hearing Page 8 of 194 7 Richard Joslin seconded Motion passed 9-0 Patrick Neale • Should you find Mr. Montgomery guilty, the options are a race revocation of the Collier County or City certificate of competency, suspension of the certificate of competency, a denial of the issuance or renewal of Collier county or any other certificate of competency, a period of probation not to exceed two years during which his activities shall be under the supervisor of the Board restitution, a fine not to exceed $10,000. • A public reprimand, a re-examination request. Requirement for denial of the issuance of Collier County or City building permits or requiring issuance with conditions and reasonable investigative and legal costs for the prosecution of this. • In determining the sanctions to be imposed, you to consider five different elements. • The gravity of the violation, the impact of the violation on the public health, welfare or safety, any actions taken by the violator Trust. • The Violations, any previous violations committed by him, any other evidence presented at the hearing by the parties relevant as to the sanction, which is appropriate for the case, given the nature of the violation and the violation. Michael Bogert • For count one, working outside the scope, contracting outside the scope of the license, the County requests a respondent to pay a fine in the amount of $1,000. This fine shall be paid within 30 days from today's date. Failure to pay in the 30 days would just result in the start of the lien process. • For count two, for commencing work without a permit, the County requests the respondent to pay a fine in the amount of $1,000. • This fine also shall be paid within 30 days from today's date. Failure to pay that one in 30 days would result also in the start of the lien process. Matthew Nolton motioned to find him guilty on his own admission Richard Joslin seconded Motion passed 9-0 Kyle Lantz motioned to fine him $1,000. Payable within 30 days on count 2 and no fine for count one Motion failed Richard Joslin motioned to adopt the County’s recommendation for the 2 fines for count 1 and count 2 and that the permit is issued within 30 days. If the permit is obtained within 30 days, then the fine for count 2 would go away and he only has to pay the $1,000. for count 1. Terry Jerulle seconded Motion passed 9-0 Chairman Allen • The respondent is the holder of the license as set forth in the administrative complaint. The respondent was present at the hearing and not represented by council. The Board has Page 9 of 194 8 jurisdiction over the respondent and subject matter raised in this administrative complaint. The respondent committed the violations as set forth in count one and count two of the Administration administrative complaint. • Therefore, by a vote of 9 in favor and 0 opposed, the respondent is found guilty of the violation set forth in count one and count two in the administrative complaint. And the board imposes the following sanctions against the respondent. In count one, there is a fine of $1,000 payable within 30 days. • For count two, there is a $1,000 fine payable within 30 days. If he is able to secure the permit, the right of way permit within 30 days, the fine will be waived. • And if both are not paid, or then both fines will eventually go to the lien process. That accurately represents that and a return to the CLB if it's not done. Chairman Allen motioned to open the 2nd public hearing. The respondent was present at the hearing and was not represented by counsel. The Board has jurisdiction over the respondent and the subject matter raised in the administrative complaint. • The respondent committed the violations as set forth in count one and count two of the administrative complaint. Therefore, by a vote of eight in favor and one opposed the respondent is found guilty of the violation set forth in count one of the administrative complaint. • The board imposes the following sanctions against the respondent. The respondent is required to pay a fine of $1,000 within 30 days. If that fine is not paid, then it will result in a lien. 11. On July 16, 2024, Scott Ctvrtnik, Site Plans Reviewer II (Fire) placed a CO Hold on permit# PRMFH20230416452 for unpermitted demo work in 5334 Treetops Dr. 8. On February 6, 2025, Scott Ctvrtnik, Site Plans Reviewer II (Fire), met with Mr. Kallie at 5334 Treetops Dr and identified work commenced outside the scope of permit # PRMFH20230416452. Mr. Ctvrtnik notes to Mr. Kallie were: His work shall require a revision to be submitted by the contractor, signed and sealed by a design professional, including all additional work performed, electrical intent and electrical pages for work performed, and electrical contractor added to the Permit. 9. On March 7, 2025, a review of County records revealed permit PRMFH20230416452 had been applied for on April 19, 2023, and issued June 6, 2023, with subsequent issued and rejected revisions. 10.On April 25, 2025, the last revision to permit# PRMFH20230416452 was rejected with no new permit progress. 11. On June 24th, 2025, a Notice of Hearing to appear before the Collier County Contractors' Licensing Board on July 16th, 2025, at 9:00 a.m. was served by United States Postal Service certified mail to the Respondent, PETER J KALLIE. A Phone call to PETER KALLIE on July 7, 2025, confirmed he was aware of the hearing time, date and place. 12. Based on the investigation, and pursuant to the Code of Laws and Ordinances of Collier County, Florida Section 22-201 (2), the Contractors' Licensing Supervisor determined sufficient cause exists to warrant the filing of formal charges. 13.
