Agenda 07/08/2025 Item #16F 2 (Second Amendment to the Lease Agreement with Collier Mosquito Control District)7/8/2025 Item # 16.F.2 ID# 2025-1978 Executive Summary Recommendation to approve the Second Amendment to the Lease Agreement with Collier Mosquito Control District, allowing Collier Mosquito Control District to continue the operation of radio communication equipment previously installed on the County-owned communications tower at 2901 County Barn Road, Naples, FL 34112. OBJECTIVE: To approve the Second Amendment (“Amendment”) to the Lease Agreement (“Lease”) with Collier Mosquito Control District to extend the lease term for space on a County-owned communication tower. CONSIDERATIONS: The Board of Collier County Commissioners (“Board”) approved a Lease Agreement with Collier Mosquito Control District (“District”) on June 13, 2000, Agenda Item 16.E.4 granting the District access to tower space of the County’s communications tower located at 2901 County Barn Road, Naples, FL 34112. The First Amendment to the Lease Agreement was approved by the Board on June 9, 2020, Agenda Item 16.C.1. and is set to expire on July 12, 2025. This location is essential for the District’s radio communications equipment for mosquito control operations within Collier County. Key Terms of the Amendment: Term: The term is extended to July 12, 2030. Provided it is not then in default, the District has the option to renew for three additional five-year terms, allowing for a potential maximum lease term through July 12, 2045. Termination: Either party may terminate the Lease at any time, with or without cause, by providing a thirty-day written notice. This provision remains unchanged from the original Lease Agreement. Utilities: County will continue to provide electricity to the District’s equipment. Rent: $1,579.73 annually, and will continue escalating at 3% annually for the remaining life of the lease. The First Amendment established the annual escalation at 3%. This lease agreement is consistent with the Collier County strategic plan objective to plan and build public infrastructure and facilities to effectively, efficiently, and sustainably meet the needs of our community. FISCAL IMPACT: The annual rent shall continue to be deposited into Intergovernmental Radio Communications Program account number 1060-140480-362110. GROWTH MANAGEMENT IMPACT: The item is consistent with the Growth Management Plan.
