Executive Summary
Recommendation to approve and authorize the Chairman to approve a Budget Amendment for the Florida Opioid
Settlement Funds to transfer existing funds from the Collier County Seniors Fund (1806) Projects 44059 and 44085 to
the Opioid Regional Abatement Grant Fund (1850) Project 44059 and the Opioid City/County Grant Fund (1852) Project
44085 in the amounts of $3,857,643.09 and $921,562.89 respectively. (Funds 1850 and 1852)
OBJECTIVE: Utilize the funds received from the Florida Opioid Settlement Fund to address the opioid epidemic, to
support the County's strategic objective of promoting access to health, wellness, and human services to benefit Collier
County residents.
CONSIDERATIONS: A local, state, and national opioid crisis arose because of the manufacturing, distribution, and
overprescribing of opioids, and resulted in opioid abuse, misuse, overdoses, addictions, and death throughout
municipalities, counties, states, and the nation. These activities contributed to the public health emergency and crisis
commonly referred to as the opioid epidemic. Collier County and the municipalities therein have suffered from this
crisis, which has caused and is causing an undue strain on local government finances to implement programming to
combat the opioid epidemic. These funds may be used to mitigate the harmful effects of the opioid epidemic in the
community and increase educational campaigns to counteract misinformation about the addictive nature and harmful
effects of opioids and opioid abuse.
The National Opiate Litigation filed by the State of Florida and various local governments against pharmaceutical
companies has resulted in numerous settlements, to be distributed to the State of Florida over multiple years. On June
22, 2021 (Agenda Item #16.K.8) meeting, the Board of County Commissioners (Board) approved Resolution No. 2021-
136, authorizing Collier County to join with the State of Florida and other local governments as a Participant in the State
Memorandum of Understanding (MOU) and approved participation in the Florida Plan for the Florida Opioid Settlement
agreement.
As part of the settlement, two (2) allocations will be received annually over the next eighteen (18) years: City/County
and Regional Abatement. On April 11, 2023, the Board approved the initial City/County allocation in the amount of
$289,151.06 (Agenda Item #16.D.5) and the Regional Abatement fund allotment in the amount of $2,628,842.15 on
June 13, 2023 (Agenda Item #16.D.3).
On June 25, 2024, the Board approved its second-year allocation (Agenda Item #16.D.7), in the amount $650,019.83 for
City/County and $1,241,219.04 for Regional Abatement received on January 1, 2024, and recognized and interest
payment of $1,310.30 for Regional Abatement received on April 24, 2024. An amount of $16,741.88 in additional
City/County funding was anticipated and was not received. This will be reconciled once we move the funds out and
close the remainder of the balance in project 44085. On April 22, 2025, (Agenda Item #16.D.6), the Board approved its
third-year allocation in the amounts of $399,277.79 and $1,542,962.85 for City/County and Regional Abatement,
respectively. The Opioid settlement funds have transitioned to Grant Funds, necessitating the transfer from 1806 to 1850
and 1852.
The Opioid Settlement Funds were recently assigned a Catalog of Stated Financial Assistance (CFSA) number,
changing the funds from Collier County Seniors Fund 1806 to State funds. This change required an internal transfer of
funds from non-grant Fund 1806 to the Opioid Regional Abatement Grant Fund 1850 and the Opioid City/County Grant
Fund 1852.
Supports the County's strategic objective of promoting access to health, wellness, and human services to benefit Collier
County residents.
FISCAL IMPACT: Budget amendments are necessary to recognize the transfer of existing funds from the Collier
County Seniors Fund (1806), Project 44059, to the Opioid Regional Abatement Grant Fund (1850), Project 44059 for
the amount of $3,857,643.09 and from the Collier County Seniors Fund (1806) Project 44085, to the Opioid
City/County Grant Fund (1852), Project 44085 for the amount of $921,562.89. The additional anticipated amount
referenced in the Year 2 ES was not received; therefore, the amount transferred to Fund (1852) Project 44085 is

16,741.88 less than the current Fund (1806) budget. There is no match requirement associated with this program.
GROWTH MANAGEMENT IMPACT: There is no Growth Management impact associated with this item.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal issues and
requires a majority vote for approval. -JAK
