Agenda 07/08/2025 Item #16B 7 (Repeal the prior Developer Agreement and Amendment with Hogan Farms LLC, and approve a Developer Agreement with Hogan Farms LLC, (Developer))7/8/2025 Item # 16.B.7 ID# 2025-2240 Executive Summary Recommendation to repeal the prior Developer Agreement and Amendment with Hogan Farms LLC, (Developer) and approve a Developer Agreement with Hogan Farms LLC, (Developer) that reserves capacity within the Transportation Concurrency system in exchange for donated land to the County for the future widening of Immokalee Road; allow the option for the Developer to excavate the pond site during their site development; distribute the fill to the adjacent Collier County Public Utilities site; a cost sharing and reimbursement plan and continue the commitment to swap land to accommodate intersection improvements at Camp Keais Road and Immokalee Road. (This is a companion to item 16.C.2) OBJECTIVE: For the Developer to provide right-of-way to support future capital improvements including Immokalee Road widening, Immokalee Road & Redhawk Lane intersection improvements, excavate the County’s Pond site, distribute the fill to the adjacent Collier County Public Utilities site and swap lands for improvements to the intersection of Immokalee Road and Camp Keais Road. CONSIDERATIONS: Based on growth in the area, the County may need to expand Immokalee Road in the vicinity of the project. To facilitate future expansion, additional right-of-way along the frontage of the Brightshore Stewardship Receiving Area, as well as stormwater management will be required. The Developer has agreed to donate 100’ of land along the southern property boundary to accommodate the widening, as well as a pond site to facilitate future stormwater management needs. In lieu of reimbursement, the County will reserve capacity within the transportation concurrency system. The Developer has committed to design and construct intersection modifications at their project entrances along Immokalee Road including but not limited to a traffic signal within one year of a request from the County. Hogan Farms LLC will also assist with a property exchange to facilitate future realignment of Camp Keais Road and Immokalee Road. The Developer has agreed to provide all successors, assigns, tenants and buyers, both residential and commercial, who purchase or lease land from the Landowner a separate written notice of the planned Immokalee Road improvements with the statement that the County will not construct or contribute funding for the construction of any sound wall or other barriers of any kind to reduce the impact, noise, etc. Also, if the County elects, the Developer will excavate the County’s Pond site location and distribute the fill to the adjacent public utility site. The County will agree to pay the developer an amount not to exceed $130,624 for the completion of this work. In addition, the Community Development District will maintain the pond site area until such time as the County widens Immokalee Road and utilizes the pond site. This item supports the Infrastructure and Asset Management Strategic Focus Area of the Strategic Plan by planning and building public infrastructure to effectively and efficiently meet the needs of the community. FISCAL IMPACT: The County will be responsible for a portion of the design and construction costs associated with the pond site excavation estimated to be $130,624. The County shall incur the costs to reimburse the Developer; these costs will be paid from Gas Tax Fund. GROWTH MANAGEMENT IMPACT: This item meets current Growth Management Plan standards to ensure the adequacy and availability of viable public facilities.
