Executive Summary
Recommendation to approve the release of a code enforcement lien with an accrued value of $470,850 for a reduced
payment of $27,007, in the code enforcement action titled Board of County Commissioners vs. Veronica Tressler,
Barbara Dethloff, and Elizabeth Lucky, in Code Enforcement Board Case No. CEROW20150023031, relating to the
property located at 231 Willoughby Dr., Collier County, Florida.
OBJECTIVE: To have the Board of County Commissioners accept an offer to release a code enforcement lien with an
accrued value of $470,850 for a reduced payment of $27,007 in Code Enforcement Board (CEB) Case No.
CEROW20150023031.
CONSIDERATIONS: In Case No. CEROW20150023031, the CEB ordered the imposition of a lien against Veronica
Tressler, Barbara Dethloff, and Elizabeth Lucky for a code violation at 231 Willoughby Dr. The violation consisted of a
culvert drainage pipe requiring repair or replacement located in the right-of-way. The lien was recorded in the Official
Records on March 24, 2022, at O.R. Book 6102, Pages 1015-1017, in the amount of $297,059.49. Fines continued to
accrue for 3,139 days ($150 per day from September 24, 2016, through April 28, 2025), totaling $470,850. The owner
brought the property into compliance on April 28, 2025.
Pursuant to Resolution No. 2023-90, a request for a reduction of fines may be considered when payment of the lien
would impose severe financial hardship on the owner. The property located at 231 Willoughby Drive was passed down
by survivorship from Otto and Elsa Steppes to their three daughters, Veronica Tressler, Barbara Dethloff, and Elizabeth
Lucky.
Sadly, Ms. Lucky's sister, Barbara Dethloff passed away in 2022, and her sister Veronica Tressler, who resided at 231
Willoughby Drive, passed away in 2024, leaving Elizabeth Lucky as the sole survivor, as recorded in the Official
Records on April 15, 2025, at O.R. Book 6458, Page 2163.
In 2016, a Right of Way Permit (PRROW2016062461) was issued to restore the culvert. Unfortunately, the culvert
failed inspection. In 2021, a second Permit, PRROW20210416949, was issued, and after paying contractors nearly
$17,000, the job was abandoned, leaving Ms. Tressler in financial distress while daily fines continued to accrue.
After the passing of Veronica Tressler, Ms. Lucky's last remaining sister, she was left burdened with the unexpected
costs of an issue she was unaware of and did not create. After expending over $36,000 of emergency funds on property
taxes, legal fees, and restoration costs, Permit PRROW20250311870 was issued, and the violation was abated on April
28, 2025.
The property is being actively maintained, and Mrs. Lucky requests that her family's current health and financial distress
be taken into consideration by providing lien relief, which would involve waiving all accrued fines and releasing the
lien. However, Code Enforcement recommends accepting payment of $27,007.
The recommended payment of $27,007 is ten percent of the Collier County Property Appraiser's assessed property value
of $270,070 and meets the criteria outlined in Resolution 2023-90. There are currently no known violations on the
property.
This item is consistent with the Collier County strategic plan objective to preserve and enhance the character of our
community.
FISCAL IMPACT: Acceptance of a payment of $27,007 to settle the lien will correlate to what is outlined in Collier
County Resolution 2023-90.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and

legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution

We would like to outline our current situation as it relates to the property on 231 Willoughby Drive,
Naples, Florida.
This property belonged to my parents, Otto and Elsa Steppes. Their wishes were that upon their death
the home would be passed down to the four daughters by Survivorship.
My sister Veronica Tressler lived with my parents in this home and served as my mother's care taker
until my mother's death in 2000.
She also served as my sister Patricia Martin's caretaker when she was struck with breast cancer. Patricia
died in 2006.
Veronica continued to live with my father at this home until his death in 2010.
As the home had been left in survivorship, my sister Barbara and I felt it was only fair that Veronica
continue to live there. My sister Barbara and I both live in Texas and never lived in the home at any time.
My sister Barbara passed in 2022, and Veronica suddenly passed on Novem ber 8, 2024.
Upon my sister's passing we went to Naples for the funeral.
It was at this time that I became aware of the issues that the property had with Collier County Code
Enforcement. I was never aware of any financial difficulties that my sisterwas having. lwasneveraware
that my sister was struggling to keep up with any maintenance on the home. I was never aware she had
liens placed against the property. I was not aware that she was having health issues other than what a
person has once they hit their 70s. We never received any correspondence from the county or from my
sister regarding the fines, liens and tax issues with the county. My discovery of all the issues happened
in December of 2024.
It was from the Collier County City View website that I discovered the situation with the Right of
Way/Culvert failures. I discovered from the unpaid taxes that my sister had serious financial difficulties.
I learned that she had paid S17,000.00, in cash, to have the culverts redone, only to have them fail and
the person who had done the work was in the wind. My sister fully intended to have culverts compliant
with County Codes. But she was a 76 year old infirmed woman who exhausted her financial resources
and fell upon hard times.
After we completed our research we immediately started plans to rectify every issue that was
outstanding.
All back taxes were paid.( see pages 1.2.3.4.5)
All outstanding fees/fines, other than the Right of Way, were paid and cleared. ( see pages 6 & 7 )
We researched and found a reputable company to complete the Culvert/ Right of Way issues. This work
was completed on April 24'h We received confirmation on April 28th that the Right of Way had passed
county inspection.

I come before you to appeal the very heavy fines that were laid on the property.
You can see we have resolved all of the outstanding issues quickly. The Right of Way / Culvert issue that
had been spinning for 10 years has been resolved. We have acted in good faith, and done the right thing
to correct the issues that the County has laid before us.
But this has been a terrible and unexpected financial burden on us.
These large expenses, and all the miscellaneous expenses so far have cost us approximately 536,000.00
and have taken all of our emergency funds. (see pages 8 & 9)
These savings were already strained due to my being the principal bread winner for my family, but
having lost my job due to downsizing of my company in 2023. I have yet to find new employment.
( see page 10)
My husband's company suddenly closed in 2024. He too, is still unemployed. ( see pages 11 & 12 )
My breast cancer treatment since 2019 and my husband's joint replacements surgeries also have
burdened our attempt to save for our retirements.
We still have 9 years left on our mortgage for our home in Texas. Under our current lack of
employment, and our outstanding current mortgage we cannot afford to keep two homes. (see page 13)
I know that the above issues are the same that many families have to deal with, but please understand
that we, as quickly as we could, rectified all of the outstanding issues my sister had with the County and
we took the responsibility for issues that we were unaware of and had not created. At the same time we
are in our late 60's and 70's and had been trying to responsibly manage our financial lives and these
totally unexpected expenses have depleted our savings.
We ask that the County consider our issues and financial situation, and kindly dismiss all fines, and
remove the lien from the property.

KNOW ALL MEN BY THESE PRESENTS: That the BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA is the owner and holder of a certain lien against all real and
personal property owned by:
Veronica Tressler, Barbara Dethloff and Elizabeth Lucky,

The lien was recorded on March 24, 2022, in Official Records Book 6102, Pages 1015-1017, in
the Official Records of Collier County, State of Florida. The lien secures the principal sum of two
hundred ninety-seven thousand fifty-nine dollars and forty-nine cents ($297,059.49), plus accrued
interest and penalties, if any, and imposes certain obligations against real property situated in
Collier County, Florida.
Collier County, a political subdivision of the State of Florida, by execution of this Release and
Satisfaction of Lien, acknowledges payment as approved by the Board of County Commissioners
as satisfaction of the lien and hereby cancels and releases said lien.
The Clerk of the Circuit Court is hereby directed to record this Release and Satisfaction of Lien in
the Official Records of Collier County, Florida, to acknowledge that the lien ceases to exist.
